Holzmeister, General Manager From: Debi Black, Engineering Technician Subject: Monthly Bacteriological Report _ February 1991 Attached is the "Summary of Bacteriological Water Quality" report for the month of February, 1991. As you can see, the report shows that all of the 28 samples taken within the District' s distribution system were free of coliform bacteria, and met the State' s drinking water standards. you will notice, that this month the report indicates no presence of coliform bacteria at the Northside Well. Amendment of Ordinance No . 7501 and geso ut-i nn No 8240 1 . 1 This Ordinance hereby supersedes Ordinance No . 7501 and Resolution No. 8240 to the extent that such Ordinance and Resolution concern the fixing of water standby charges in the County of Nevada . To this end, Sections 1 . 2 , 3 . 2 and 6 . 2 of Ordinance No . 7501 and any other references to water standby charges in the County of Nevada in Ordinance No . 7501 and Resolution No . 8240 are hereby repealed. Ordinance No . 7501 and Resolution No . 8240 as they relate to water standby charges in the County of Placer and electric standby charges shall remain in full force and effect . l 2677004/32 SECTION 2 . �nPral Authority 2 . 1 The water standby charge fixed by this ordinance is hereby enacted and imposed by virtue of the authority set forth in Section 54984 et seg. of the Government Code of the State of California . 2 . 2 The means for collection of such water standby charges are enacted by virtue of the provisions of Sections 54984 at 3-P,9, of the Government Code, and Sections 16641, et sea . of the Public Utilities Code, of the State of California . SECTION 3 . 6yolication 3 . 1 The water standby charges shall apply to all vacant lands or parcels within that portion of the District ' s boundaries encompassing the County of Nevada , whether currently in existence or hereafter created through lot splits , subdivi- sions or other methods , to which water is made available for any purpose by the District , whether dater is actually used or not . 3 . 2 The water standby charges shall not apply to any vacant land permanently dedicated exclusively to transportation of persons or property. SECTION 4 . Rate of Water Standby Charges 4 . 1 The rate for such water standby charges shall be an annual charge not to exceed Eighty Dollars ($80 . 00) for any parcel . SECTION 5 . 1MVleMes 5 . 1. Once per year, on or before June lst of each year , or at such other time as may be required by law, the Board by resolution shall determine and fix the annual charges applicable for the ensuing year and shall specify therein the lands, lots and parcels to which the charges shall apply along with the charge applicable to each such land, lot or parcel . 5 . 2 The annual charges so fixed may vary from time to time and in different localities within the District , depending upon factors determined by the Board, and as provided by law. 5 . 3 Immediately after determining and fixing such charges a certified copy of such resolution shall be given to the 'Auditor of the County of Nevada . 2 2677004/32 5 . 4 There shall be no exemptions to the charge or charges fixed and imposed by this ordinance except for those exemptions specifically stated herein or otherwise authorized by law. All exemptions shall be approved by the Board. water standby charges imposed on public entities or agencies shall be subject to the provisions of Sections 54999 et • , as applicable . 5 . 5 For the purposes of this ordinance, determination of lot or parcel location and ownership shall be based upon the latest available records of the Assessor ' s office of the County of Nevada, State of California . SECTION 6 . A v n ' R 1 6 . 1 Except as otherwise provided herein, the annual charge or charges hereby imposed are subject to payment in advance. 6 . 2 The annual charge or charges hereby imposed are fixed on a basis of twelve ( 12) calendar months, commencing on the 1st day of July of each year and ending on the last day of June of each succeeding year thereafter . 6 . 3 The owner of the lands within the boundaries of the District shall be responsible for the payment of the charge or charges hereby imposed. SECTION 7 . Availability Defines 7 . 1 For the purposes of this ordinance, water shall be deemed available and the charge or charges hereby imposed shall be applicable to all vacant lands, parcels or lots within the District ' s boundaries, whether currently in existence, or hereafter created through lot splits , subdivision, or other methods as follows: whenever there is a District water distribution line not less than two (2) inches in diameter installed within 100 feet of the nearest exterior boundary line of any such parcel . 