HomeMy WebLinkAboutMemo r RESOLUTION NO. 8537 OF THE TRUCKEE DONNER PUBLIC UTILITY DISTRICT ORDERING ANNEXATION OF LAND TO SAID DISTRICT — PONDEROSA HILLS, PLACER COUNTY — WHEREAS , heretofore the owners of the land and property hereinafter described petitioned the Truckee Donner Public Utility District and Placer County Local Agency Formation Commission for the annexation of said land and property to the Truckee Donner Public Utility District , and said petition was heretofore filed with the Executive Officer of the Placer County Local Agency Formation Commission ; and WHEREAS, said petition complied with the requirements of law , and notice of the filing of said petition was duly given in the manner required by law; and WHEREAS , the Executive Officer of said Placer County Local Agency Formation Commission has reviewed said petition and a hearing by such Commission was held in accordance with and as required by law; and WHEREAS , said Local Agency Formation Commission approved said annexation of the property hereinafter described at a hearing held September 3 , 1985 , subject to conditions and recommendations set forth in Local Agency Formation Commission memorandum dated August 26 , 1985 , a copy of which is attached hereto and by reference by a part hereof. NOW, THEREFORE , BE IT RESOLVED by the Board of Directors of the Truckee Donner Public Utility District that there be and there is hereby annexed to the Truckee Donner Public Utility District all that certain land and property situated in the County of Placer , State of California , and more particularly bounded and described in Exhibit "A" attached hereto. BE IT FURTHER RESOLVED that said annexation is subject to the developer entering into a development agreement with the Truckee Donner Public Utility District outlining terms and conditions necessary for the provision of service. BE IT FURTHER RESOLVED by the Board of Directors of the Truckee Donner Public Utility District that the Secretary of the Board cause copies of the order , certified by the Secretary of the Board of Directors , to be mailed to the Executive Officer of the Local Agency Formation Commission of the County of Placer for filing with the Offices of the Recorders of the Counties of Nevada and Placer , State of California. PASSED AND ADOPTED at a regular meeting of the Board of Directors of the Truckee Donner Public Utility District duly called and held in said District on the 4th day of September , 1985 , by the following roll call vote : AYES : Cooley , Corbett , Hamilton and Maass . Adjournment s-� MEMORANDUM LOCAL AGENCY FORMATION COMMISSION COUNTY OF PLACER To: Local Agency Formation Commission Date August 26, 1985 From: Ruthe McKee, Deputy Executive Officer Subject Staff Report for Meeting of September 3, 1985 TRUCKEE DONNER PUBLIC UTILITY DISTRICT - PONDEROSA HILLS ANNEXATION (85-11) Proposal : Application has been submitted by resolution of the Truckee Donner Public Utility District to annex approximately 20.9 acres of uninhabited territory in order to provide treated water and electricity. There are presently no resi- dents in the area, which is surrounded on three sides by the District and located within Placer County just south of the Nevada County line. Land Use: The area proposed to be annexed is designated in the Placer County General Plan as low density residential (two to five dwelling units per acre) . The present zoning is Single Residence Tahoe - minimum lot size 20,000 square feet, with Land Use Intensity two units per acre. No zoning changes are antici- pated. Existing land use is Single Family Residential , with only one dwelling unit now in the area. Five houses are proposed to be built in the near future. No Agricultural Preserves would be affected by the annexation. Services: Police protection in the area is provided by the Placer County Sheriff's Department, with fire protection by the California Department of Forestry. The Truckee Fire Protection District also serves this area. Other services are provided by the County. Boundary Analysis : The property is bordered on three sides by present District boundaries and the property owners have requested to be included within the Truckee Donner Public Utility District. The District presently serves power and water to a strip of territory within Placer County just north of the proposed annexation. Environmental Review: The District has determined there will be no significant impact on the environment due to the annexation, and a negative declaration has been prepared. The annexation will not affect any agricultural preserves. Transfer of Jurisdiction: The Nevada County Local Agency Formation Commission has transferred jurisdiction to Placer County LAFCO for this annexation proposal . Sphere of Influence: The Sphere of Influence approved by Nevada County LAFCO for the entire District in November 1983 lists in its findings that "the' Placer County area is provided with water service only" by the District. It is noted on the sphere of influence map that "electric service is limited to the Primary Sphere" (the present District boundaries) . The area proposed to be annexed is within the "Secondary Sphere". However, since State law requires only that the ,.. area to be annexed be within the sphere of influence, limitations on services imposed by Nevada County are not binding in Placer County. Additional Information: Sierra Pacific Power Company has indicated strong interest in serving electricity to the area proposed to be annexed, and believes Staff Report - September 3, 1985 - page 2 the property should be considered to be within the Company's service area. This was taken into consideration by Nevada County LAFCO when the sphere of influence was approved. A representative of Sierra Pacific will be present at the LAFCO hearing to explain the Company's viewpoint and concerns. Conclusions: The Truckee Donner Public Utility District has indicated it has adequate water and power facilities to serve the area. The proposed annexation is adjacent to its service territory and there are electric facilities within 135 feet. The property owners have requested to be served power and water by the District and, since the area is presently bordered on three sides by Truckee Donner Public Utility District boundaries , it would appear to be a logical extension of services for the District. Recommendation: It is recommended that the Commission approve the Ponderosa Hills Annexation to the Truckee Donner Public Utility District for the purpose of serving power and water, subject to the following conditions : 1. The District is authorized to collect its standard annexation fees. 2. The District may complete the annexation without notice, hearing or election. 3. The boundaries of the territory approved for annexation shall be described in Exhibit A attached to LAFCO' s resolution of approval and shall be used by the conducting agency in all subsequent proceedings. 4. The territory approved for annexation is uninhabited and given the short term designation of Ponderosa Hills Annexation. 5. Truckee Donner Public Utility District is designated as the conducting agency; the Board of Directors is authorized to complete the annexation in accordance with the District Reorganization Act. 6. The annexation shall not be completed until the amount of property tax revenue to be exchanged per the provisions of A.B. 8 has been determined. f Y lG Ruthe McKee —
