General Status of the District - Attahced to this report are the water produc- tion figures for the month of May. These figures show a marked increase in water consumption due to golf course watering at Tahoe Donner. During the past two weeks, we have had two water outages in Ponderosa Pal- isades cussed by the failure of Ponderosa Palisades booster pumps to operate when called. The cause of the failures has been determined to be an operating problem rather than a real equipment failure. One of the two booster pumps in the Booster Station was removed because the electrical terminal connections were badly burned; it was thought by the water crew that the pump may have been damaged. While the pump was removed, the telemetry needed to be rewired so that the second pump would always come on when water was called for. Inasmuch as the rewiring was not accom- plished when the call for pump turn-on came, the call came to the pump that had been removed; therefore, nothing happened and the tank ran low on water. When the problem was discovered, the necessary corrections were made, and the station is now back to normal . 2. Annual Report - We are still waiting for the semi-final draft of the annual report copy from Gail Grimes. I anticipate receipt this week. 3. Energy Conservation Booklet - I have circulated to the Board a manual that is fairly complete and readable on the subject of energy conservation in the home. These booklets are available to us at a very reasonable cost (less than $1 .00 a- piece) . After reviewing the booklet, I would like the Board members ' opinions as to whether or not we should purchase a supply of these manuals for distribution to customers with "high bill" problems. 4. Infrared Heat Loss Audit - We have received a letter from an aerial survey com- pany offering to provide infrared aerial surveys of our District as part of an energy conservation program. Numerous co-ops and power agencies in the middle west have used these aerial surveys to great advantage in helping their customers reduce dom- estic power costs. What these aerial surveys show, when they are made on a cold day or night, is the houses or buildings with high heat loss. In the mid-west, where these aerial surveys have been used rather extensively, the owners of the buildings shown to have a high heat loss are notified by the utility and asked to make correc- tions or to insulate in the interest of energy conservation. 5. APPA Annual Meeting - The annual meeting of the American Public Power Associa- tion, of which the District is a member, will be held in Seattle, Washington the 17th, 18th, and 19th of June. Inasmuch as I will be in Vancouver, Canada on the 15th and 16th of this month, 1 propose to stop over in Seattle for at least one day to visit the APPA meeting . A copy of the program for this meeting is attached to this report for Board information. Another convention worth noting is the American Water Works Association annual meeting which, this year, will be held in San Francisco June 24-29. Some of the sessions at the AWWA convention seem to have very appropriate material for our District. A copy of the program is attached for the Board 's information. Attached at page 6o of this Report is the Bond Counsel' s Proposed Agreement that provides for review, approvals, inspections , acceptance, operation and maintenance of the Water Facilities to be up-graded within the Armstrong Tract. Improvement Plans for the Water were provided to the Staff May 7th and a complete set of Road, Sewer and Water were provided May 31, 1979 . The proposed work consisted of a New Duplex Booster Station, a new 100,000 gallon Storage Reservoir and 2,930 feet of Distribution Piping. Upon completion the fire flow within the Armstrong area will comply with the Fire District Ordinances and a high level of water service will be assured. The General Plan is on the wall. I recommend approval of the Improvement Plans and the signing of the cover sheet and hereby confirm to you that the installation will conform to the District Standards . These events will be reported as I recall them. Mrs . Sutton came into the office during the week of August llth and asked me what I knew of Quintana' s water on West River Street. My reply was that I knew nothing about it as Dan Cook had been involved in the West River Street water main and I would not be involved until the District had accepted the main. She then inquired if there had been a request for service from Quintana. My reply was that I did not know as I would not normally be involved in a water application. The connection request would be made through application taken in the front office. The job would be completed and I would have no knowledge of the connection. Mrs . Sutton then asked what Ken Krajewski knew about the connection. Mr. Krajewski indicated that he knew nothing of the matter_ Mrs . Sutton asked to see correspon- dence from the District' s file concerning such connection and anything concerninrg the county and/or Quintana' s water. Mrs . Sutton examined the file related to this matter and indicated that there was some correspondence missing. Ken Krajewski was questioned and said that he was not aware of any correspondence. However, upon further questioning he was able to produce some further correspondence. MEMORANDUM to the Board of Directors Quintana Construction, West River Street Water Connection August 28, 1975 Page 2 Ken and I went to see for sure that water service had in fact been run to Quintana' s building on West River Street now occupied by Yates Body Shop. We discovered that water was running to Yates Body Shop. At our request John Quintana came into the District office and told Ken he had connected onto the County water line. I phoned Terrence Lowell and asked if he knew any- thing about Quintana' s connection. He replied he did not but requested that I keep him informed of what was discovered. The following day I spoke with Quintana and Freitas in our office. Quintana indicated he had made a water service connection to our water main at a point across the road from Standard Oil. That connection is the one I attempted to explain to the Board on August 19, 1975 . Mr. Quintana was unable to attend that meeting. Since that time Mr. Quintana has come into the office. During . his visit I asked him to show me where he had made the connection. He indicated that he would not show me any- thing or tell me anymore but that he would meet with the Board. Mr. Quintana has been invited to attend our next regular Board meeting on September 2nd. Mr. Lowell phoned the District on Friday, August 22nd and gave the District his permission to turn off the water at the county barn in order to be sure that Quintana had connected to the county system. Tuesday morning, August 26th, Mr. Craig, Mrs . Sutton and, myself went to Yates Body Shop while Mr. Krajewski turned off the water at the metering point at the county barn. When the water was turned off at the county barn the water stopped flowing at Yates Body Shop. This leads me to believe, beyond a doubt, that the water to Yates Body Shop is connected on the customer side of the water service at the county barn. I have sent a letter to Mr. Lowell explaining that the connection is on his side of the service and that the MEMORANDUM to the Board of Directors Quintana Construction, West River Street Water Connection August 28, 1975 Page 3 District has a pipe locator if he needs to know where the pipe crosses his property. To better understand the current problem a review of the West River Street Assessment District may be in order. 1 . Development was being retarded along West River Street due to lack of fire flow. 2 . Private fire systems were proposed and conceptually okayed, however, the property owners and the Fire Protection District felt the reliability of the community system was worth the extra cost. 3 . Several public meetings were held with the property owners ' along West River Street --- some vocally opposed - some in favor. 4 . The Assessment as formed was the end result of the petitions returned to the Board by 70% land owners effected . 5 . The purpose of the A.D. was to provide fire flow. 6 . Mr. Quintana applied to the Board to have his property included - which was approved . 7 . Plans and Specifications , Notices , Resolutions and Assessments were prepared in accordance with the Petition and directives that the water main not be constructed in such a way as to provide service to those beyond the limits of the A .D. Service and line extensions beyond the A .D. are to come before the Board for approval and must contribute to the overall cost. 8 . After the Bids were received (Quintana was asked to bid on the job ) a protest hearing was held - Mr. Quintana filed a written pro- test and asked to be excluded from the District . :1 a•S 7.L ..�..E:. Board of Directors Truckee , California September 16 , 1975 Page 2 9 . The Board, did not let Quintana out of the District, however, his $4 , 600 assessment was reduced to $0.00 . The 320 L. F. of 6" main to the east was also eliminated from the project at that time. 10 . Mr. Quintana asked to have the eliminated line reinstated June 26th and to have the line extended some 300 feet beyond the contract plans position. John stated in his letter, "as I under- stand it our original assessment was slightly in excess of $4000 for this service" . 11 . Mr. Quintana was informed by our letter of July 7 , 1975 that : 1. His payment would be S7,266 . 19 . 2 . That Dart must contribute . 