MANAGER'S REPORT
1 . General Status of the District
During the past two weeks there have not been any significant water
or electric outages. However, on March 15th, in the afternoon, there was a
temporary outage in the Sierra Meadows--Ponderosa Palisades area caused by the
severing of one of our power poles by a vehicle. The problem was quickly re-
paired; the costs will be billed to the offending party.
2. Annual Report
I met with Gail Grimes during the past ten days and we jointly put
together a great seal of information that should go into the annual report.
Gail is currently preparing the data in copy form, and is also preparing a
report layout for presentation to the Board. Once the concept has been ap-
proved by the Board, we will go ahead and do the complete report, then come
back to the Board with the final version of the report for the Board to read,
modify if they so choose, and hopefully, approve. After that point, the re-
port will be a finished product and go to the printers for printing.
1 am firmly convinced that this annual report„ when finished, will be
one of the most valuable tools this -District has ever produced to aid in com-
municating with its customers, making the people of Truckee aware that the
TDPUD is their District and advising what the District does any why it does it.
3. Update on Stampede_ Dam Project
On Monday, March 12th, I received a call from a Mr. John Anderson of
^" the Western Power Marketing Administration of the Department of Energy. Mr.
Anderson informed me that they were writing a letter to the Sierra Pacific
Power Company advising Sierra Pacific that the power plant would be constructed
and requesting that, under the current energy law, Sierra Pacific wheel the power
to the TDPUD. The reason for Mr. Anderson's call was to let us know what they
were doing since, in previous correspondence with the District, he had noted
that in 1976 the Manager of the District had indicated that the District would
want to construct their own power line.
Mr. Anderson's position, and presumably that of the Western Power
Marketing Administration, was that as long as there was an existing Sierra
Pacific line that went in the vicinity of Stampede Dam and also came very close
to Truickee, this existing facility should be used rather than disturb the en-
vironment any further with a new line. I told Mr. Anderson that I personally
agreed with the Department of Energy's approach on this and felt that there
would probably be very little difficulty in working with Sierra Pacific to
achieve a wheeling agreement. I feel that we are cooperating very nicely with
Sierra Pacific these days and believe that they would be quite willing to wheel
the energy to us unless there are really good, sound technical reasons that pre-
vent them frorn doing so.

Dear Jim:
Pursuant to the request of the Board of Directors, this office is submitting
this report on LAFCo for poss..ble use at the March 19, 1979, meeting.
Function end Effect of LAFCo:
The function of the Local Agency Formation Commission is to aid in the
orderly formation and development of local agencies. The first paragraph
of Section 54774 of the California Government Code summarizes the purpose
of the Con-itnission as follows:
Among the: purposes of a local agency formation commission are
the discouragement of urban sprawl and the encouragement of the
orderly formation and development of local governmental agencies
based upon local conditions and circumstances. One of the objects
of the local agency formation commission is to make studies and
to obtain and furnish information which will contribute to the
logical and reasonable development of Local governments in each
county and to shape the development of local governmental
agencies so as to advantageously provide for the present and future
needs of each county and its communities.
(Unless otherwise stated all "Sections" refer to a section of the California
Government Code.)
The Commission has broad powers and may determine the area boundaries
within which a distict may operate, may approve or disapprove proposals for
annexation or consolidation of districts, and may limit an existing district
to the services it. presently provides..
The Local Agency, Formation Commission was created and exists by virtue
of the Knox--Nisbet: Act, and it appears to be the intent of that Act to give
the Commission general powers to coordinate the services provided by the
various districts within the County.

Section 54858 states that the Commission may refer any proposal to a Special
Districts Advisory Committee. The appointment of and proceedings by the
advisory committee shall be made and taken substantially in accordance with
the provisions of Chapter 2, Part 3, Division 1, of the Government Code
(Sections 56220 et seq.). Since the Commission does have such broad powers
over the district, an advisory committee would probably be a helpful method
by which the •districts could make their desires known to the Commission.
Latent District Powers:
The powers of the Truckee-Donner Public Utility District are set forth in
Section 1646E of the Public Utilities Code, which reads as follows:
A district may acquire, construct, own, operate, control, or use,
within or without or partly within and partly without the district,
works for supplying its inhabitants with light, water, power, heat,
transportation, telephone service, or other means of communi-
cation, or oneans for the disposition of garbage, sewage, or refuse
matter, and may do all things necessary or convenient to the full
exercise of the powers granted in this article.
In addition, a public agency possesses those powers necessarily or fairly
implied in or incident to the powe-.rs expressly granted and those essential
to the declared objects and purposes of the agency— not simply convenient,
but indispensable. lIard,en v. Superior Court, (1944) 44 Cal.2d 630, 284 P.2d
9; Von Schmidt v. iVidbur., 94. "105 Cal. 151, 38 P. 682. In other words,
when relying oil an express power the District may do whatever is convenient
to the exercise of that power, but when relying on a general object or
purpose, the act must be indispensable to that purpose or object.
Section 54851 provides that. the Commission may adopt a rule that would
determine that no new or different function or class of service shall be
provided by any existing district. If such a rule were adopted, the. Truckee-
Donner Public Utility District would be limited indefinitely to supplying water
and power..
