PROPOSED TDPUD AQUISITION OF DONNER UTILITY WATER SYSTEM

Truckee-Donner Public Utility District
The proposal that the TDPUD take action to acquire the properties of
the Donner Lake Utility Company has generated much discussion, and with j
it, the spread of certain misinformation and/ or erroneous ideas.
REVOCATION OF FRANCHISE
The Commission staff engineer who investigated the complaints from the
Biltz Tract customers, was asked the question, " Could the Public Util-
ities Commission revoke the franchise held by the Donner Lake Utility
Company? " The answer was an emphatic no.
The only way the PUD can &quire the system of the Water Company is by:
1. Direct purchase negotiations, or
2. Condemnation Proceedings.
( See Sections 1403 through 1409 of the Public Utilities
Code, State of California )
LOW COST AQUISITION OF WATER SYSTEM
The idea has been put forward that the Donner lake water system is run
down, is in very poor shape, so should not command a very high purchase
price.
The price to be paid by the PUD to the DLUC, if the PUD were successful
in condemnation proceedings, would have been not by the utilities Comm-
ission prior to the -trial. ( See P U Code Section 1411 )
Quoting from Code Section 1416
" The finding of the Commission fixing the just compensation ----
shall be final and shall not be subject to modification,
altaratdos,: re�r�eraa2.. or•review'by. any-Court ia• thi* State".
In other words, the matter of compensation will not be argued during
the condemnation proceedings.
Three staff members at the Commission office, in unofficial opinions
expressed to the writer, agreed that the It Just Compensation " set
by the Commission would exceed S300.000.00 and possibly be appreciably
higher. The $300,000. figure is the approximate depreciated book
value of the water system.

25% OF RESIDENTS SIGN PETITION
The Sierra Sun reported that '• A petition, signed by 25% of Donner Lake
residents, was presented to the TDPUD Board". 25% of what?
Was it 25`X of the count of persons, or was it 25% of the properties
receiving water service? If the latter, what does that say for the
remaining water customers? Are 750 water accounts against the intent
of the petition?
CONCLUSION
The previous paragraph was included to demonstrate that a petition
sign-up cannot be taken as the equivalent to an election. The Sierra-
Sun reporter was mislead into the statement: "Donner Lake residents
will agree to assume full financial liability for squiring or improv-

ing the Donner Labe water system. Far from the truth!
If this Board decides to pursue the intent of the petition, we urge
an election at an early date. The ballot should clearly state what the
added costs would be to Donner Lake water users, over pre&t rates,
for which ever course they choose, ie, continuation with the present
owners, or a take-over by TDPUD.
