PROCLAMATION
OF THE
TRUCKEE DONNER PUBLIC UTILITY DISTRICT
WHEREAS, water is California's most precious natural resource, and;
WHEREAS, the health and welfare of the people and the state's
economic growth depend on a reliable and safe supply of water, and;
WHEREAS, water also provides Californians with recreation and
beauty as well as enhances fish and wildlife habitats, and;
WHEREAS, because water plays such a vital role in our everyday
lives, it is important that individuals understand how water is
developed, treated, and delivered, and;
WHEREAS, local water agencies throughout the state serve the public
by delivering water from the watershed to our homes and businesses
at an affordable price, and;
WHEREAS, during the week of May 1, the Truckee Donner Public
Utility District, in cooperation with the California Water
Awareness Committee composed of various urban and agricultural
} water communities, will work to increase understanding of how
quality water is delivered to the people of California;
NOW, THEREFORE, the Board of Directors of the Truckee Donner Public
Utility District hereby proclaims May 1 - 5, 1989 as Water
Awareness Week and urges all citizens to join in supporting the
District in its efforts to help the Truckee community become water
aware.

ORDINANCE NO.
8902
OF THE
TRUCKEE DONNER PUBLIC UTILITY DISTRICT
PROVIDING FOR INFORMAL BIDDING PROCEDURES
UNDER THE UNIFORM PUBLIC CONSTRUCTION
COST ACCOUNTING ACT
WHEREAS, Resolution No. 8802 adopted by the Board of Directors of
the Truckee Donner Public Utility District on February 1, 1988 sets
forth the District's decision to become subject to the California
Uniform Construction Cost Accounting Act; and
WHEREAS, the District determined, by such resolution, to implement
the accounting and bidding procedures provided for under the Act
effective June 1, 1988 ; and
WHEREAS, the State Controller has been properly notified of the
District's election to become subject to the Act, and has provided
the State Controller with a copy of Resolution No. 8802 ; and
WHEREAS, the General Manager of the District was directed to
prepare and submit to the Board for approval an ordinance, as
required by the Act, containing those provisions required by Public
Contract Code Section 220334 ;
NOW, THEREFORE, BE IT ENACTED by the Board of Directors of the
Truckee Donner Public Utility District that effective 30 days from
the date of passage of this ordinance, the following accounting and
bidding procedures provided for under the California Uniform
Construction Cost Accounting Act shall be effective:
Section 1. Informal Bid Procedures
Public projects, as defined by the Uniform Public
Construction Cost Accounting Act, of $50, 000 or less may
be let to contract by informal procedures as set forth in
Sections 2 , 3 , 4 and 5 of this ordinance. Projects shall
not be split in order to avoid the formal bid requirements.
Section 2 . Contractor's List
The General Manager of the District shall cause a list of
contractors to be developed and maintained and submitted
to the Board for review and approval in accordance with the
provisions of Section 22034 of the Public Contract Code and
criteria promulgated from time to time by the California
Uniform Construction Cost Accounting Commission.

Section 3 . Notice Inviting Informal Bids
Where a project is to be performed which is subject to the
provisions of this ordinance, a notice inviting informal
bids shall be mailed to all contractors for the work to be
bid, as shown on the list developed in accordance with
Section 2 , and to all construction trade journals as
specified by the California Uniform Construction Cost
Accounting Commission in accordance with Section 22036 of
the Public Contract Code and to the Sierra Sun. Additional
contractors and/or construction trade journals may be
noticed at the discretion of the General Manager, provided
however:
(a) If there is no list of qualified contractors
maintained by the District for the particular category
of work to be performed, the notice inviting bids shall
be sent only to the construction trade journals
specified by the Commission, and to the Sierra Sun.
(b) If the product or service is proprietary in nature
such that it can be obtained only from a certain
contractor or contractors, the notice inviting informal
bids may be sent exclusively to such contractor or
contractors.
Section 4 . Content of Notices for Informal Bidding
All mailing of notices to contractors and construction
trade journals pursuant to this ordinance shall be
completed not less than 15 calendar days before bids are
due. The notice inviting informal bids shall describe the
project in general terms, how to obtain more detailed
information about the project, and state the time and place
for the submission of bids.
Section 5. Award of Contracts
The General Manger is hereby authorized to award informal
bidding contracts not to exceed $15, 000 in amount. The
District Board of Directors shall award informal bidding
contracts over $15, 000, not to exceed $50, 000. The General
Manager shall report the award of any informal bid
contracts to the Directors at the next regular Board
meeting.
Section 6. Force Account Projects
Projects of $15, 000 or less may be performed by the
employees of the District by force account, by negotiated
contract, or by purchase order.
Section 7 . Projects Subject to Formal Bidding
Projects of more than $50, 000 shall, except as otherwise
provided by law, be let to contract by formal bidding
procedure.
Section S . Formal Bid Procedures
Notice inviting formal bads shall state the time and place
for the receiving and opening of sealed bids and distinctly
describe the project. The notice shall be published at
least 14 calendar days before the date of opening the bids
in a newspaper of general circulation, printed and
published in the District. The notice inviting formal bids
shall also be mailed to all construction trade journals
specified in Section 22036. The notice shall be mailed at
least 30 calendar days before the date of opening the bids.
In addition to notice required by this section, the General
Manager may give such other notice as he deems proper.
Section 9. Rejection of Formal Bids
In its discretion, the District may reject any bids
presented. If after the first invitation for bids all bids
are rejected, the District shall state the reasons for the
rejection, and after reevaluating its cost estimates of the
project, the District shall have the option of either of
the following:
(a) Abandoning the project or readvertising for bids
in the manner described by this ordinance.
(b) By a four-fifths vote of the Board of Directors,
pass a resolution declaring that the project can be
performed more economically by the employees of the
District.
Section 10. Award of Formal Bids
(a) If a contract is awarded, it shall be awarded to
the lowest responsible bidder. If two or more bids are
the same and the lowest, the District may accept the
one it chooses.
(b) If no bids are received, the project may be
performed by employees of the District by force
account, or by informal bidding procedures set forth
in this ordinance.
Section 11. Adoption of Plans Specifications and working
Details
The Board of Directors of the District shall adopt plans,
specifications and working details for all projects of more
than $15, 000. For projects under $15000, the General
. Manager shall cause plans and specifications in sufficient
detail to be drawn up to allow proper bidding to occur.

