Holzmeister, General Manager Subject: Staff report The staff report is very brief because I took some vacation time and was less busy during the past week. I spent most of my time working on water system financing, the newsletter and the General Plan Steering Committee meeting. APPA CONFERENCE IN NASHVILLE Attached is the announcement of the APPA National Conference in Nashville on June 14 , 15 and 16 . NO BID DUE TO BONDING REQUIREMENTS Once again a prospective bidder is refusing to give us a proposal on a new vehicle because of the bid bond and performance bond requirement. Hyde, District Civil Engineer SUBJECT: Status Report - Gateway Tank Project The purpose of this memo is to bring you up-to-date with the status of the Gateway Tank project. The need for the tank was identified in the Gateway master plan. Current storage capacity is 36% of that required by District standards to serve existing customers. SPreliminary engineering is underway. Sauers Engineering was authorized to proceed with the design work in November, 1990. A site for the tank has been identified on the hillside upslope of the western end of Frates Lane. Survey and geotechnical work have been performed at the site. A topographic map has been developed of the site. Hydraulic modeling has been done to predict how the new tank will behave in the distribution system. Preliminary environmental work has been completed to assess the impacts of the proposed project and to identify any potential problems that might need special attention. The results of the work so far indicate that the site is suitable for a tank. Based upon the positive results, it is time to begin the property acquisition process. Preliminary contacts last year with the owners (through the developer of the new Safeway project and the owner's representatives) indicated that the owners were willing to sell the site to the District. Engineering work has proceeded to the point where the exact location and dimensions of the site have been determined. our next step is to initiate the formal process to acquire the property. I will work closely with our Legal counsel to determine the proper steps to follow and - report back with an outline. The Board should be prepared for a request to enter into negotiations with the owners sometime soon, perhaps at the next Board meeting. ORDINANCE NO. 9101 i OF THE TRUCKEE DONNER PUBLIC UTILITY DISTRICT EFFECTING A COMPENSATION ADJUSTMENT FOR THE GENERAL MANAGER AND AUTHORIZING THE EXECUTION OF A CONTRACT WITH PETER L. HOLZMEISTER WHEREAS, the Board of Directors deems it advisable and appropriate for the General Manager to receive a compensation adjustment; and WHEREAS, the contract between the General Manager and District expired on December 31, 1990 and the Board has determined that it should be renewed; NOW, THEREFORE, BE IT ENACTED by the Board of Directors of the Truckee Donner Public Utility District that effective 30 days from the date of passage of this ordinance the following action occur: 1. That the General Manager receive a 10% wage increase retroactive to January 1, 1991. 2 . That the other terms of the contract remain unchanged. 3 . That the President be authorized and directed to execute on behalf of the District the management employment agreement with Peter L. Holzmeister, a copy of which has been attached hereto and entitled Exhibit "A" . 4 . That the Deputy District Clerk of the District be directed to publish this ordinance in accordance with the laws of the State of California. Craig, Dep y District Clerk smc ORDINANCE NO. 9102 i OF THE TRUCKEE DONNER PUBLIC UTILITY DISTRICT ESTABLISHING SPECIAL WATER RATE FOR SMALL UNITS MEETING CERTAIN CRITERIA WHEREAS, the Board of Directors of the Truckee Donner Public Utility District, hereinafter referred to as District, has adopted a budget for the year 1991; and WHEREAS, it has been determined that creating a special , lower rate for small units that meet certain criteria would not adversely affect the ability to carry out the public trust in providing for the needs of the community water system; and WHEREAS, a public hearing was held this date to receive comments from the public concerning the establishment of a special water rate for small units; NOW, THEREFORE, BE IT ORDAINED by the Board of Directors of the Truckee Donner Public Utility District that effective with the effective date of this ordinance, units under 300 square feet with ino provisions for washer/dryer, dishwasher or outside hose bib, no improved landscaping needing water other than that provided by nature, no leaking plumbing fixtures as determined by District staff, shall be set as follows: 1. Domestic Water Rates for single family homes, individual condominium units and townhouse units shall relate to the pressure zone in which said service is located. The Domestic Flat Rate Base for all zones shall be the fixed monthly rate of $14 . 64 . The appropriate zonal pumping costs shall be added to the base monthly rate yielding the appropriate flat zonal rates as follows: Zone 1 $16 . 24 Zone 2 17 . 64 Zone 3 18 . 30 Zone 4 19 . 05 Zone 5 19 .42 Zone 6 19.76 Zone 7 21. 38 Zone 8 22 . 34 Zone 9 22 .70 Zone 10 24 . 97 Zone 11 27 . 11 2 . The Clerk of the District shall immediately cause a copy of this ordinance to be published in a newspaper of general circulation and posted in three places within the District. Craig, Deputy Dist .n,ct Clerk smc f 1 RESOLUTION NO. 9102 S OF THE TRUCKEE DONNER PUBLIC UTILITY DISTRICT AUTHORIZING BUSINESS CREDIT CARD ACCOUNTS WITH MBNA AMERICA WHEREAS, the District desires to provide to its five Directors and to the General Manager business credit cards for use in connection with District business; and WHEREAS, MBNA AMERICA, N.A. has indicated to the District that it will provide business credit card accounts to the District on terms satisfactory to the District; NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Truckee Donner Public Utility District as follows: 1. That the President of the Board of Directors and/or the General Manager of the District is hereby authorized and directed by the District to apply for, sign for, and on behalf of the District in order to open the business credit card accounts referred to above, to name and request the issuance of credit cards to the individuals holding the positions described above, and to do all other acts and to perform all obligations incident and necessary to the maintenance and satisfaction of the business credit card accounts in accordance with the terms and conditions of said account. Such terms and conditions are acknowledged as received and presented to the Board of Directors on or before the date that this resolution was adopted. 2. That the President of the Board of Directors and/or the General Manager of the District is further authorized and directed to deliver and certify to MBNA, from time to time, as necessary, a listing of all designated individuals and other authorized users who are each so authorized to use a credit card account with MBNA, together with a sample of the signatures from such persons so designated. 3. That the President of the Board of Directors and/or the General Manager of the District is further authorized and directed to deliver and certify to the bank a certified copy of this resolution and that the same is in conformity with the charter and bylaws of the District, together with a certificate or signature card setting for the names and certifying to the signatures of the authorized users or guarantors, and MBNA shall be free from all liability and fully protected in relying on such certifications of the incumbents and shall be indemnified and saved harmless from any claims, demands, expenses, attorneys` fees, loss, damage, or liability whatsoever resulting from, or growing out of, honoring the signatures of any person so certified, or refusing to honor any signature not so certified until the actual receipt by the Bank of a written notice purporting to be under the seal of the District and purportedly signed by the General Manager of the District notifying the Bank of any changes of such offices and incumbents or other authorized signers. 4. The foregoing powers and authority will continue until written notice of revocation has been received by the Bank. That, notwithstanding any other provision of law, elections of its governing board members be held on the same day as the statewide election in November of even- numbered years. 2 . That a certified copy of this resolution be submitted to the Placer and Nevada County Board of Supervisors no later than 240 days prior to the date of the currently scheduled district election for approval.
