MANAGER'S REPORT
December 17, 1979
General Status of the District - There have been no significant water or
power outages since the last Manager's Report. Because of the protracted
period of good weather, new connection activity remains at a high level.
By year end, PUD crews will have installed nearly 1,000 new electric meters
for the District. This is 21 times the number of new services forecast a
year ago. Recent developments which indicate a possible cutoff of new sewer
permits in the Truckee area will probably act as a further spur to building
activity in the coming months and will result in a continued high level of
new connections to at least mid-year 1980. Such an event as a sewer mora-
torium will also greatly increase the building pressure on non-sewered
areas such as the Martis Valley, Prosser Heights and Prosser Lakeview Es-
tates.
Pre-application meeting with FmHA - Tuesday, December llth, Dan Cook, Karl
Kuttel and I met with Jim Walker of the Farmers Home Administration in
Woodland, California to discuss the possibility of borrowing money for our
1980 water system improvements. The conversation with Mr. Walker was rather
discouraging inasmuch as he pointed out that the Farmers Home Administration
in Northern California has 135 applications on file for water projects, the
total of which is over $100,000,000. The funds available, including loan
and grant funds, total approximately $28,500,000. He indicated that the
probability of the District obtaining loan funds for the 1980 construction
year was very small, and in any event would require a revenue bond election
prior to the Farmers Home Administration proceeding very far with a loan ap-
plication. I have since talked with a financial consultant for the Northern
California Power Association and the Turlock Irrigation District who suggested
that we go ahead with a bond election in any event, and that we may wish to
include in the bond election monies for such projects as the long-term or five
year forecast of funds needed for the water system as well as for the two
hydroelectric projects. He pointed out that obtaining bonding authority
from the electorate does not obligate the District to actually sell the bonds
and use the money; it simply gives them the authority to do so as the money
becomes needed for various projects within the scope of the authorization.
District Conservation Program - During the coming week, I have an appointment
with Mr. Jim Hacker of Sierra Pacific Power Company to discuss potential Sierra
Pacific help in establishing an energy conservation program. Mr. Howard Koester,
General Manager of the Sierra Economic Development District in Auburn, has also
pledged whatever help he can provide.
Essentially, an energy conservation program consists of several
activities; 1) education - this involves educating the users of energy through
direct mail programs, seminars, demonstrations, advertising and other means,
2) an energy audit program - this involves the inspection of consumers' resi-
dences or places of business and the determination of the energy efficiency

Re: Truckee Donner Public Utility District
Dear Lew:
This letter is being sent to confirm our telephone conversation of
this date regarding your unauthorized use of the Ponderosa Palisades
Tank access road as a driveway to the residence on Sunshine Court.
As I indicated, the Board of Directors of the Truckee Donner Public
Utility District have directed the Manager to place a chain across
the access road in order to prohibit any unauthorized use.
Your requests to use the access road were specifically denied at
two regular meetings of the Board of Directors. Their action in
prohibiting access is being taken in furtherance of Board policy
regarding these matters.
r' It is my understanding that you will be contacting the Board of
Directors regarding your dissatisfaction with the State Communi-
cations vault located on the Tank property.

Dear Lew:
This letter is being sent to confirm our telephone conversation of this morning
regarding your residence on Sunshine Court. The President of the District,
Mr. Karl Kuttel, indicated that the District will seek to correct the drainage
problem from the Ponderosa Palisades Tank. In addition, Mr. Kuttel indicated
that as a courtesy, he would support your efforts to seek temporary access
to your property across the District's land for purposes of moving heavy
objects, furniture, etc.
It is my understanding that the District will maintain the position set forth
in our telephone conversation and confirming letter of December 4, 1979,
regarding the placement of a chain across the access road. This matter will
be placed on the agenda for the December 17, 1979 meeting, and it is hoped
that you will attend at that time.