within the District on the 17th day of April 1989 , by the following

RESOLUTION NO. 8910
OF THE
TRUCKEE DONNER PUBLIC UTILITY DISTRICT
DIRECTING THAT COMPETITIVE BIDDING
BE DISPENSED WITH IN CONNECTION WITH
THE DISTRICT'S PURCHASE OF
COMPUTER HARDWARE
WHEREAS, the District has determined the need to acquire an IBM
9332 External Disk Drive with 200MB of memory (disk drive) ; and
WHEREAS, the disk drive was included in the 1989 Budget; and
WHEREAS, Public Contract Code Section 20206.4 generally requires
that the District seek competitive bids in connection with the
purchase of goods; and
WHEREAS, various California court decisions, including Graydon v..
Pasadena Development Agency, 104 C.A. 3d 631 (1980) , hold that if
the subject of a contract is such that competitive proposals would
be unavailing or would not produce an advantage, and the
advertisement for competitive bid would thus be undesirable or
impractical, a public agency may dispense with competitive bidding;
and
WHEREAS, IBM offers to California local agencies a special
discounted price on computer hardware, which District staff has
concluded is a far more favorable price than is available through
any other IBM vendor; and
WHEREAS, the following price quotes for a disk drive of the type
described above have been received by the District: IBM $5,950,
Orcom Systems $8, 500, Celtic Computers, Inc. $6, 900 (used but
eligible for IBM maintenance) , Neptune $7, 132 , thereby confirming
District staff conclusion; and
WHEREAS, due to the facts set forth above, competitive bidding
would be unavailing and would not produce an advantage to the
Distract, and the advertisement for competitive bids and the delay
that would therefore result, would be undesirable;
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors that for
the reasons set forth above, the District finds that competitive
proposals for an IBM Disk Drive would be unavailing and would not
produce an advantage to the District, and the advertisement for
competitive bids, and the resulting delay, would be undesirable.

BE IT FURTHER RESOLVED that the District shall therefore dispense
with competitive bidding for the acquisition of an IBM Disk Drive,
and District staff is authorized to purchase an IBM 9332 Disk Drive
for the sum of $5,950 plus tax from IBM.

RESOLUTION NO. 8911
OF THE
TRUCKEE DONNER PUBLIC UTILITY DISTRICT
AUTHORIZING APPLICATION TO THE DEPARTMENT OF WATER
RESOURCES FOR FUNDING TO ASSURE THAT THE HIRSCHDALE
WATER SYSTEM MEETS MINIMUM SAFE DRINKING WATER STANDARDS
WHEREAS, the Truckee Donner Public Utility District has the
authority to construct, operate and maintain the Hirschdale Water
System on behalf of the Community of Hirschdale; and
WHEREAS, the Truckee Donner Public Utility District desires to
assure that the Hirschdale Water System meets minimum safe drinking
standards;
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the
Truckee Donner Public Utility District that pursuant and subject
to all of the terms and provisions of the California Safe Drinking
Water Bond Law of 1988 and all amendments thereto, application be
made to the California Department of Water Resources for funding
to assure that the Hirschdale Water System meets minimum safe
drinking water standards; and
BE IT FURTHER RESOLVED that the General Manager of said District
is hereby authorized and directed to cause the necessary data to
be prepared, investigations to be performed, and application to be
signed and filed with the Department of Water Resources.
PASSED AND ADOPTED by the Board of Directors of the Truckee Donner
Public Utility District at a meeting duly called and held within
the District on the 17th day of April 1989, by the following roll
call vote:
