These are all matters that only the Board can determine. Title 3, District Code: BUDGETING Section 3.01. 001 Financial Goals 3.01.01.1 The following goals are established to promote and maintain the financial strength of the District: Revenue Goals • Set operating revenues to capture entire cost to provide service plus maintain reserves and satisfy debt coverage ratios • Review connection charges each year and set then to recover all costs • Review facilities fees every three years History: Two workshops were held on January 9 and 23, 2008 to discuss amending the water fee and the electric schedules. Overall costs have been reviewed and it has been determined that an adjustment to the fees are necessary. The water connection increased $40.00 for both the 5/8X3/4 inch and 3/4 inch meters. Both the electric connection and facilities fees increased 3%. A workshop was held on January 9, 2008 to discuss the Voluntary Renewable Energy Certificate Program and action was taken on January 23rd to set a rate of $0.02 per kWh usage for customers who would like to participate in the program. New information: There is no new information. Draft ordinances are attached. t Recommendation: I recommend the Board adopt the following: Agenda Item 9 a. - Ordinance amending water connection fees Agenda Item 9 b. - Ordinance amending the Electric Connection Charges Agenda Item 9 c. - Ordinance amending Electric Facilities Fees Agenda Item9 d. - Ordinance establishing a rate for the Voluntary Renewable Energy Certificate Program Michael eaea Holley, General Manager 2 TRUCKEE ua Public Utility District Ordinance No. 2008 - XX Amending Water Connection Fees WHEREAS the District's current Connection Fee schedule was established on January 18,2006;and WHEREAS, the District has been experiencing increased costs for labor, fuel, materials and other items since that time; and WHEREAS on February 6, 2008 a public hearing was held to receive public comments on the proposed Water Connection Fee increase; NOW,THEREFORE, BE IT ORDAINED that the Board of Directors of the Truckee Donner Public Utility District does hereby enact the following: 1. Connection fees are charged to reimburse the District for the actual administrative, material and labor costs of connecting to the water system (excluding the service lateral). 2. Fee review- Each year, the District's staff reviews the estimated cost of capital improvements, the continued need for those improvements and the reasonable relationship between such need and the impacts of the various types of development pending or anticipated and for which these fees are charged.The staff shall report its findings to the Board of Directors and recommend any adjustment to this fee or other action as may be needed. If no protest is made pursuant to Public Utilities Code Section 16078,then this ordinance shall be effective sixty(60) days after the date it was adopted by the Board of Directors. 5. The Clerk of the District shall immediately cause a copy of this ordinance to be published in a newspaper of general circulation and posted in three places within the District. Holley P.E., Clerk of the Board Page 2 Ordinance 2008-XX TRUCKE! • Public Utility District Ordinance No. 2008-X0( AMENDING THE ELECTRIC CONNECTION CHARGES WHEREAS the District's current Electric Connection charges were established on January 18,2006;and WHEREAS, the Electric Fee Schedule was established on September 6, 2006; and WHEREAS, the costs of materials and labor have increased since the last adjustment to the electric connection and fee schedule charges; and WHEREAS, on February 6,2008,a public hearing was held to receive public comments on the proposed rate increases; NOW, THEREFORE, BE IT ENACTED by the Board of Directors of the Truckee Donner Public Utility District as follows: Effective 60 days from the date this ordinance is adopted the following electric connection charge schedule shall be effective. The provisions of other Ordinances shall remain in effect to the extent that they do not conflict with this ordinance. Holley, Clerk of the Board Ordinance 2008-XX 2 TRUCKEE R O ■i R pop Public Utility District Ordinance No. 2008 - XX Amending Electric Facilities Fees WHEREAS, a study was conducted to determine the capital improvements required to provide for projected load growth over the 15-year planning period, increased system capacity, and expansion or maintenance of the operating flexibility of the electric system. The study is the District's 2002 Electric System Master Plan Update; and WHEREAS the purpose of the facilities fees is to finance public electric system facilities to mitigate the impacts of additional demands on the existing electric system caused by new development within the District's electric service area; and WHEREAS costs of material and labor have increased since the last adjustment to the electric facility Ordinance 2003-07, effective February 16, 2004; and