SUBJECT; STAFF REPORT
1. WATER QUALITY REPORT - Attached is the water quality report for the month of
June 1992.
2. ELECTRICAL CONDUIT IN NEW BRIDGE - R. W. Beck, in our draft master plan, is
talking about needing a river crossing to bring another circuit out of Martis Substation to
tie to Truckee circuit #2. This will help remove some of the load from the older, smaller
capacity Truckee Substation and serve it from the newer, larger capacity Martis
Substation.
To facilitate this future upgrade in our system, we would like to install two six inch
conduits on the new bridge downtown. At this point, we do not have all the details
worked out; Keith Sauers and R. W. Beck are working with CalTrans on the specifics.
Since the bridge is already under construction, we need to move quickly if we are to
succeed. We think the cost will be under$20,000. Facilities fees are available to cover
this cost.
I would like the Board's concurrence that staff should be proceeding with this project.
3. RECRUITMENT OF PLANNING MANAGER - I have completed the process of
recruiting a person to head the Planning Department. His name is Scott Terrell. He is
currently Energy Conservation Manager at Turlock Irrigation District. He has several
years experience in the energy conservation field, and has supervised a staff of three
energy auditors. He has a bachelor's degree in environmental science and a masters
degree in education. He comes highly recommended by staff at NCPA and WAPA,
where he has earned a statewide reputation for being an innovator in energy conservation
and customer services. He appears to have very strong interpersonal skills, so he will
work well as a member of the management team we are building.
I offered Scott a starting salary of $55,000; he currently earns $54,000. Attached is a
recent notice of job vacancy in the City of Anaheim. As you will see, persons with Scott's
knowledge are able to earn up to $80,000 per year at a level lower than department
head. Scott will help us as we focus our attention on being helpful and responsive to our
customers. He will start work on September 9, 1992.

Subject: Monthly Bacteriological Report _ June, 1992
Attached is the "Summary of Bacteriological Water Quality" report
for the month of June 1992 .
As you can see, the report shows that all of the 39 samples taken
within the District's distribution system were free of coliform
. bacteria, and met the State's drinking water standards. In addition
43 of the 44 samples taken at the District's sources were also free
of bacteria.
Three of the four samples taken at the Northside well were free of
bacteria. It would appear that we are still experiencing
intermittent bacteria in the well. We are continuing to carefully
monitor our chlorine residual at the well and as the distribution
samples indicate, the bacteria is being contained and limited to
the well head.

WHEREAS, the Board of Directors of the Truckee Donner Public Utility District approved
the specifications and called for proposals on the Tahoe Donner Pipeline Replacement
Project; and
WHEREAS, Contract B was awarded to the low bidder, Ford Construction Company and
the contractor entered into an agreement with the District to perform the project; and
WHEREAS, the project has been completed by the contractor and he has conformed with
all provisions of the contract; and
WHEREAS, the District's Consulting Engineer, SEA, has recommended that the project
be accepted by the District;
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Truckee Donner
Public Utility District as follows:
1. That the Truckee Donner Public Utility District hereby accepts Contract B,
Tahoe Donner Pipeline Replacement Project.
2. That the Clerk of the District be directed to file with the County of Nevada
the Notice of Completion, a copy of which is attached hereto.
3. That 35 days following the Notice of Completion, the 5% retained from
contractor payments be released to the contractor if no claims have been
made to the District by material suppliers or laborers.