3. The line will be installed as per the contract plans . ` 4 . Payments must be made in full by July 10, 1975. Copies of the letter were sent to Nevada County and to Wes Zachary. 12 . A final inspection of the completed work was conducted July 30 , 1975 and the Notice of Completion was approved August 19 , 1975 . 13 . Mr. Quintana apparently connected his consumptive water line into the County Building prior to the completion of the West River Street Assessment District. 14 . Mr. Quintana entered into an agreement with the County some 26 _ days after the West River Street Assessment District work was done r, and some seven days after the Notice of Completion was filed to : 1. Install a water line within 250 feet of the County Building . r 2 . Provide 1,000 G. P.M. i 3. Constructed in accordance with all T.D. P.U.D. requirements . 4 . "Said water line will also furnish water to" . . . Yates Body Shop. 5. The Countyvall pay 112 of the line extension cost up. to $3 , 644. 10 . Conclusion : A . Mr. Quintana has a contract to extend the now existing line easterly to a point within 250 feet of the County Building to provide : 1. Fire flow to the County. 2. Water service to Yates Body Shop. B. Mr. Quintana connected to the County Water Service for his (Yates ' ) consumptive water service with full and prior knowledge (July 7) that consumptive water was not being provided by the 12" assessment district line . As is the case with all other commercial property in the assessment district. C. My interest in this matter could. just as. well have been pursued in a like manner by a private citizen, but since I am on the PUD Board I felt some responsibility to try to untangle it. July 1, 1975: At the Board meeting on this date , the Directors received copies of letters from the Nevada County Derartment of Public ?".orks (June 23) and John Quintana (June 26) to Ken Krajewski re: water service to both properties and firefl.ow for County Maintenance Facility from the 7:RSAD lin e . Dan Cook was at our meeting, and he asked for a ter_ta.tive okay on a Change Order which would reinstate the construction of the line extension toward Quintana' s property. He ex- rlained that we-were not altering the WRSAD boundaries to include the County property, but that Quintana' s property was already geographically located withhthe Assessment District, but had been given a zero assessment last fall when Quintana asked to be excluded from the improvements . His exclusion at that time had not affected the remainder of the 1"/RSAD , and his extension could be reinstated now through a C-4"U- without affecting the Assessment District. In response to my question about the contents of the letters from ^i.lintana and Nevada County regarding grater service for both rroperties and fireflow for the County, Dan indicated the water would come from the east instead of '.RSAD as far he knew. v-¢. It was to be paid by July 10 in order for the contractor to receive authorization to proceed because the rest of the job would be finished by then. About July 17 or 18 , 197 5: I happened to observe what appeared to be a trenching operation across the County yard in direction of Q uintana' s building. July 24, 1.975: After a Dart Committee meeting with Airport District Board, I asked Dan about the WRSAD project. He inquired whether I had heard anything about '?uintana being unhappy with his line extension. I hadn' t heard anything about this , and Dan said that during the construction of the line extension, Quintana had wanted the line to be built farther down West River Street. Dan said that he had instructed the contractor to terminate the line and place the hydrant precisely according to the anDroved C.C .U. , which was what Quintana had paid Tor. Aim-ust 13, 1975: I became aware that some contract for water was being arranpAed between the County and Quintana. P•y - curiosity was aroused since I recalled the corres,_.ondence. to Ken in late June which indicated some sort of arrangement between the County and Quintana , and since I was aware that i•-- there was no water main in front of Quintana' s Property, and since I knew that the :r7RSAD Quintana Char_p7e Order had not gone as far east as Quintana apparently wanted it to go. My -primary concern at that time was the integrity of the WRSku line until that line had been accepted by theDistvict and until some policy decisions had been made by the Board regard- ing future hook-urs. It had always seemed to me that the �Board would have to establish some policies on this line to guide IT-S administration since it had been paid for by property owners , rrimarily to provide themselves with fi_refl.ow to meet reouirements necessary for the development of their properties. _ I was concerned that the County and Quintana wRxa might be making some