RESOLUTION NO. 8920 OF THE TRUCKEE DONNER PUBLIC UTILITY DISTRICT SETTING FORTH THE COST ALLOCATION AND PAYMENT SCHEDULE FOR THE AFFECTED PROPERTY OWNERS IN THE HIRSCHDALE IMPROVEMENT DISTRICT WHEREAS, the Board of Directors of the Truckee Donner Public Utility District advertised and conducted a public hearing regarding the allocation of casts for the Hirschdale water system improvement project on July 17, 1989 , and property owners were notified and provided with pertinent information; and WHEREAS, many of the property owners provided comment at the public hearing for consideration by the Board; and WHEREAS, with respect to Assessor's Parcel Numbers 48-110-13 and 48-110-1 ., the Lambs and Rivaras stated they would sign agreements that they would execute legal covenants to be recorded with Nevada County indicating they will not further subdivide and stating there will be only one residence and one water service for Assessor' s Parcel Number 48-110-13 , and two residences and two water services for Assessor's Parcel Number 48-110--11; WHEREAS, the Board of Directors, after considering the public input, determined to approve the Hirschdale water system cost allocation in the amount of $92 , 519. 97 on a dwelling unit/zoning basis at a cost of $2 , 151. 63 for each dwelling unit equivalent; *V11HEREAS, the District intends to initiate assessment proceedings and have these allocations placed as assessments against the property; NOW, THEREFORE, be it resolved by the Board of Directors of the Truckee Donner Public Utility District as follows: 1. That the final cost allocation and payment schedule attached hereto are hereby approved. 2 . That the cost allocation and payment schedules set forth herein shall be automatically rescinded at the completion of the formal assessment proceedings and shall be replaced by whatever allocation and payment schedules are adopted as part of the assessment proceedings. RESOLUTION NO. 8921 ® OF THE TRUCKEE DONNER PUBLIC UTILITY DISTRICT AUTHORIZING THE ACCEPTANCE AND RECORDATION OF HIRSCHDALE LIENS WHEREAS, the Truckee Donner Public Utility District has installed a new water system for the community of Hirschdale; and WHEREAS, property owners within the community of Hirschdale who will be served by the water system have each been assessed a portion of the cost of the installation of the water system; and WHEREAS, those property owners who elect to pay their assessment over time rather than at the time of their application have agreed that a lien may be recorded against their property in the community of Hirschdale in order to assure that the assessment will be paid at a future date; and WHEREAS, the Nevada County Recorder' s Office requires that the Board authorize the acceptance and recordation of documents by resolution; NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the 'Truckee Donner Public Utility District that it hereby authorizes the acceptance of any properly executed liens entitled, "Lien - Hirschdale" and authorizes the recording of such liens with the Nevada County Recorder. It is the District's intent that this resolution shall authorize the acceptance and recording of all such liens, and that a separate resolution for each individual lien shall not be necessary. District staff is hereby authorized and directed to forward any such properly executed liens to the Nevada County Recorder' s Office for recordation, together with a copy of this resolution. FURTHER, upon completion of the formal assessment proceedings, this resolution shall automatically rescinded. Craig, Deputy DisAkict Clerk smc 0 FIFTH AMENDMENT TO THE TRUCEE-DONNER PUBLIC UTILITY DISTRICT DEFINED BENEFIT PENSION PLAN TRUCKEE-DONNER PUBLIC UTILITY DISTRICT hereby amends the Defined Benefit Pension Plan which was adopted by said Employer on August 15 , 1983 . The effective date of this Amendment is January 1 , 1983, in accordance with the Memorandum of Understanding between the District and the International Brotherhood of Electrical Workers Local No . 1245 dated January 12 , 1989 . Section I , subsection 1 of the Joinder Agreement (Retirement Benefit Formula) shall be amended to read as follows : 1 . The Normal Monthly Retirement Benefit shall be equal to: . (x) a. 40% of Average Monthly Compensation, reduced proportionately for service less than 20 years at Normal Retirement Date; plus (x) C. . 5 of 1% of Average Monthly Compensation for each year of service in excess of 20 years at Normal Retirement Date . Section L of the Joinder Agreement (Death Benefits) shall be changed to read as follows: W d. The Actuarial Equivalent of the Accrued Benefit Section N of the Joinder Agreement (Actuarial Equivalent) shall be changed to read as follows : 1 . The Early Retirement benefit payable to a Participant commencing on the Participant ' s early retirement date, shall be a monthly amount of immediate annuity on the Normal Annuity Form equal to the Vested Accrued benefit to the date of Early Retirement or early severance from service, determined by the formula which produces the highest benefit : 1 . 1 . Reduced by 1J15th for each of the first 5 years by which Early Retirement preceeds the Normal Retirement Date, reduced by 1J30th for each of the next 5 years , and reduced actuarially thereafter, or i 1 . 2 . Reduced. actuarially. 2 . All ether calculations requiring an Actuarial Equivalency shall be based on average unisex rates as determined by a review of the best current rates available in the marketplace, excepting that a lump sum equivalent cannot result in a higher benefit than if determined by the following Actuarial assumptions , and that the interest rate used cannot be higher than that which would be used by the Pension Benefit Guaranty Corporation for determining the present value of an immediate distribution on plan termination, which rate shall be the rate in effect at the beginning of the calendar year in which the distribution is to be made : 2 . 1 .