7 .2 All determinations of availability made by the Board shall be deemed final . SECTION 8 . 8 . 1 Pursuant to the aforesaid provisions of the California Government Code and the California Public Utilities Code, the charge or charges fixed and imposed by this ordinance shall be added to and become a part of the annual assessment levied by the County of Nevada, State of California, on the lands , parcels or lots to which applicable . Said charge or 3 2677004/32 charges shall be added to the assessment and are hereby declared to be a lien on the land. Said charge or charges may be divided pursuant to county assessment practice and payable in two installments . By this ordinance, and pursuant to the authority granted by law, the District does hereby avail itself of and elects to use the assessment and collection procedures of the County of Nevada, State of California , as applicable, and said County, by and through its assessor, auditor , tax collector, and any or all other offices or persons connected therewith are authorized and directed to assess and collect the charge or charges all as enacted herein at the same time and in the same manner as county taxes . when collected, the charge or charges so collected shall, pursuant to law and the practice of such County, be paid over to the District . 8 . 2 Enforcement of the collection by the County of Nevada shall be by the same means as is provided by law for enforcement of liens for county taxes to and including sale of delinquent property, penalties , interest and redemptions, all as provided by law. SECTION 9 . Misgellaneous 9 . 1 If any provisions of this ordinance or the applica- tion thereof to any person, land, lot or parcel be held invalid or unconstitutional by a court of competent jurisdiction, such decision shall not affect the other provisions of this ordinance . 9 . 2 Except as otherwise provided herein, the Manager of the District is charged with the enforcement of the provisions of this ordinance. Nothing herein contained shall be construed to limit the authority of the Board to amend, supplement or change this ordinance at any time or from time to time. Further, the Board may adopt rules and regulations consistent with the terms of this ordinance and pursuant to law, to the end that the terms hereof be efficiently, fairly and uniformly applied, and to the further end that cooperation with the County of Nevada be achieved for the purposes as stated herein. 9 . 3 All other rules, regulations, resolutions, ordinances, and charges applicable to the District ' s system, works and facilities are hereby ratified and shah, continue in effect , unless the same be deemed inconsistent herewith. SECTION 10 . Effective Date 10 . 1 This ordinance shall become effective thirty (30) days after its enactment and shall be posted and published pursuant to law, provided, however , that the water standby 0 4 26 77004/32 charge or charges set forth herein and Section 1 of this Ordinance regarding the amendment and the repeal of portions of Ordinance No. 7501 and Resolution No . 8240 of the District concerning water standby charges in the County of Nevada shall not be deemed effective until the lst day of July, 1991, and water standby charges in the County of Nevada shall continue to be imposed under the authority of and in the manner directed by Ordinance No. 7501 and Resolution No . 8240 of the District until such date. 5 2677004/32 Passed and adopted this 18th day of March, 1991, by the following roll call vote, at a meeting of the Board of Directors of TRUCKEE-DONNER PUBLIC UTILITY DISTRICT, held within, the Distract . Craig, deputy Dist ct Clerk 6 2677004/32 a ORDINANCE NO. 9104 OF THE TRUCKEE DONNER PUBLIC UTILITY DISTRICT AN ORDINANCE OF THE BOARD OF DIRECTORS AUTHORIZING THE EXECUTION AND DELIVERY OF AN INSTALLMENT PURCHASE AGREEMENT, A TRUST AGREEMENT, AN ASSIGNMENT AGREEMENT, A CONTRACT OF PURCHASE AND AN OFFICIAL STATEMENT, AND CERTAIN OTHER ACTIONS IN CONNECTION THEREWITH WHEREAS, the Truckee Donner Public Utility District , a public utility district duly organized and existing under and pursuant to the Constitution and laws of the State of California (the "District" ) , including the Public Utility District Act , Section 15501 g—t seq. of the Public Utilities Code of the State of California (the "Public Utilities Code" ) is authorized under provisions of the Constitution and laws of the State of California, including without limitation, Section 16431 of the