arrangement to extend the WP.SAD line before the necessary decisions had been made by the Board on future hook-ups and extensions . That afternoon I asked Paul where Quintana would get water service for his building since there is no water main passing by his property. He indicated that he didn' t know. I asked him who would know He wasn' t sure . I asked him if Ken Krajewski might- know. He said that he would find out. I told Paul the basis for my concern: the integrity of the WRSAD line , and the -possibility of a contract between Quintana and the County which might involve that line . Aug-u.st 15, 1975s I discovered that Quintana' s building was occupied and had water service . I told Paul that I wanted to discuss Quintana' s water service with Ken and that I wished him to arranp-e it and be present. I asked Ken where Quintana was getting his water. Ken said that as far as he knew Quintana didn' t have any water. I assured him that the building did have water, including a toilet that flushes , and a water box out in front. Ken said that he didn' t know how or where Quintana could have obtained water. He conjectured that he might have a line in the river, that he might be connected into Twin States.)water line in the river, or that he might even be connected into the County building next-door.- Ken then volunteered that he was Positive that it was not coming from the WRSAD line . I asked him0 how he could be so positive _ about that if he didn' t know where it was comin-- from.- He said because there was only one road crossing up by the homes . We agreed that there was so evidence of any other road crossing or any disturbance of the terrain along the r oad which might indicate aline installation. Alrost in unison both Paul and Ken volunteered that the WRSAD .Line "fell short , " both usinr7 the same phraseology. I asked : what they meant by that, and they indicated that the line had not been extended as far as it was supposed to have been extended. I told them that my information from: Dan Cook A,,--as that the line extension had been constructed exactly as planned and according to what was paid for by Quintana and as outlined in Dan' s letter. I told Ken I would ar.•preciate it if he would find out where Quintana was getting- his vrer. I left the office shortly after with the intention of going to the Post Office . When I observed Kent in his pickup jijj" at the Gateway Fire Station, I decided on the spur of the moment to go down to Quintana's building and talk to .dim Yates , the tenant, myself. He wasn' t in so I proceeded to the Post Office . Ken' s pickup was then at the downtown Fire House , so I decided since he wasn' t in much of a hurry to check on Quintana' s water- service after all I )d-_j;:90oack to Yates Body Shop and waiter for Jim to return. After -erhars half an hour 23 Sutton to Board re : Quintana ramie 4 Avp�ust 1.5, continued: I decided to �-_o on home and return later. When I did see Jim later, after Ken and Paul had checked with him, he did not ar.-oear to have any knowledge of the source of his water service since it was installed before he occupied the building. He said that his lease did not include free water, and he presumed he 'd be billed monthly by the PLTD for water. He was sure the stater wasn' t coming from the river because he ' d be aware of a pumring operation. Later I saw Paul at the office again, and he recounted his conversation with Jim Yates , which coincided with mine , and Paul indicated he was trying to make contact with Quintana. I asked Paul to examine the Work Orders for water hook-ups and hook-up applications with me so that we could determine if the District had any record that Quintana, Yates , or Nevada County had apr.lied for water, been connected, etc . We did not examine Work Orders , but did look over the hook-up appli- cations . Quintana had only made application for an electrsc hook-up and Yates had sit-ned an electric service application; Nevada County had ar,r.lied for both water and electric hook-ups to its new building in March, 1975. That afternoon I tried to call Wes Zachery, Der.uty County Lnaineer, who had v ritten the June 23 letter to Ken. He was on vacation for the next week or, so, and Terry Lowell , the Director of Public Works , was out of the office for the rest of the afternoon. Auanst 18 , 1975 (Monday) : I placed a call for Terry Lowell who returned it about midday. I asked him what kind of arrange- rent the County was making with Quintana for water. He said he was finalizine' a contract with Quintana to provide water service and fi.ref low for the new Maintenance Facility; it would involve extending a i,�,ater line and Installing a fire hydrant, etc . Terry Said that the County would pa},r half of Q uintana' s assessment for NIRSAD . I told him that the :'IRSAD line was already extended as far as it was going* to be extended under Quintana' s assessment. lie thought the line hadn' t been finished yet. I assured him that "Acceptance of the 11RSAD Line" was an Agenda item. for the PUD meeting the next night, August 1-9 . I told him that the extension was not only com- pleted, but had been installed according_ to the V:RSAD plans and the Quintana. C .C.O. according_- to my information from Dan. I asked Terry how the-County coii].d make a contract with anyone to sur.