ENGINEER'S REPORT
DECEMBER 17 , 1979
1. MEETING IN WOODLAND December_ 11, 1979
Attached as page to this Engineer' s Report is a Memo to File
concerning the preapplication meeting held with Farmers Home
Administration. Milt has already discussed the matter at some
length earlier on the agenda, and no additional discussion is
warranted at this time.
2. TRANSFER OF DART'S LETTER OF CREDIT
The agreements between the Truckee Donner Public Utility District
and Dart Industries provide for a 1.6 million dollar letter of
credit guaranteeing performance of Dart with respect to the
supplemental agreement of 1973. It is appropriate that the letter
of credit should be transferred to the airport transmission main
well pumping facilities and other related work at this time.
3. PLACER COUNTY ANNEXATION
Attached as page 5 of this Engineer's Report is a narrative for
your consideration as it applies to the annexation of Placer
County Service Area No. 19 .
4. WATER USE ORDINANCE
Enclosed as page 8 of this Engineer's Report is a narrative
discussing the water use ordinance and some of its ramifications
as I see them at the present time for your consideration and
discussion.
5. GOLDTOWN/TRUCKEE MOUNTAIN TOWNHOUSES
Attached as page 14 of this Engineer's Report is the latest
correspondence concerning the Goldtown/Truckee Mountain
Townhouses . We have had several conversations on the telephone
following the last meeting of the Truckee Donner Public Utility
District, however, there have been no submittals of written
information and/or documentation provided.
6 . EASEMENT GRANTED TO THE TRUCKEE SANITARY DISTRICT BY THE
TRUCKEE DONNER PUBLIC UTILITY DISTRICT
Attached to your last Engineer' s Report was a request to grant
an easement for one of the main collector lines in Sewer
Assessment District No. 5. It is my understanding that Steve
has responded to you concerning the easements , its applicability
and benefits to the district. It would be in order to grant the
easement at tonight's meeting, if that is the pleasure of the
Board.

Fm.H.A. MEETING DECEMBER 11, 1979
Milt had scheduled a meeting with Mr. Hardley of the State Office
in the Farmers Home Administration in Woodland, California for
10: 30 A.M. Unfortunately, Mr. Hardley had an illness in the
family and was not able to participate in the meeting with the
District. Mr. Jim Walker substituted (Jim Walker tells us that
he will. be leaving the Federal service on January 11, 1980 after
31 years of service) .

At the present time Truckee is eligible for some grant fund
participation in that the median family income is listed as
$8,481 per year. The cut off point for grant eligibility is
$8,500 per year.
Regardless of the eligibility, it would appear that grant funding
possibilities are slim. Statewide in fiscal 79 the Farmers Home
Administration has only $8,000,000 available. Statewide in fiscal
79 the Farmers Home Administration has $20,000,000 to utilize as
loan guarantee funds.
At the present time there are 135 projects that have submitted
preliminary applications and the projects for which applications
have been received total some $100,000,000.
Mr. Walker indicates that definite funding information will not be
' available until late in the fall when the priorities and project
completions on the above listed 135 projects has been sorted out
and final approvals determined.
At the present time there are 4 bonding procedures - the Farmers
Home Administration is accepting.
1. 1941 revenue bond act apparently is the most popular.
2. 1933 sewer revenue bond act would apply to sewage projects
and can be issued by 4/5 vote of the Board of Directors .
3. Assessment bonds are being utilized by Farmers Home when
there is a specified area of benefit.

4. A non profit corporation corporate bonds are currently
being utilized in some projects.
The passage of Proposition 4 has complicated the non profit
corporation issuance of corporate bonds and early indications
are that the bond councils are suggesting that the various
districts go back to the electorate for the passage of 1941
revenue bonds and terminate consideration of the non profit
corporation.
Projects are are currently on the 135 application list that are
anticipating the use of non profit corporation are most likely
in difficulty in providing the voter approval of the proposal.
It would appear therefore, that a substantial number of the 135
applications will be dropped from consideration during fiscal
year 1979 .
Farmers Home Administration will accept a project application
on a 79-1 improvement. Farmers Home Administration will not
accept an application where the water system improvements that
are contained within sewer assessment district No.5. The
S.A.D. 5 contract has been awarded for construction without benefit
of a pre-application, plan and specification review, and authoriza-
tion to call for bids being provided by Farmers Home Administration
�-. and therefore funding in part or in total of the water system
improvements in Sewer Assessment District No. 5 will not be provided
' by the Farmers Home Administration.

