The electric standby charge for the fiscal year 1992-93 shall be the sum of $20 for any parcel consisting of one acre or more, and the sum of $10 for any parcel of less than one acre. 0 The District shall determine the lands to be affected thereby for the current fiscal year and the charges to be assessed, levied and collected on the lands and parcels, and upon the completion thereof a subsequent resolution shall be approved fixing and placing the electrical standby charges on the District tax roll for collection by Placer and Nevada Counties. 3. The Clerk of the District is hereby directed to forward certified copies of this resolution to the Board of Supervisors and the County Auditor of the County of Placer, and the Board of Supervisors and the County Auditor of the County of Nevada. Craig, Deputy Distr t Clerk smc/a:1SB-2W.RES -RESOLUTION NO. 927 5 fJF TNS TRUCKEE DONNER PUBLIC UTILITY DISTRICT. ,ESTA BL ISHINC POLICY IO Y REGARDING INTEREST PAID ON CONSUMER DEPOSITS AND RESCINDING ,PREVIOUS RESOLUTIONS WHEREAS, the Truckee Donner Public Utility District has been paying interest on consumer deposits at the rate of 5 114% for several years; and WHEREAS, the interest rate on regular passbook savings accounts has decreased substantially; and WHEREAS, the Board of Directors wishes to establish a procedure that would allow staff to review and adjust the interest rate paid on deposits on a more regular basis and that such rate would reflect the interest rates paid by the local banking institutions on regular passbook savings accounts; NOW, THEREFORE, BE IT RESOL VED by the Board of Directors of the Truckee Donner Public Utility District as follows: 1. Staff is hereby directed to adjust the interest rate paid on deposits on a quarterly basis beginning July 1, 1992 to reflect the average rate paid at that time by the local banking institutions on regular passbook savings accounts. 2. From this time forward, unless otherwise required by law, it will not be necessary to notify the customers affected each time the interest rate changes. 3. The Manager's Report, on a quarterly basis, will provide the Board with any changes made in the consumer deposit interest rates. 4. Provisions of previous resolutions conflicting with this new procedure are hereby rescinded. Box 309 Truckee, CA 96160-0309 Dear Peter: Re: Standby Charges At your request, Sauers Engineering, Inc. has reevaluated the Water System Standby Charge for this year. Results of the reevaluation indicate that the current Water System Standby Charge of $80.00 per parcel per year is still appropriate. Based on the most current special district taxrolls, it was determined that there are now 4,480 parcels in the District which are eligible for water system standby charges. This is up from 4,201 eligible parcels last year. Using the 1992 Budget and the Water System Standby Charge Engineer's Report dated February 1991, as a model, the appropriate portion of the budget attributable to standby customers was determined to be $351,077. This is also up from last year's $347,404. The calculation of water service standby charge is as follows: $ 351,0771yr 4,480 pel _ $78.37/pcl-yr. AUTHORIZATION The Board of Directors, at a regular meeting on February 4 , 01991 , did discuss the District ' s water system standby charges . The Board of Directors , at that meeting authorized and instructed the District ' s consulting engineer to prepare an engineer ' s report of standby charges consistent with the requirements of appropriate legislation . 2 . ENABLING LEGISLATION In 1975 the District implemented a standby charge program pursuant to the provisions of California Public Utilities Code Section 16475 . More recently the Uniform Standby Charge Procedures Act has been adopted by the state legislature . This act is found at California Government Code Sections 54984-54984 . 9 . A copy of the act is appended to this report as Appendix A. The act applies to Truckee Donner Public utility District , and this Engineer ' s Report is prepared pursuant to the applicable provisions of the act . 3. HISTORICAL in 1975 the District , pursuant to Ordinance No . 75-01 , adopted a standby charge for electricity and water which is made available to District customers whether they use these services or not . A copy of Ordinance No . 75-01 and its companion adoption Resolution No. 75-04 are attached as Appendix B for reference purposes . 4 . STANDBY CHARGES REVIEW In the event that the District intends to utilize the Uniform Standby Charge Procedures Act, it must comply with components of the act described below. i ( 1 ) The District may apply the charge system-wide, or may apply it to a particular zone . Additionally, the charge may vary based on land use , benefit derived from the use or availability of facilities , degree of availability of the use of water , quantity of the use of water , area of a parcel , frontage of a parcel and/or on a per parcel basis . Prior to adopting the standby charge schedule, the District must have prepared by a qualified engineer a report as described in further detail in Chapter 6 of this report . The District may initiate standby charge proceedings by adoption of a resolution referring to the engineer ' s report ; a description of the lands upon which the charge is to be imposed ; the amount of the charge for each parcel ; and the date , time and place upon which the governing board will hold a public protest hearing . 54984 . 3 (b--d) ) 5 . PARCELS AFFECTED Water supply facilities have been provided to serve approximately one-half of the parcels in the District . Active water services presently include 369 commercial services and 5 , 168 residential services , for a total of 5 , 537 services . There are many vacant parcels which have a public water supply available . Pursuant to District Ordinance 75-01 availability of water is defined as further described in the following section . The District staff maintains a tabulation of parcels which fit this criteria, and such tabulation is available for review at the District office . There are 4, 106 parcels less than one acre and 95 parcels one acre or larger , for a total of 4, 201 parcels . is ( 2) 6. ENGINEERS REPORT A. A description of the charge and the method b which it will be iMDOsed. The water standby charge shall be an $80.00 charge imposed by the Truckee Donner Public Utility District on all vacant parcels within its water