Attached is a copy of the bills for Board consideration. Among the bills that are listed are
bills from Sandel/Avery Engineering in the amount of $49,631.22 and Porter, Simon,
Graham, Phelps and Cuttitta for$506.00 for work performed on the SCADA project. The
funding for this project is scheduled to come from the COP financing.
RECOMMENDATION
1. Authorize payment of the bills in the usual manner.
2. if the pills from SandellAveryand Porter,Simon, Graham,Phelps and Cuttitta
are approved, authorize staff to transfer the money for payment out of the
Certificates of Participation funds on deposit with the Local Agency
Investment Fund to reimburse the general fund.

9. Chlorination stations contract
Attached are two memoranda, one from Pat Sutton and the other from Keith Knibb. As
1 understand the issue, James Maneatis changed the form of his business from a sole
proprietorship to a corporation. The change occurred after submitting the bid but before
performing any work on the job. John Phelps is suggesting that we agree to assigning
the contract to JJM Engineers - Constructors, Inc, which is the legal name of James
Maneatis' business now that it is incorporated.
2. Installation of wafer meters
Please take a look at Dave Rully's memorandum of March 22, 1993, copy attached.
Dave wrote this memo to me to clarify why he has been installing water meters on
existing services at the time new homes are being built. The reason Dave gives is
financial.
I believe there is another reason to install water moters on existing services. I would like
to begin to get a handle on the amount of water used by residences in Truckee. I would
like to begin to develop a data base of water use to help us understand how much water
is used at landscaped versus non-landscaped homes, at different elevations, and so on.
This data base will help us focus water conservation programs in the future and will help
us design a water rate when that becomes required.
I hope the Board will agree to permit us to continue this program.
3. Truckee Fire District request for a radio repeater site
Please review Dave Rully's memorandum regarding the request of the Fire District for a
radio repeater site. I think the Board needs to make this decision, If the Board agrees
to allow TFPD to use Donner View Station, we will work out the details with the Fire
District and place this matter on a future agenda.

This is to inform you that there are some potential problems
regarding the chlorination station contractor ' s license ,
which need to be resolved as soon as possible .
According to the information received by the Board at the
time of bid award on March 15 , 1993 „ the bid was submitted
by James J . Maneatis . According to public information I
obtained from the State License Board , the individual License
#365952 issued to James J . Maneatis has been on inactive
status since April 16 , 1993 . James J . Maneatis is the
qualifying individual for a new license , #669449 , issued in
April to a corporation named JJM Engineers-Contructors , Inc .
If James J . Maneatis provided the District with a Bidder ' s
Bond in the name of the sole proprietorship and under his
Individual Owner ' s License number , which was in effect at the
time of the bid opening and bid award , has his bonding
company issued the construction bond in that name or in the
name of the corporation and the new corporate license number?
This matter had better be straightened out before construc-
tion begins on the chlorination stations . And when I say
that this matter needs to be straightened out , I expect for
there to be a report to the Board regarding the fact that
the consultant , Sauers Engineering , Inc . , approves that the
work will be performed by a company different from the
company which was the low bidder on the job , and that the
work will be performed under a different license number than
the one used by the original bidder at the time of the bid
opening and the award of the bid , and perhaps on the contract
with the District .
In order to assure that the District ' s interests are protect-
ed , I request that Counsel for the District review this
matter and actively participate in determining any recommen-
dations for the Board ' s consideration .

