COMPLETE:AND DIRECTING THE FILING OF THE NOTICE OP COMPLETION
WHEREAS, the Board of Directors of the Truckee Donner Public Utility District made the
determination to go forward with the 1994 Water System Improvements Project which consisted
of construction of the Prosser Heights hydropneumatic pump station, the Prosser Annex well and
storage tank, approximately 3,900 lineal feet of pipeline, road construction, site work, installation
of a sand separator at the Airport well and other related work; and
WHEREAS, the Contract was awarded to Wunschel & Small, Inc., P. O. Box 799, Fair Oaks,
California 95628 and the contractor entered into an agreement with the District to perform the
work, and
WHEREAS, the District's Consulting engineer, Sauers Engineering, Inc., has recommended that
the work be accepted by the District,
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Truckee Donner Public
Utility District as follows:
1. That the District hereby accepts the Proposition 55, Safe Drinking Water Bond Law 1994 Water System
Improvements Project.
2. That the Clerk of the District be directed to file with the County of Nevada the Notice of Completion,
a copy of which is attached hereto.
3. That 35 days following the filing of the Notice of Completion, the all% retained from the contractor
payments be released to the contractor if no claims have been made to the District by material
suppliers or laborers.
PASSED AND ADOPTED by the Board of Directors of the Truckee Donner Public Utility District
at a meeting duly called and held within said District on the third day of July 1995 by the following
roll call vote:
AYES: Hemig, Maass, Sutton and Jones.
NOES: None.
ABSENT. Aguera.

FILING OF THE NOTICE OF COMPLETION.
WHEREAS, the Board of Directors of the Truckee Donner Public Utility District made the
determination to furnish and install a pump and electrical and piping facilities in the new
Prosser Annex Well and replace a well pump and substantial electrical equipment at the
Northside Well, and
WHEREAS, the Contract was awarded to Clayborn Contracting Group, Inc., Drawer
106203, Auburn, CA 95602 and the contractor entered into an agreement with the District
to perform the work; and
WHEREAS, the District's Consulting engineer, Sauers Engineering, Inc., has
recommended that the work be accepted by the District;
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Truckee Donner
Public Utility District as follows:

WHEREAS, the Truckee Donner Public Utility District has determined the need to acquire Cooper
Power System reclosers and microprocessor-based recloser controls, and
WHEREAS, Public Contract Code Section 20206.4 generally requires that the District seek
competitive bids in connection with the purchase of goods; and
WHEREAS, various California court decisions, including Graydon v. Pasadena Development
A.cent 105 C.A. 3d 631 (1980), hold that if the subject of a contract is such that competitive
proposals would be unavailing or would not produce an advantage, and the advertisement for
competitive bid would thus be undesirable or impractical, a public agency may dispense with
competitive bidding; and
WHEREAS, the District has a large investment in the Cooper Power Systems reclosers and
• controls, using them exclusively; and
WHEREAS, the exclusive use of Cooper Power System reclosers and controls reduces costs in
inventory of parts; and
WHEREAS, the exclusive use of Cooper Power System reclosers and controls allows for inter-
changing within the system; and
WHEREAS, the exclusive use of Cooper Power System reclosers and controls does not require
additional training of District personnel; and
WHEREAS, the exclusive use of Cooper Power System reclosers and controls will be more
compatible with future SCADA plans; and
WHEREAS, the exclusive use of Cooper Power System reclosers and controls has the potential
of shortening outages by staff being familiar with the same equipment from station to station; and
WHEREAS, due to the facts set forth above, competitive bidding would be unavailing and would
not produce an advantage to the District, and the advertisement for competitive bids and the
delay that would therefore result, would be undesirable;
• NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Truckee Donner Public
Utility District as follows:
1. That the recitals set forth above are adopted as findings and for the reasons set
forth herein finds that competitive proposals for the above described electrical
apparatus would be unavailing, would not produce an advantage to the District and
the advertisement for competitive bids and the resulting delay would be
undesirable.
2. That District staff is hereby authorized to dispense with competitive bidding and
purchase Cooper Power System reclosers and microprocessor based recloser
controls at this time and in future years.
PASSED AND ADOPTED by the Board of Directors at a meeting duly called and held within the
District on the 5th day of July 1995 by the following roll call vote:
AYES: Hemig, Maass and Jones.
ABSTAIN: Sutton.

WHEREAS, the Board of Directors of the Truckee Donner Public Utility District has determined
the need to purchase its annual supply of poles and funds have been set aside in the 1995
budget for the purchase of such poles;
NOW, THEREFORE, BE IT RESOLVED that the Board of Directors of the Truckee Donner Public
Utility District does hereby authorize staff to issue a call for bids based on the District's standard
specifications for poles, and that the date and time established for the bid opening is August 1,
1995 at 2:00 PM.
