Holley Date: February 20, 2008 Subject: Adoption of an Ordinance Why this matter is before the Board: This item covers the adoption of an Ordinance for the Miscellaneous Fees Schedule. This is a matter that only the Board can determine. Mission Objective 6. Manage the District in an effective, efficient and fiscally responsible manner. Mission Goal 6.6 Develop appropriate financial procedures to assure responsible financial management. History: Two workshops were held on January 9th and 23rd, 2008 to discuss amending the miscellaneous fees schedule. Overall costs have been reviewed and it has been determined that an adjustment to the fees were necessary. New information: There is no new information. The draft ordinance is attached. Recommendation: I recommend the Board adopt the Ordinance amending the Miscellaneous Fees schedule to be effective in 30 days. Michael D. Holley, General Manager t s i n a Ew DistrictPublic Utility Ordinance No. 2008 - Amending the Miscellaneous Fees Schedule WHEREAS, the District has not increased the Miscellaneous Fees Schedule for many years; and WHEREAS, the cost of material and labor have increased considerably since the last time the Miscellaneous Fees Schedule was updated; and WHEREAS, an analysis was prepared to determine the cost to provide the various services performed by District employees; and WHEREAS, the Board has directed staff to charge fees to recover the cost of performing the services listed on the Miscellaneous Fees Schedule, a copy of which is entitled Exhibit A and is attached hereto; and WHEREAS, the Board wishes to impose fees in a fair manner to its customers and others requesting services; and WHEREAS, the Board of Directors has held two workshops to discuss the proposed increases; and WHEREAS, the Board of Directors has directed staff to publish the proposed fee schedule in the local newspaper one time for two separate weeks, post the fee schedule on the District's website and make the fee schedule available at the front counter during this period; and WHEREAS, the Board of Directors has held a public hearing on February 20, 2008 to receive public comment on the proposal to update the Miscellaneous Fees Schedule. NOW, THEREFORE, BE IT ORDAINED that the Board of Directors of the Truckee Donner Public Utility District does hereby enact the following: Section 1 The Board of Directors hereby adopts the above recitals as its findings. Section 2 Payment and collection of services performed and listed on the Miscellaneous Fees Schedule (Exhibit A attached): The person, company or organization requesting the service shall pay and the District will collect the fees listed on the Miscellaneous Fees Schedule for the performance of any of the services listed thereon. When possible, fees will be collected in advance of District staff 1 Ordinance 2008- performing such services. Otherwise, the District will bill the person, company or organization requesting to have such service performed for the fees or actual charges incurred. In cases of damage to District facilities, the District will bill the responsible party. Section 3 Methods of payment Payment may be made by any method that has been established by the District for that service. Persons, companies or organizations will be informed of the available methods of payment at the time of the charge or at the time of the billing. Section 4 Future Miscellaneous Fees schedule updates District staff will update this schedule each year for the Board's consideration. Section 5 Effective with the effective date of this Ordinance, all prior resolutions and ordinances pertaining to the Miscellaneous Fees Schedule are rescinded and of no further force and effect. Section 6 This ordinance shall be effective thirty (30) days after the date it was adopted by the Board of Directors. Section 7 The Clerk of the District shall immediately cause a copy of this ordinance to be published in a newspaper of general circulation and posted in three places within the District.