service area for which water is deemed available (as described in paragraph 6 (D) below) , except those parcels of vacant land permanently dedicated exclusively to transportation of persons or property. The method by which the water standby charge shall be imposed shall be that ,the District shall notify the Auditor Controller of the County in which the parcel is located on an annual basis, and direct that such charge be imposed upon all parcels to which it is applicable, and collected by the County with other property assessments, and distributed by it to the District. B. A compilation of the amount of the charge posed for each arcel subject to the char-Fe. A charge of $80.00 shall be imposed on each parcel subject to the charge, regardless of the size of the lot, its use, or its location within the District. C. A statement of the method and rationale followed in determininz the de ree of benefit conferred by the service for which the charge is made. As indicated above, the District currently has 5,537 active customers, (57 percent of total customers) and 4,201 inactive or standby customers (43 percent of total customers) . Set forth in Appendix "C" , "WORSH,EET" is a synopsis of the District's 1991 water department budget allocations, and beside each general cost item is a breakdown of the amounts that are properly chargeable to active customers, and the amounts that are properly chargeable to inactive or standby customers. As indicated on attachment "C" , $347,404.00 of the total water department budget of $2,151,037.00, or 16 percent -of the total budget, is properly allocable to inactive or standby customers. This amount, $347 ,404.00, divided by the District's total inactive or standby customers (4,201) , yields a per parcel charge of $82.70, which has then been rounded off to $80.00 per parcel per year. D. Other factors listed in Section 54984.2 Based on the method and rationale described above, and the compilations contained in the "WORKSHEET" (Appendix "C") , the benefit conferred upon parcels for which water service is available has a value of at least $80.00 per year. Based on the analysis conducted, it was determined that all vacant lots for which water service is available derive a similar benefit from such availability. Until a parcel is developed, it is impossible to determine what its actual water use will be. As a result, it is not equitable or feasible to base the standby charge on anticipated land use, area of the lot, frontage, or similar factors. For the same reason it is not equitable or feasible to base the charge on particular zones of benefit within the District, or pressure zones, or 3 subdivisions. The District's existing standby charge, which has been in effect for over fifteen years, is applied on a per parcel basis, whenever there is a istrict water distribution line not less than two inch in diameter installed ithin 100 feet of the nearest exterior boundary line of such parcel. This method has worked effectively for over 15 years, and the District has received virtually no objection, to this method from its existing customers. Considering all factors, the District's existing method is the most equitable method and is recommended. 7. SUMMARY OF RECOMMENDED STANDBY CH.JRGE The rate for the water standby charge shall be an annual charge of $80.00 per parcel, regardless of parcel size, applied to each parcel in the District for which water service is available but not used. Resolution by governing body of local agency The governing body of the local agency shall adopt a resolution to initiate proceedings to fix a standby charge. The resolution shall contain all of the following: (a) A statement that the report of a qualified engineer is on file with the agency and that a standby charge is proposed based upon the report. The report shall include all of the following: (1) A description of the charge and the method by which it will be imposed. (2) A compilation of the amount of the charge proposed for each parcel ' subject to the charge. (3) A statement of the methodology and rationale followed in determining the degree of benefit conferred by__the service for which the charge is made. (4). The other factors listed in-Section $4,84.2. (b) A description of the lands upon which the charge is to be imposed. Assessor parcel numbers shall constitute sufcient description for this : purpose. (c) The amount of the charge for each of the lands so described. (d) The date, time, and place upon which the govening body will hold a public protest hearing regarding the imposition of the charge, and notice that the governing body will hear and consider all objections or protests, if any, to the proposed charges. A protest by a landowner shall contain a description sufhciert to identify the land owned by the landowner. A written protest may be withdrawn at any tirne before the determination on the charge by the governing body. (b) If the governing body receives written protests which are not withdrawn at the time of determination by the governing bode, which protests represent 40 percent of the parcels subject to the charges authorized by this chapter, no further proceedings may be had under this chapter until a period of one year shall have passed from the time of the initiation of this procedure. (c) If the governing body receives written protests which are not withdrawn at the time of the determination by the governing body, which protests represent 15 percent or more of the parcels subject to the charges authorized by this chapter the governing body may still adopt, revise, change, reduce, or modify a charge, but all the-charges are ineffective until collectively approved by a majority of the vote in an election within the affected territory in Which the owner of one or more parcels may cast one vote for each parcel owned within the affected territory. Added stats 1988 ch 834 sec 1. _ ..... § 54984.7, Charges in successive years If the procedures set forth in this. chapter have been followed in a given i year, the governing body may, by resolution, continue the charge in successive years at the same rate and in the same manner, but dispensing ,%ith the requirement for mailed notice. The local agency shall cause notice of the intent to adopt the resolution' to be published pursuant to Section 6066, prior to the date set for adoption, and shall hear any and all objections at the time and place set forth in the notice.