•rly them with water and fi_reflow from our lines without eonsultina the District. He said the County' s contract with Quintana would require the contractor to make arrancrements for any Line extension, hook-up, etc . , and that the work would have to be done according to our specifications and directions . Sutton to Bo;�rd rei Quintana 9/15/75 Page 5 Ilk AuFrust 18 , continuedr I said it certainly didn' t appear that the District knew what was going on. He felt, to -the contrary, that Ken knew because Zachery had conferred with him. He read some letters in his file on the fireflow for the new County facility. The letters included copies of letters from Dan Cook to Ken Krajewski on October 25 and November 8, 1974, detailine: plans for a County-Quinta-na water installa- tion from the south and east of the County -property, including sketches , etcl; letters from the County to the Truckee Fire District, etc . , including ones dated this summer, indicating that the County -planned to obtain firef low and service from t he MSAD extension. We both rremarked that there should have been xhmmk some recent letter of confirmation from the PUD on the ;'iRSAD arrangement, but Terry couldn' t find anything like that in his file . I al-so asked him if he had any idea where Quintana right be wetting his water service since no one at the PUD knew anything about it, and since Quintana hadn' t applied for service . He said he didn' t know. I t old him that I had observed what I thought was a- trenching operation across the County yard a r,onth previous toward Quintana' s building. He said that he was told there were some drainage -problems and perhaps that was what I had observed. I asked him if there -was any possi- bility that Quintana might have tied into the County water ser vice , since Ken had suggested it, or if Quintana might have crossed through the County yard to connect to the PUD water line in the street to the east of the County property. Terry indicated that he had no knowledge of either possibility. He said that a connection to the County service would be illegal he thought. I saw Paul briefly at the office . He informed me that Quintana had been in the office and had said that he had connected to the County water serviee . Further discussion revealed that Paul had not r:ersonally seen Quintana , but that Ken had told him that Quintana had been in and that Quintana had told Ken that he had connected to the County service . I asked Paul if he intended to confirm this by some method. He said that he would. I told Paul that I had reason to believe that some corresnondence existed thatshould be in our files and that I ,*fished to review it. He asked where I thought he should start looking for it. I told him that if there wasn' t anything in the usual files he should probably try the files in Ken' s office . He said that he would ask Ken for it "quietly. I asked him what he meant by "quietly." He explained that since Ken and I had a problem, he wouldn' t ask for it while I was there because then he might _ not be able to obtain it. I told him that if he was afraid of that ha--^-rening then held bett-er fire Ken. -- zs Sutton to Board re: Quintana 9/15/75 pale 6 Aur-ust 1.8 . continued: I atterPted to see the Fire Marshall, Reuben h:aki . that afternoon. Later by Phone we made an appointment for the next rrorninp. August 19 , 1975 (Tuesday) I talked to Reuben about fireflow requirements , etc . He indicated that the hydrant at the eastern termination of .the WRSAD line (Quintana' s extension) wasn' t quite as close as they like it, but it was close enough to ''uintana' s building to satisfy the TFD fireflow requirements . He confirmed that this hydrant was not, however, close enough to the County facility and some arrangement woiild still have to be made for its fireflow, He indicated that from the TFD viewpoint the plan last fall to put in a 6" main to the east of the County property was a better solution for the general area, but that the Fire District doesn' t involve i_tTself in those kind of decisions as loner as the fireflow is satisfied , and that whe-be the water Mould come from would be the PUD' s concern. I asked to see anything: in the TFD files that would be helpful in