MEMORANDUM
January 18, 1989
To: Board of Directors

Subjects South River Street East water line
I am calling a special Board meeting so the Board may discuss all
the ramifications surrounding the South River Street East water
line prior to the scheduled public hearing. Three items are
enclosed with this memo:
1. A brief historical time line.
2 . A copy of a policy statement passed by Resolution No.
8472 . 1 specifically draw your attention to the first
paragraph under the heading of "Policy, " which says that
existing users shall pay their proportional share of the
cost to upgrade private facilities, and to the next to the
last paragraph of the document which refers to the formula
we now call "Rule 21. 11
3 . A copy of Resolution No. 8630.
it 's my contention that there was never a need for a public hearing
on this matter as Rule 21 has applied since the project was first
authorized.
At the special meeting we will discuss both this matter and our
committee system.

HISTORICAL TIME LINE
EAST SOUTH RIVER STREET WATER LINE
1. The original owner/developer of the mobile home park had a one
inch water line constructed across Route 267 to a point along East
South River ,Street, at which point the water was metered and
connected to a private line which served water to the trailer
spaces.
2 . At an unknown time, the houses occupied by McGinity and Porter
were connected to the private water line; however, they were billed
for water by the District.
3 . When the District realized that the occupants of the McGinity
and Porter houses were connected to a private line, billing was
stopped.
4 . The private water line was not built to Distract standards,
was not within a District right of way, and its precise location
was unknown.
5. To be served by the District would require construction of a
six-inch water line at a cost of approximately $35, 000. In
accordance with District rules and regulations, this cost would be
borne by the property owners.
6. Meetings were held with the property owners to determine
whether there was enough support for formation of an assessment
district; there was not.
7. The District went out to bid, built the water line, and
accepted the improvement into the District on August 18, 1986
(Resolution No. 8630) .

POLICY STATEtA ENT
PUR PQSE
The purpose of this policy is to wide the District in its decisions relating
to the upgrading of privately owned electric or water facilities which ( 1) are
located within the District , (2) are currently being used to provide service
from the District to customers , and (3) are noc in compliance with existing
District specifications and standards .
INTENT
It is the intent of this policy to establish n mnnn.er in which privately owned
facilities which are not in compliance with District specifications and stan-
dards may be upgraded and then accepted by the District for ownership, opera-
tion and maintenance. It is the intent of this policy that such upgrading be
• handled in a manner that is equitable to the District and to property owners,
and CO shift a portion of the initial cost of upgrading the facilities from
property owners to the District .
POLICY
Under this policy, existing users shall pay only their proportional share of mg
the cost of the upgrade of the private facilities . The District small pay the
expense of the upgrade with respect co undeveloped lots. Therca ter, when the
owners of the undeveloped lots apply to the District for service, the District
shall charge such owners their proportional share of the upgrade.
The District will continue to provide servico through private facilities that
do not meet District specifications only if the current users execute a re-
cordable agreemenc committing to upgrade the facilities, and share their
proportional cost of the upgrade , according CO the policy contained herein . 9
PROCEDURE
When District staff discovers that current District customers receive service
through private water or electric facilities that do not meet District stnn-
dards, the matter shall immediately be brought to the attention of the Ceneral
Manager .
The Ceneratl Manager shall causo to be prepared a comploce analysis of Ehe pri-
vase facility , including the location and descripcion of the facility , the owner
of the facility , the customers being served by the facility, the condition of
the facility in relation to current District specifications and standards, the
current escimaced value of the facility, and the approximate cost of upgrading

Water Line Extension Formula
The proportionate share of a line extension cost to a particular parcel
is based upon the useable land area of the parcel , as well as the frontage
of the parcel to the main.
The total useable land area is determined , and each parcel is given a
percentage of the total . Two thirds of the total water main extension
cost is calculated , and the useable land area percentage is applied to
this total , in order to calculate the fireflow portion of the water main