Public Utilities Code to purchase certain equipment and facilities as the District may determine is necessary or proper; . WHEREAS, the District proposes to finance ( i) the replacement of approximately 72 , 650 lineal feet of existing pipeline in the Tahoe Donner subdivision, (ii) the installation of approximately 2 , 500 lineal feet of pipeline between the Martis Valley Estates subdivision and the Olympic Heights subdivision, (iii) the construction of a booster pump station to pump water _ from the Herringbone Tank to the Donner View Tank and (iv) the purchase and installation of a telemetry system for the entire water system, including preliminary costs and costs incidental thereto, in part through causing the execution and delivery of not to exceed $11, 000, 000 principal amount of Certificates of Participation as described herein; WHEREAS, in the judgment of this Board it is for the best interest of the District to enter into the Installment Purchase Agreement described herein; WHEREAS, a majority of the Board of Directors of the District (the "Board" ) constituting a quorum for the transaction of business , is present, as required by Section 16071 of the Public Utilities Code; and WHEREAS, all acts , conditions and things required by the Constitution and law of the State of California to exist, to 1 2677004/15 have happened and to have been performed precedent to and in connection with the consummation of the financing authorized hereby do exist, have happened and have been performed in regular and due time, form, and manner as required by law, and the District is now duly authorized and empowered, pursuant to each and every requirement of law, to consummate such financing for the purpose, in the manner and upon the terms herein provided; NOW, THEREFORE the Board of Directors of the Truckee Donner Public Utility District does hereby resolve as follows . Section 1 . Installmen Purchase Aareemen The form of Installment Purchase Agreement, dated as of April 15, 1991 , between the District and the Truckee Donner Public Utility District Financing Corporation (the "Corporation" ) , presented to this meeting and on file with the Clerk of the Board of the District , is hereby approved. In accordance with Section 16033 of the Public Utilities Code, the President of the Board (the "President" ) is hereby authorized and directed, for and in the name and on behalf of the District, to sign, and in accordance with Section 16115 of the Public Utilities Code, the Clerk of the District (the "Clerk" ) is hereby authorized to countersign and both the President and the Clerk are hereby authorized and directed to deliver to the Corporation the Installment Purchase Agreement in substantially said form, with such changes therein as the President may require or approve, such approval to be conclusively evidenced by the execution and delivery thereof . Sec. i n 2 Trust Agreement . The form of Trust Agreement, dated as of April 15, 1991, among the District, the Corporation and First Interstate Bank Ltd. , San Francisco, California or such other trustee as the President approves (the "Trustee") , presented to this meeting and on file with the Clerk, is hereby approved. In accordance with Section 16033 of the Public Utilities Code, the President is hereby authorized and directed, for and in the name and on behalf of the District, to sign the Trust Agreement, and in accordance with Section 16115 of the Public Utilities Code, the Clerk is authorized and directed to countersign the Trust Agreement , and both the President and the Clerk are hereby authorized and directed to deliver to the Corporation and the Trustee the Trust Agreement in substantially said form, with such changes therein as the President may require or approve, such approval to be conclusively evidenced by the execution and delivery thereof . 2 2677004/15 , Section 3_ Ags_i nm nt Agreement. The form of Assignment Agreement , dated as of April 15 , lggi, between the Corporation and the District, presented to this meeting and on file with the Clerk, is hereby approved. In accordance with Section 16033 of the Public Utilities Code the President is hereby authorized and directed, for and in the name and on behalf of the District, to sign the Assignment Agreement, and in accordance with Section 16115 of the Public Utilities Code, the Clerk is hereby authorized and directed to countersign the Assignment Agreement, and both the President and the Clerk are hereby authorized and directed to deliver to the Corporation the Assignment Agreement in substantially said form, with such changes therein as