SUBJECT: Tahoe Donner Leak Analysis _ Status
Report

Staff Report for Board Meeting,
SEA is proceeding with Phase II of the Tahoe Donner Leak Analysis.
As you might recall, Phase II is the field study portion of the
analysis. The work includes a sonic leak survey by a
subcontractor. The leak survey is currently underway and should
take one or two more weeks to complete. The subcontractor is
surveying all the mains and a portion of the service lines and fire
hydrant laterals. After the survey is done, SEA will determine the
location of about a dozen excavations to expose the pipelines in
both "bad" (leaky) and "good" (not leaky) areas. The locations
will depend on the results of s he leakworking survey h EA also on input
from the corrosion engineer that
Another part of Phase II involves training of the water crew to
detect and prevent corrosion during their repair work. This
training, to be done by the corrosion engineer, will be scheduled
soon.
As this phase progresses, SEA will be attending a future Board
meeting to present tentative results.

$1/ACRE FOOT FEE DEFEATED: As part of the many fee proposals to
balance the state budget, Assemblyman Isenberg had proposed a $1 per acre
foot fee on all water extractions or diversions (including hydro electric
diversions) of water in California. That proposal was finally beaten but water
and electric utilities have had some fees placed on them as part of the
adopted budget. The De artment of Health S �
$3.6 million in fees, starting at $.50 Der service connection
purveyors serving over 200 service connections. This language does not
con any o e res ctions or contro t we had negotiated as part of
AB 2155 (Costa). In addition $5 million was authorized by an increase of
the energy surcharge on electric consumers.
Legislation Was also passed (SB 2557 - Maddy) authorizing counties to
pass a utility users tax on utility services in unincoEporated areas.
SB 65 CHAPTERED: SB 65, which would place a measure on the ballot to
include public agencies under the disclosure provisions of Proposition 65,
was allowed to become law without the Governor's signature. The bill, which
was opposed by CMUA, still would allow listed chemicals to be used in water
to protect public health but would require disclosure of those chemicals
under Prop 65. In spite of the many letters of Opposition sent to the
Governor by CMUA members and other public agencies the Governor allowed
the bill to become law. It was strongly supported by the California
Manufacturers Association. The provisions will only become law, however, if
approved by the voters on the November ballot.
E WETLANDS
Negotiations continue with Assemblymen Sher and Isenberg over two of the
most significant wetlands bills. The Sher bill AB 4231 would create a policy
under CEQA calling for a no net loss of wetlands habitat or acreage. The
R only remaining difficulty with the bill is the lack of definition. We have
suggested to the author and the Legislature that the bill should be amended
to include the Corps of Engineer definition expanded to include mudflats and
also including a provision that declares that water conveyance facilities
and/or areas created by the seepage of water from conveyance facilities not
be considered as wetlands. The lack of definition is a particular problem
P because of the addition of the no net lass language. Although, public
agencies are often the lead agency under CEQA (not the case for powerplant
o siting under the jurisdiction of the Energy Commission) the lack of def` -Ation
would seem to invite law suits claiming that the public agency used the
Rwrong criteria.
The Isenberg bill, AB 4327, requires ratios of two to one habitat value for
mitigation of wetlands on site and three to one for mitigation of wetlands off
site. This provision is a substantial improvement over the previous provision
