OF THE
• Tf2t1CKEE DONNER PUBLIC UTILITY DISTRICT
EFFECTING A COMPENSATION ADJUSTMENT
FOR THE GENERAL MANAGER
WHEREAS, the Board of Directors deems it appropriate for the General Manager to receive a
compensation adjustment;
NOW, THEREFORE, BE IT ENACTED by the Board of Directors of the District that effective thirty
days from the date of passage of this ordinance the following action occur.-
1. That the General Manager receive a 4% salary increase retroactive to January 1,
1996.
2. That the General Manager receive an 8%salary increase retroactive to January 1,
1997, making his adjusted annual salary $88,895.
3. That the Deputy District Clerk of the District be directed to publish this ordinance in
accordance with the laws of the State of California.
PASSED AND ADOPTED by the Board of Directors at a meeting duly called and held within the
District on the second day of July 1997 by following roll call vote:

RESOLUTION NO. 9713'
OF THE
TRUCKEE DONNER PUBLIC UTILITY DISTRICT
IMPLEMENTING AND FIXING ELECTRIC STANDBY CHARGES
FOR THE FISCAL YEAR 1997-98
WHEREAS, on February 18, 1975, the Board of Directors of the Truckee Donner Public Utility
District duly adopted Ordinance No. 7501 fixing electric standby charges on lands within the District
boundaries and providing a means for collection thereof, and
WHEREAS, on August 16, 1982, the Board of Directors adopted Resolution No. 8240 amending
Ordinance 7501 to include Placer as well as Nevada County; and
WHEREAS, Ordinance No. 7501 prescribes that implementation of the actual charges shall be
made by resolution of the Board for each fiscal year:
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Truckee Donner Public
Utility District as follows:
1. The electric standby charge for the fiscal year 1997-98 shall be the sum of$20 for
any parcel consisting on one acre or more, and the sum of$10 for any parcel of less
• than one acre.
2. The District shall determine the lands to be affected thereby for the current fiscal
year and the charges to be assessed, levied and collected on the lands and parcels,
and upon the completion thereof a subsequent resolution shall be approved fixing and
placing the electrical standby charges on the District tax roll for collection by Placer and
Nevada Counties.
3. Certified copies of this resolution are to be forwarded along with the direct charges
to the County Auditor of the County of Placer and the County Auditor of the County of
Nevada.

FIXING AND PLACING ELECTRIC STANDBY
CHARGES ON DISTRICT TAX ROLL FOR COLLECTION BY THE
COUNTIES OF PLACER AND NEVADA
WHEREAS, on February 18, 1975, the Board of Directors of the Truckee Donner Public Utility
District duly adopted Ordinance No. 7501 fixing electric standby charges on lands within the District
boundaries and providing a means for collection thereof,' and
WHEREAS, on August 16, 1982, the Board adopted Resolution No. 8240 amending Ordinance
7501 to include Placer as well as Nevada County; and
WHEREAS, on July 2, 1997 the Board adopted Resolution No.9713 implementing and fixing
electric standby charges pursuant to Ordinances 7501, 9103 and 9105 for the fiscal year 1997-98;

WHEREAS, the District has now determined the lands affected thereby and the charges to be
assessed, levied and collected on the lands and parcels;
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Truckee Donner Public
Utility District as follows:
1. That the Board of Supervisors of the County of Placer, State of California, and
the County of Nevada, State of California, levy the standby charges against the
parcels and owners of record listed on the computer itemization of unimproved
parcels kept and maintained in the Administrative Services Department of the
District and made a part hereof by reference, and that the County Auditors and
Tax Collectors be instructed to levy and collect said charges in the same
manner as County taxes as by law and in said ordinance provide. Upon
completion and correction of the current list through June 30, 1997, a copy will
be forwarded to the Auditor Controller of each County.
2. The District warrants and represents that charges imposed by the District and
being requested to be collected by Placer and Nevada Counties comply with
all requirements of state law, including but not limited to Articles X111C and X111D
of the California Constitution (Proposition 218).

3. That certified copies of this resolution be forwarded to the County Auditor of the
County of Placer and the County Auditor of the County of Nevada.

. We were recently informed that the Truckee PUD is considering approval for erection of a
wireless communication antenna by Pacific Bell Mobile Services in conjunction with WestStar
Communications on the Ponderosa Palisades water tank site. It is my understanding that the
antenna would be located in the open space immediately behind our home, which is located at
I I280 Skyline Court.
On reviewing the deed of 1962 written at the time the land was originally developed for PUD use,
it is stated unequivocally that the property is to be used solely for water and electric facilities. No
provision was made for use by communication services or other private enterprises. It is my
understanding that the provisions of this deed are still in effect I strongly oppose the use of this
land by any enterprise other than the Truckee PUD.
As a radiologist, I am concerned about exposure to electromagnetic radiation that may be emitted
by this antenna. I am aware of potential health hazards that may result from exposure to
electromagnetic radiation and I would expect that the Truckee PUD would be liable for any
adverse health effects resulting from such exposure. I am also obviously concerned about the
negative aesthetic effects such a structure would have on the enjoyment of our property and the
potential negative effect on our property value. Alternative sites for erection of this structure are
available in undeveloped areas where these negative factors would be less of an issue.
I wish for this letter to be read and recorded in the proceedings of the July 2n° meeting since I am,
unfortunately, unable to attend. If this issue escalates into a legal action to protect the welfare of
the home owners bordering the PUD property, I would fell obliged to participate.

• following:
It is important to understand that the Public Utility Districtahas
no legal right to allow this type of use of its property.
agreement with the developer, C. S. Beavers, of April 10, 1962,
which agreement was subsequently recorded, the Public Utility District
was granted this parcetfor the restrictive purposes of "construction,
maintenance and installation of utility works, facilities, and
appurtenances". Inasmuch as the proposed project is not a utility
use by the Public Utility District, as expressly and implicitly
contemplated by the agreement, the use contravenes the Public Utility
District's restrictive covenant and they cannot be permitted to use
their property in this manner.
We find it quite distressing that this piece of land, given to the
Public Utility District for one specific purpose, i.e, water, is
again being considered for other purposes.
Please be sure that this letter of complaint is read at the Regular
Meeting tonight.

Dear Mr, Holzmaister.
Please submit this letter at the PUD meeting to be held July 2nd and put it on record for us.
As a home owner in Ponderosa Palisades whose lot boarders the PUD water tank we wisb to
protest the use of that site for a Pae Bell Mobile telecommunication facility. The lot was deeded
• to the PUD to be use for only one purpose - for a water tank and the necessary maintenance
buildings and roads. We chose this location for our home because of the natural setting, we have
no fancy club house, nor underground utilities;-but we do have peace and quite and no
e intend to do everything in our power to maintain
commercial buildings or sites in the area. W
that peace and quite. We do not wish to see a large communication center towering over our
homes and the tree tops.
Please help us protect our property and neighborhood by not allowing this illegal use of the
property intrusted by the developer to the PUD. I doubt that any of you would like a tower such
is planned in your back yard.