the President may require or approve, such approval to be conclusively evidenced by the execution and delivery thereof . (the "Underwriter" ) , presented to this meeting and on file with Clerk, is hereby approved. In accordance with Section 16033 of the Public Utilities Code, the President is hereby authorized and directed, for and in the name and on behalf of the District, to sign the Contract of Purchase, and in accordance with Section 16115 of the Public Utilities Code, the Clerk is hereby authorized and directed to countersign the Contract of Purchase, and both the President and the Clerk are hereby authorized and directed to deliver to the Trustee and to the Underwriter the Contract of Purchase in substantially said form, with such changes therein as the President may require or approve, such approval to be conclusively evidenced by the execution and delivery thereof , provided, however, that the interest rate payable with respect to the Certificates (as hereinafter defined) does not exceed 9% and the original issue discount does not exceed 3 . 5% and the aggregate principal amount of the Certificates does not exceed $11, 000 , 0000 . Section Preliminary Qfficial Statement. The form of Preliminary official Statement relating to the certificates of participation (the "Certificates" ) in the installment payments to be made by the District pursuant to the Installment Purchase Agreement , presented to this meeting and on file with the Clerk is hereby approved. The General Manager of the District (the "General Manager" ) is hereby authorized and directed to execute, approve and deliver the final official Statement in the form of the Preliminary Official Statement , with such changes as the General Manager may require or approve, such approval to be 3 2677004/15 conclusively evidenced by the execution and delivery ! thereof (hereinafter referred to as the °'Official Statement") . The General Manager is hereby authorized and directed, for and in the name and on behalf of the District, to execute and deliver to the Underwriter the Official Statement . The Underwriter is hereby authorized to distribute copies of the Preliminary Official Statement to persons who may be interest in the purchase of the Certificates and is directed to deliver copies of the Official Statement to actual purchasers of the Certificates . The Clerk is hereby authorized and directed to attest the signature of the President , if necessary, and to affix and attest the seal of the District, as may be required or appropriate in connection with the execution and delivery of the Installment Purchase Agreement, Trust Agreement , Assignment Agreement, Contract of Purchase and Official Statement . Secion 7 . Other Actigns . The President and the General Manager are hereby authorized and directed to do any and all things and to execute and deliver any and all documents which they may deem necessary or advisable in order to consummate the sale, execution delivery of the Certificates by the Trustee and otherwise to carry out, give effect to and comply with the terms and intent of this ordinance, the Certificates , Installment Purchase Agreement, Assignment Agreement, Contract of Purchase and official Statement . This ordinance shall take effect on the 30th day following its passage in accordance with Section 16075 of the Public Utilities Code. Craig, Deputy Dis ict Clerk 5 2677004/15 RESOLUTION NO. 9110 OF THE TRUCKEE DONNER PUBLIC UTILITY DISTRICT APPROVING SCOPE, ENVIRONMENTAL DOCUMENTS AND NOTICE OF EXEMPTION FOR THE TAHOE DONNER PIPELINE REPLACEMENT PROJECT WHEREAS, District staff has recommended, and the Board of Directors of the Truckee Donner Public Utility District has agreed, that certain pipelines in Tahoe Donner be replaced; and. WHEREAS, staff and Consulting Engineer, SEA, have prepared a map and list detailing the extent of pipeline to be replaced; and WHEREAS, District Civil Engineer, Andy Hyde, has prepared a preliminary review, environmental assessment and Notice of Exemption as required by the California Environmental Quality Act; NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Truckee Donner Public Utility District as follows: 1. That the map and list prepared by staff and SEA detailing the extent of the pipeline replacement project, attached 40 hereto as Exhibit "A", be approved. 