PLACER COUNTY SERVICE AREA 19 ANNEXATION
Following our report of March, 1977 , considering the advisability
of annexing certain property within Placer County, a great deal
of Board time has been used in ferreting out the advantages and
disadvantages and the determination of the area to be annexed.
During the period of deliberation, the concensus of opinion that
I have received is that the County Service 19 including all
parcels currently being served by the Truckee Donner Public
Utility District should be annexed to the District at this time.
Enclosed as page 6 of this report is the activities diagram
from the 1977 report. You will recall there was some discussion,
without resolution, between the Local Agency Formation Commissions
of Nevada County and Placer County. Regardless of the county
assuming jurisdiction over the proceedings , a resolution by this
District is necessary to reinitiate the process. Enclosed as
page 7 is the draft resolution contained in the 1977 report as
modified for your March 19, 1979 meeting.
Favorable action on a resolution similar to the one enclosed
will initiate the annexation consideration_ by Nevada County,
L.A.F.C.O. , which may or may not transfer jurisdiction to Placer
County L.A.F.C.O. The favorable action on the resolution
similar to the one enclosed will also initiate the preparation
and tabulation of all supporting documents necessary for L.A.F.C.O.
and the property owner consideration.

WATER USE ORDINANCE
Unfortunately, I feel I need some additional direction in order
to accomplish your desires as it relates to the water use
ordinance that you anticipate.
During your October 8, 1979 Board Meeting, you adopted Resolution
79-38 entitled "Directing the Preparation of a Policy Ordinance
Quantifying the District' s Ability to Serve Water and Refining
and Making Known the Terms by Which Water Service Will be Made
Available" . The subject resolution was , of course, adopted on
the premise that litigation by the Lahontan executive officer
would not be filed. The litigation was filed and a subsequent
ordinance outline regarding water service, was presented for
consideration at your October 29 , 1979 meeting. Also provided
at the October 29th meeting was a preliminary draft outline of
the "Report on Water Service Commitments and the Airport Well
Transmission Line" .
With the exception of Section 4, "Will Serve Policy" the report
outline could easily be interpreted as a 1980 version of your
1976 report. The guidance that I seek at tonights meeting has
to do with the desires of the directors relating to the follow-
ing:
A. Do you wish to expand the 1976 report and bring it current
with Addenda type attachments .
B. Do you wish that I prepare a completely newjreport recognizing
that the 1976 report has never been adopted by the Distric tjfor
use in the proposed ordinance regarding water service.
C . Do you wish individual subservice zones addressed in the
mini report fashion as was the case in the southeast subservice
zone and the report of 1978.
D. Do you wish that the report, in whichever of the forms you have
selected above, be written in a format that would assist the
Farmers Home preapplication as discussed in the Manager's Report
of tonight' s agenda.
I seek your guidance in this matter in that I feel I have more or
less totally lost the ability to anticipate the Board's desire
and directions .

I appologize for my inadequate communication abilities, my
reluctance to rely on oral data provided, my insistence that
you respond to the District's requirement the same as other
developers and my tenacious reiterations that you must comply
with the rules, regulations , standards and policies of the
Truckee Donner Public Utility District and the Truckee Sanitary
District.
i-- I attempted to reach you several times Saturday, December 15,
1979, without success . I am providing you with this update on
our previous conversations and those that I have had with your
design professionals . I believe that the items still missing
from you would contain the following:
1. Provide T.D.P.U.D./Developer Agreement
2. Provide R/W for work off property
3. Provide explanation of conflicts with general note 1
Planning Department condition 1 and the C.C.& R's .
4. Provide T.S .D_ & T.D.P.U.D. within the "roadway easement"
rights .

5. Provide explanation of the ramifications of the Planning
Department site plan approval of a 30 unit apartment complex
with 23 conditions attached and your statement that you
plan to build a 30 unit condo . proj ec t without County Planning
or D.P.W. approval prior to an occupancy permit.
6. Provide copies of the County's acknowledgment of waiving all
or some part of the site plan approval conditions.
7. Provide a letter from the T.V. , gas and telephone companies
that. they do not intend to use a common trench with the
District's and that the positions shown on the improvement
plan is superior- to and shall take precedence over all
utility locations and placements .
8. Provide completion bonds in the amount of $114,407 in favor
of the T.D.P.U.D.
9. Provide an appropriate Encroachment Permit to connect to
the T.D.P.U.D. system.
10. Provide completion bonds in the amount of $36,135 in favor
of the T.S .D.
11. Provide an appropriate encroachment permit to connect to
the T.S.D. system.
12. Provide the appropriate plan check fee to the T.D.P.U.D.

The working documents are missing the following:
A. The general conditions and bidding documents .
B. Plan note about connecting to the existing facilities .
C . Resolution of the power/trash/irrigation conflict