determining what the situation was . There were a number of letters spanning the past year between the County and TFD, Cook' s October & November, 1.974 letters to Krajewski , etc . I asked for copies of Dan' s letter of October 1974 to KK (because -it contained more details referred to in the Novem- er letter) and Zachery' s letter to TFD on June 30, 1975 which asked for an extension of time for fireflow require- ments compliance until mid-July when he expected the WRSAD line to be completed . (Zachery' s letter, dated before ,." <'...,< even tentative approval on ^uintana' s line extension had been before the Board, stateds "have at this time taken the necessary steps to have ^ the waterline which is currently being constructed by the Public Utility District on West River Street extended to the County Facility to meet with your required fire flow." There appeared to be no correspondence from the PUD confirming any arra.nt-emer_t for the County to receive service and fireflow from the WRSAD line . This lack of written confirmation by anyone connected with the PUD continued to puzzI6 me . I talked to Reuben again. later on the phone and he verified that there was no written confirmation in his file on the County' : plan to obtain fireflow from WRSAD. He indicated that the TFD wouldn' t reaard such confirmation as a necessity to grant the extension of time on the -oresumptior_ that the County knew it had to make the necessary arran¢ements with the PUD. AUGUST 19 Board Meetings Paul retorted to- the Board that John Quintana, accompanied by Newt Freitas of the Co>>nty Road Department, had been in the office that morning and had talked to Paul and Ken. Paul told the Board tr_at Quintana had told v945-. < Sutton to board res Quintana 9/15/75 page 7 Ai)-ust 10, continued: that he had extended our water line from near the Standard XYaX Oil Comrany plant to serve his building_. Paul was asked to show the Directors on the map where the extension was made , but he preferred to draw a diagram on the chalkboard. His first diagram would have required a road crossing. When asked about the lack of any visable road crossing+ he there -9== indicated he couldn' t ex-plain 'Quintana' s hoof:-up after all. August 20, 1975: I went to the office in the early afternoon to do some research on another matter. Paul gave me a file of Quintana/ Nevada County correspondence to review. It contained cor_ ies of the same correspondence res WRSAD that the Board had received from June , 1975 At the coffee pot in the hall I told Paul that this file didn' t contain the letters. I was interested in seeing since I already had them.. I told him once again that there should be other correspondence which should be in some District file . Paul went into Ken' s office while I was still in the hall and I heard him ask Ken if there was anything else . I heard Ken reply that there wasn' t anything else . Paul returned to the hall and reported to me that there wasn' t anything else in the files . I said that I knew that there should 'ce some other correspondence , and that I had already obtained conies of several letters , including one from Dan to Ken which very definitely should be in our file . As I told Paul that it didn' t matter whether they were available through the District or not because I could get conies from the other agencies r involved, Ken was arproaching the hall from his office saying that there wasn' t anything_ else in the file , He immediately t urned around and within 30 seconds ar•reared in the Board Room, where I gone , with a file in his hands . He gave me the file with the exr»lanation that he didn' t know what I wanted and he was just looking under "'Quintana." I told him it was strange that he couldn' t find anything else when the heading on the file read "Quintana, Nevada County, W!j.Rivbr St" or a reasonable equivalent. This file did contain conies of the letters from Dan to Ken last fall_ on the 'Quintana property/ Nevada County property fireflow solutions, letters between Nevada County and the TF'D , a letter from Y!aki to Cook in . October, etc . August 21, 1e715s I talked to Terry Lowell . I told hir-a that I was ar-Darentl.y wrong about the -possibility that Quintana' s line might be through the County yard or to the County service . I exrlained that Paul had resorted to the Board at the August 19 meeting that Quintana had rersonally exrlained to him that he had extended oub- water line in W , River Street from the east to serve his property. Terry said that Quintana had called him the previous day ('�"?ednedday, August 20) and told him that he had connected into Ai)�-i)st 21, continued: the County water service . He said that Quintana had also told him that Ken had told him to solve his problem of water to his building.: temporarily anyway he wanted. Terry and I agreed that it was difficult to decide what to believe since Quintana seemed to have a variety of exnlana.tions . We dis- cussed the easiest way to determine whether the latest version was true: turn off the water at the County service and observe what happened to the water at Quintana' s building. He said he would reQuest the District to do this. Terry main expressed doubt that the WRSAD line extension was actually completed. He said that in a recent shone con- versation with Paul, Paul had said he "thou?;ht" the INIRSAD line was finished. I told his: that this was a strange way of putting it when the Board had taken action to accent the line on August 19 , and the item was placed on the agenda during the previous week. We discussed whether the County contract , which had not yet been approved by the Board of Supervisors , would put the County in a vulnerable rosition from the standpoint of raying half of Quintana' s assessment for the WRSAD extension which did not serve the County facility' s fireflow needs . Terry said that the contract provides for a line extension to serve those needs without stipulating where the water comes from. Terry suggested that I talk to Quintana personally and ask him to explain where he was getting his water. I explained t hat since I was not acquainted with Quintana , and since Paul was already in touch with him on the matter, I didn' t feel that I should interfere by making contact with him myself. August 22, 1975 (Friday) : Paul called to tell me that Terry Lovell had authorized a turn-off of the County' s water to see if ^uintana had connected into that water service . John & I went with Paul to the Quintana. buildings; Ken went to the older County building. Freitas was visible outside near Ken before Ken shut off the water at the County water box. As we returned to the PUD office , Hohn and I both indicated that we thought the route of the pipe should be located by the District. Paul expressed som..e concern for causing the County some embarrassment. I asked him who he thought might be embarrassed. I told him that my conversations with Terry Lowell didn' t indicate that Terry Lowell as Director of Public Works would be embarrassed by whatever turned out. Paul also indicated that he did not want any of this to be blamed on Ken; he assured us that Ken knew nothin,= about any of it; he indicated that he regarded my interest in the entire matter as a result of a nersona.l dislike for Ken; and he indicated that he wouldn' t stand for Ken to be blamed in any way. We did agree that Paul was to call Terry Lowell that day to inform him that the turn-off confirmed that Quintana' s water was connected to the County service , and that the District has equipment to locate water ripes . Can this date , in confirmation of his phone conversation with Lowell, Paul wrote a letter to Lowell retarding the "improper water connection, " enclosing Section 7 of rules & regulations ree-arding "Resale of grater." AuF-ust 28, 1975 (Thursday) : I had an opportunity to talk briefly with Dan Cook about the Quintana hook-up. He said that he believed that Quintana' s original plan his development was for, a warehouse which might not -i eo uired a water hook-up. Jack Marquette was also -eresent , and Dan suggested that he right errant to look into buintana' s sewer connection since he had r_wate ' a toilet that flushes and there is not a sewer main past his property. He told me that the sever line does cross County yard and is connected into the County service . He assured me it was in a completely separate trench from the water service . September 10, 1975 (�',�ednesday) : Terry Lowell returned my call. I asked him if Quintana had an easement for his sewer service across the County yard. He said he did not, and did not have official permission. He thanked me for sending him a copy of Q uintana' s September .l letter to the PUD because he hadn' t received one from Quintana although a copy to Lovell showed on the letter. Regarding the water hookup, Q uintana/County contract for water, and the problem in reneral, Terry questioned whether the PUD didn' t have some responsibility to determine employee involve- ment in Quintana water service and QQ uintana' s understanding. that L7RSAD inclusion would provide his property and County with water service and fireflow.. I told him that at various times I had been assured by Per. Krajewski , Mr. Hobensack and .T. r. Quintana that he had acted completely inderendently in his water hook-up. I had also been assured on several occasions by Hobensa.ck that no one was responsible for any x=W misunderstand- ing on the 7hRSAD line , and no arrangement had been made to allow Quintana to get water from that line for any purpose .