2 . That the environmental documents and Notice of Exemption for the project be approved for filing with the County of Nevada. Passed and adopted by the Board of Directors of the Truckee Donner Public Utility District at a meeting duly called and held within the District on the 18th day of March, 1991, by the following roll call vote: AYES: Corbett, Curran, Maass, Sutton and Aguera. Project Description Approximately 71, 000 Lineal feet of existing water pipeline in the Tahoe Donner subdivision will be replaced. These pipelines were installed when the subdivision was constructed between 1971 and 1975. They have reached the end of their useful life due to excessive leakage caused by corrosion of the steel. pipelines. The total length of pipelines in the Tahoe Donner subdivision is roughly 341, 300 lineal feet. The pipelines to be replaced represent about 20 percent of the total. The remaining 80 percent of the lines have not displayed the same severity of leakage and are not scheduled for replacement at this time. The pipeline replacement will involve the installation of new ductile iron water mains parallel to the existing steel mains. The new mains will be coated to prevent corrosion. Project site prior to this project The project site is a developed subdivision. The Tahoe Donner Subdivision is primarily residential. There are over 6000 residential lots within the subdivision. Approximately 450 of the lots are currently developed. The remaining 55% of the properties are vacant, undeveloped lots. The ubdiv cable sion is served by public water and sewer, electricity, ies from meadow , ph TV and paved county roadways. The topography land to hills. The new pipelines will be located along the edge of the existing paved roadways. These areas have been disturbed during previous construction, and this project will not affect sites of historic or cultural significance. 3 . Surrounding Property Land along both sides of all roadways in which pipelines will be replaced .is residential, mostly single-family lots with some multi-unit residential properties along a small number of streets. Vegetation is typical of the east side Sierra Nevada mountain range. Grasses are found in only a few places. Bushes are sage brush and manzanita. Conifers such as White Fir, Jeffery and Lodge Pole Pine are common. Small animals such as mice, rabbits and squirrels abound. Larger game such as coyote and deer occasionally frequent the area. Since the project is a like-sized replacement of existing water lines in developed roadways, no alteration of existing features will occur. F :f- sl '{ r 1 - l-J`TT2 it � 4 '. _�., �♦ \ 1 f 5 4 �' � f • ] r t F J RESOLUTION NO. 91-11 OF THE TRUCKEE DONNER PUBLIC UTILITY DISTRICT INITIATION OF PROCEEDINGS TO FIX WATER STANDBY CHARGES IN PLACER COUNTY WHEREAS, the Board of Directors of the Truckee Donner Public Utility District (the "Board" ) desires to initiate the proceedings required to fix standby charges under the Uniform Standby Charge Procedures Act (Sections 54984 et sea . of the California Government Code) (the "Standby Charge Act" ) ; WHEREAS, the report of Sauers Engineering, Inc . , a qualified engineer (the "Report" ) is on file with the Truckee Donner Public Utility District (the "District" ) and contains all of the following in accordance with Section 54984 . 2 of the Standby Charge Act : (1) a description of the standby charges and the method by which they will be imposed; (2) a compilation of the amount of the standby charges proposed for each parcel subject to the charges ; (3) a statement of the methodology and rationale followed in determining the degree of benefit conferred by the service for which the standby charges are made; and (4) certain other factors listed in Section 54984 . 2 of the Standby Charge Act; WHEREAS, attached hereto as Exhibit A is a description of the lands upon which the standby charges are to be imposed; NOW, THEREFORE, the Board of Directors of the Truckee Donner Public Utility District hereby resolves as follows : 1 . That the Board shall conduct a hearing at 7 : 00 P.M. on April 8, 1991 to hear and consider all objections or protests , if any, to the passage of a resolution imposing 2677004/31 standby charges at an annual rate of $80 . 00 per parcel , regardless of parcel size, applied to each parcel located in that portion of the District encompassing the County of Placer for which water service is available but not used, as described in the Report and in Exhibit A attached hereto. 2 . That the General Manager of the Distract shall cause to be published a notice of the time and place of such hearing on the proposed standby charges , pursuant to Section 6066 of the California Government Cade, prior to the date set for the hearing , in the Sierra Sun, a newspaper of general circulation printed and published within the jurisdiction of the District . 3 .