WHEREAS a public hearing was held on February 6, 2008 to receive public comment on the proposal to increase the electric facilities fee schedule. NOW, THEREFORE, BE IT ORDAINED that the Board of Directors of the Truckee Donner Public Utility District does hereby enact the following: Section 1. The Board of Directors hereby adopts the above recitals as its findings. Section 2. Payment and Collection of Facilities Fees - The customer shall pay and the District will collect the facilities fees upon the submission of an application for new service or modification to an existing service. When the District requires a development agreement,the customer shall pay and the District shall collect the facilities fees upon execution of a development agreement between the District and the customer. Section 3. Amount of Facilities Fees - A. Residential Facilities Fees 1. New Residential Areas: The amount of the electric facilities fees shall be based according to panel size as follows: a. 200Amp or less - $1,298. b. 400Amp - $2,595. 2. Existing Residential Areas: Within existing residential areas, the developer or owner who builds an improvement on a vacant parcel will pay the difference in facility fees between the current facility fee and the fee that was paid for that particular parcel at the time the residential area was originally developed. In addition, if the developer or owner who builds 1 Ordinance 2008-XX an improvement on a vacant parcel desires to install a electric service larger than a 200 amp single phase panel,the developer or owner will pay the difference in facility fees between the larger panel and a 200 amp panel. 3. Modification to Existing Residential Service: A customer desiring to modify the size of an existing panel for a residential service will pay the difference in facility fees,at the current fee schedule, between the larger panel and the facility fee that was paid at the time the existing panel was installed. B. Commercial Facilities Fees 1. New Commercial Development: For new commercial development,facility fees will be due and payable upon execution of a development agreement with the District. Facility fees will be charged according to the voltage, panel size, and phasing requirements as requested and noted in the development application submitted to the District by the developer. Modification to Existing Commercial Service: A customer desiring to modify an existing commercial service due to any change of voltage, panel size,and/or phasing,the customer will pay the difference in facility fees, at the current fee schedule, between the proposed panel and the facility fee that was paid at the time the existing panel was installed. 3. For panel sizes not listed in the previous sections, the facility fee will be calculated by interpolating between or extrapolating from the listed values as appropriate. Section 4. Use of Facilities Fees - Facilities fee shall be solely used to pay for all costs associated with the public facilities described or identified in the 2002 Electric Master Plan Update constructed by the District. Section 5. Effective with the effective date of this Ordinance, all prior resolutions and ordinance pertaining to Electric Department facilities fees are rescinded and of no further force and effect. Section 6. This ordinance shall be effective sixty (60)days after the date it was adopted by the Board of Directors. Section 7. The Clerk of the District shall immediately cause a copy of this ordinance to be published in a newspaper of general circulation and posted in three places within the District. Holley, Clerk of the Board 3 Ordinance 2008-XX s 11 w�u w ' Public b I UtilityI. ict Ordinance No. 2008 - XX ESTABLISH A RATE FOR THE VOLUNTARY RENEWABLE ENERGY CERTIFICATE PROGRAM WHEREAS, in an effort to help District residential and commercial customers to reduce their individual environmental impact, the Board of Directors took action to participate in a voluntary Green Renewable Energy Certificate Program; and WHEREAS, Renewable Energy Credits (RECs) also called "Green Tags" represent the environmental benefits that occur when clean, new renewable energy is substituted for power that is produced by burning fossil fuel; and WHEREAS, the Board of Directors directed staff to pursue the voluntary Green Renewable Energy Certificate Program with Bonneville Environmental Foundation to provide an accounting of the number of Green Tags purchased and the certification; and WHEREAS,on February 6,2008,a public hearing was held to receive comments from the public concerning the voluntary rate; and WHEREAS,the Board of Directors has set the cost to participate in the program would be$0.02 per kilowatt hour(kWh) usage; and WHEREAS,the$0.02 per kWh usage rate includes all labor with overheads plus the costto purchase Green Tags. NOW,THEREFORE, BE IT ENACTED by the Board of Directors of the Truckee Donner Public Utility District as follows: 1.
