Phelps, General Counsel RE: SURVEY OF BIDDING REQUIREMENTS FOR PURCHASE OF SUPPLIES BATE. October 11, 1989 At the last Board meeting, our firm was asked to prepare a chart showing the bidding requirements imposed by state law on the various public agencies in the area. The attached survey contains the results of our research. Please note that this data concerns only bidding for the purchase of goods and supplies, and it does not include bidding requirements for construction of public improvements. In conducting this survey, we looked primarily at the act or set of laws that created the agency and contains most of its operating rules. The Legislature occasionally adopts rules concerning specific public agencies and places such rules in an unindexed and obscure part of the Government Code. Therefore, it is possible that even though we did not discover a bidding requirement for a particular public agency, there might still be a bidding requirement that would be very difficult to locate. For instance, there are no bidding requirements for supplies under the Fire Protection District Law of 1987, Health and Safety Code Section 13801, et sea,_ Although it is unlikely, there could be a bidding requirement for the Fire District located in some other obscure location of the California State Statutes. RESOLUTION NO. 8932 OF THE TRUCKEE DONNER PUBLIC UTILITY DISTRICT ACCEPTING AN EASEMENT FROM ENCINO SAVINGS AND LOAN ASSOCIATION WHEREAS, an easement has been provided by Encino Savings and Loan Association for utility purposes over Assessor' s Parcel Number 19- 474-27 ; and WHEREAS, District Counsel has reviewed the grant deed and determined that it is acceptable and ready for recording; NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Truckee Donner Public Utility District as follows: 1. To accept the easement over Assessor' s Parcel Number 19-47€7-27 for purposes described in the grant deed signed by Encino Savings and Loan Association, a California corporation, a copy of which is attached hereto and made a part hereof. 2 . That the Clerk of the Board be directed to record the easement with the County of Nevada. Notwithstanding any rights granted to Grantee above, Grantee agrees that (1) upon the completion of any work it is entitled to do, It shall be responsible at Its sole cost and expense to cause all driveway, parking areas, landscaping, and building areas to be repaired/replaced to a condition equivalent to that which existed prior to the commencement of said work, (2) It shall use its best and good faith efforts to accomplish all such work in a manner which will minimize any visual, access, or other disruption of Grantors' business which is conducted on the property of which the easement is a part, and (3) except in the case of an emergency repair give at least 2 weeks prior notice of any Intent to do such work on the site and work cooperatively with the representatives of Grantee to accomplish the requirements of (1) and (2) of this sentence.