SUBJECT, Chlorination Stations Contract
Dear Peter:
This letter is in response to the April 23, 1993 memo titled "Memorandum #2" to you
from Patricia Sutton, TDPUD Director. In her mcm.o, Mrs. Sutton refers to potential
problems regarding the contaactc is license for the Chlorination Station contractor.
. laving researched this issue and having contacted the Contractor's State License Board,
the contractor and District's Legal Counsel, I offer the following comments,
Subsequent to entering into the Chlorination Stations Contract with the District, the
contractor, James J. Maneatis, transferred his business from. a sale proprietorship to a
corpora.tion, The name of the new corporation is JJM Engineers-Constructors, Inc. 011..
April 16, 1993, the CoBtractors State License Board issued a new license to JJM
Engineers-Constructors, TDc. with Jaynes Maneatis as the License Qualifier. On that
same day, James Maneatis voluntarily inactivated the license used for his former sole
proprietorship. It is this inactivated license number that is indicated in the Chlorination
Station Contract Documents.
According to James Maneatis, the new corporation is wholly awned by him and he is the
sole shareholder. Mr. Maneatis has agreed to provide the District with documents
relating to the incorporation including proof of James Maneatis as sole shareholder Lind.

No Notice to Proceed has yet been issued for this contract. John Phelps indicated to nee
that in order for this contract to remain valid, it should be assigned from .Tams J,
Maneatis to the new corporation, and that the decision of assignment of the, contract
should be based in Fast on the information provided by the contractor regarding
incorporation. Also, to proceed under the current contract, the contractor should
provide new insurance and bond certificates for the corporation.

Re: Domestic Water Meter Installations 1993
Peter,
At the March 15th Board meeting, there was some discussion as to
the appropriateness of my decision in 1992 to retrofit water
meters on all services that my staff encountered while doing new
service "open trenches" .
I accept full responsibility for this decision, basing it
primarily on expediency and cost effective operating procedures .
The cost of the additional meters used in 1992 was less than 2%
of the water meter restricted fund. The cost to install there
while a crew is on site with an "open trench" provided by the
customer, is a minimal additional operating cost compared to
making a special trip to the service location with a truck and
backhoe to excavate the box at some later date .
I anticipate that within the next 5 weeks we will again be doing
new service hook-ups . It was my intention to follow the same
procedures that we did in 1992 .
Until the last Board meeting I did not consider this to be an
"issue" that needed the Board' s attention, ( `'my mistake" ) . Are
there factors other than cost effective operation that I need to
take into account in this situation?
I request direction in this matter.

Subject : Truckee Fire Dist. Request For Radio Repeater Site, (see
attached letter April 8 1993)
Joe Delee on behalf of the Truckee Fire Protection District has
approached me with a request to use our Donner View Station and
Tank site for a radio repeater. Apparently their present repeater
site at Ponderosa Palisades Hydro ( Ski-Tow Hill ) has been
experiencing a lot of radio interference making their
communications difficult. This is forcing them to look for a more
reliable site.
I have discussed this with SA Engineering to make sure that TFPD's
radio frequency is compatible with our new SCADA system and the
Truckee Sanitary District's repeater which has been located at this
site for about 10 years now. They have assured me that there is no
conflict with the frequencies .
There are a few other questions that come to mind on this subject,
one being housing space. Donner View Station is very small with a
limited amount of useable wall space. When our SCADA system
hardware is installed there will not be any more room.
Joe Delee has inspected the site and concurs with the space
limitation. He is willing to build a small structure attached to
the rear of the station to house their equipment. This would be
acceptable to me and would eliminate the need for them to have an
access key to our facility.
Truckee Sanitary District presently has an antenna on Donner View
Tank. Our SCADA system will add a second antenna and TFPD would
make three. This is a water tank, I am a bit concerned with the
aesthetics and that it might now appear to be a radio tower as
well .
To my knowledge no one has ever complained about the existing
antenna and it is entirely possible no local residents will ever
notice the addition of two more.

TSD shares the cost of snow removal with us and I would expect TFPD
to do the same. The electrical requirements to heat a separate
building might be considerable and we may wish to have them install
their own electrical service panel, rather than use power through
our station.
In the spirit of cooperating with the other local districts I would
recommend that the TDPUD allow the TFPD to proceed with their
repeater installation at Donner View. They would like an answer as
soon as possible. My question is, who is authorized to give it to
them, The Board, Yourself or Me?