WHEREAS, the State of California has enacted the Safe Drinking Water Bond Law of
1986, California Water Code Section 14000 et seq., to make low interest loans available
for capital improvements to the public water supply and to reduce water quality hazards;
and
WHEREAS, the District desires to make improvements to its water supply and reduce
water quality hazards by replacing a portion of its downtown pipelines, constructing
disinfection facilities at the Northside and Airport wells, constructing new Gateway,
Southside and Prosser wells, rehabilitating and disinfecting the Donner Creek well, and
constructing new storage tanks at Soma Sierra, Donner Trails and Gateway, all at an
approximate cost of five million twelve thousand dollars ($5,012,000); and
WHEREAS, the District applied to the State of California, Department of Water Resources
for a loan in the sum of five million dollars ($5,000,000) pursuant to the Safe Drinking
Water Bond Law of 1986; and
WHEREAS, by letter dated May 5, 1992, the State of California approved and committed
a five million dollar ($5,000,000) construction loan to the District and presented the
District with Safe Drinking Water Loan Contract No. E53311, which provides for a twenty-
five (25) year loan repayment schedule at a 3.1775 percent interest rate; and
WHEREAS, said loan contract requires an opinion from the District's legal counsel that
no election is required prior to the execution of said loan contract and the District's legal
counsel has provided said opinion by letter dated July 15, 1992; and
WHEREAS, said loan contract requires the District to pass a resolution accepting the loan
and designating an agent to execute Loan Contract No. E53311 and to sign requests for
disbursement of State funds;
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Truckee Donner
Public Utility District as follows:
1. All of the above recitals are adopted as findings by the District.
2, Safe Drinking Water Loan Contract No. E53311 is hereby accepted.
3. The President of the District's Board of Directors is hereby authorized and directed
to execute Safe Drinking Water Loan Contract No. E53311 on behalf of the
District.
4. The General Manager of the District is hereby authorized and designated to sign
requests for disbursement of State funds pursuant to Safe Drinking Water Loan
Contract No. E53311 on behalf of the District.

WHEREAS, in 1988 the District purchased meter reading software and hardware from
OrCom Systems that interfaces with its utility billing system; and
WHEREAS, in the last several months staff has experienced continuous problems with
the reliability of the meter reading hardware causing inefficiency and low employee
morale; and
WHEREAS, the District contracts with OrCom systems to install, train and maintain its
utility billing, meter reading and financial management system software package; and
WHEREAS, OrCom systems has become the exclusive distributor for ITRON meter
reading devices (hardware) for utilities and is the only vendor who has designed a
software program that interfaces with the District's utility billing system; and
WHEREAS, the State of California has required that all water utilities install meters at all
new residential service locations; and staff has determined that purchasing and installing
meters with special sensors which would allow for automated meter reading is in the best
interest of the District; and staff has also determined from its research that ITRON
currently has the technology to do automated meter reading for electric meters and is
developing the technology to automatically read water meters; and
WHEREAS, Public Contract Code Section 20206.4 generally requires that the District
seek competitive bids in connection with the purchase of goods; and
WHEREAS, various California court decisions, including r n v. Paodena
Devefo'pment Agee=, 104 C.A. 3d 631 (1980), hold that if the subject of a contract is
such that competitive proposals would be unavailing or would not produce an advantage,
and the advertisement for competitive bids would be unavailing or would not produce an
advantage, and the advertisement for competitive bids would thus be undesirable or
impractical, a public agency may dispense with competitive bidding; and
WHEREAS, it would be extremely time consuming and difficult for District staff to draft
specifications for the necessary meter reading software and hardware package, without
such specifications pointing directly to the system offered by OrCom Systems; and
WHEREAS, due to the facts set forth above, competitive bidding would be unavailing and
would not produce an advantage to the District, and the advertising for competitive bids
and the delay that would therefore result, would be undesirable; and
WHEREAS, the Public Contract Code Section 16034 and Government Code Section
53060 provide that the District may, without competitive bidding, contract for special
services and advice in financial, economic, accounting, engineering, legal, administrative,
and professional matters if such persons are specially trained and experienced and
competent to perform the special services required; and
WHEREAS, the District has determined that a meter reading system more nearly
resembles a special service contract, within the meaning of the above-cited code
sections, rather than a "good," as that term is used in Public Contract Code Section
20206.4, because a software package includes, as an integral part, specialized services
in adapting the system to the District's needs, installing the system, training District
personnel, and providing on-going services after installation;
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Truckee Donner
Public Utility District, for the reasons set forth above, that the District finds that
competitive proposals for an updated meter reading system would be unavailing and
would not produce an advantage to the District and the advertisement for competitive bids
and the resulting delay would be undesirable and costly.
BE IT FURTHER RESOLVED that the District finds that a meter reading system more
nearly resembles a special service, for which no competitive bidding is required, as
opposed to a "good."
BE IT FURTHER RESOLVED that the District shall therefore dispense with competitive
bidding for the acquisition of the replacement meter reading devices and software
interface, and District staff is authorized to purchase such system in the amount of
$21,043.91 plus out-of-pocket expenses to install and train District staff on the operation
of such system.
