I do not expect checks to be mailed out until next month. 2. UPDATE ON STORM DAMAGE The most recent storm on the 4th and 5th of January caused two major outages in the Donner Lake and Prosser Lakeview Estates areas; both were restored on January 6th. The Donner Lake outage was caused by a transformer failure on Moraine Drive which opened a line fuse. However, the line fuse did not function properly, and did not show that it was open. It took the crews several hours, from 11 :00 A.M. to 8:30 P.M. , to locate the defective fuse. The Prosser Lakeview Estates outage was caused by a tree top falling into the lines. Power to the area was restored on Friday morning, but, because of a branch lying across the power lines that was not detected on Friday, went out again Saturday morning. 3. ALTERNATIVES FOR AFTER-HOURS CALL-OUT PROCEDURES At our staff meeting on Friday, January 13th, Roberta Huber indicated she had information on service in Kings Beach which utilizes "beepers" and is able to serve the Truckee area. After obtaining this information, we will check into the practicality of this alternative and report to the Board. 4. STATEMENT OF GENERAL FUND: EXPLANATION OF ODD AMOUNTS REPORTED IN STANDBY REVENUES The odd amounts reported in standby revenues are a result of penalties being assessed on property owners by the County in standby revenues received by the County. 5. FINANCIAL REPORT: BREAKDOWN LISTED UNDER "P.U.D. HOUSE" CATEGORY The Bookkeeping Department consulted with Matt Gomez of Arthur Young and Co. He advised that the amount of $24,959 listed under Assets - Real Property - P.U.D. House, Land not in Use - on the Balance Sheet dated October 31 , 1977, represented $21 ,076 in land donated to the District and not presently in use, plus an original cost of the P.U.D. house in the amount of $6,332.50, less depreciation in the approximate amount of $2,449.50. However,after review of the list of parcels which make up the $21 ,076 amount, I note that some of these -1- ia� MANAGER'S REPORT January 16, 1978 Page 2 FINANCIAL REPORT - Continued parcels do, in fact, have P.U.D. facilities on them. I would suggest that the auditors look into this matter for their 1977 year-end audit. 6.,--REPORT RE ADEQUACY OF INSURANCE REQUIREMENTS OUTLINED IN DISTRICT POLICY FOR LEASE OF LAND The proposed Resolution Establishing a District Policy on the Lease of Dis- trict Land contains insurance requirements that are quite stiff. I believe that the $1 ,000,000 bodily injury liability limit and $200,000 property dam- age liability limit are more than adequate. Our umbrella liability policy should cover any District liability in excess of these amounts. Inasmuch as the District will be leasing land only, there is little likelihood that liability claims against the lessee of District property can be extended to the District. 7. UPDATE ON STANDBY ORDINANCE IMPLEMENTATION The standby charge collections have gone fairly well , although I do not have an exact figure of the amount collected; the majority of standby charges have been collected. We have a file of protests, some of which are valid, and which we are investigating. These include protests of standby charges against prop- erty which is not suitable for building and, therefore, could never use the facilities. Presumably, in prior years, when the County was collecting stand- by charges as a part of taxes, they were getting away with collecting on un- buildable property. Other protestors are simply against the concept of stand- by charges. This type of protest, assuming the standby charge is valid, will be turned over to the County for collection on the tax rolls. 8 REPORT REGARDING SIERRA PLANNING ORGANIZATION'S NOTIFICATION AND REQUEST RE NIGHT LIGHTING FOR MULTI -USE BASEBALL FIELDS TWO The Board has received Sierra Planning Organization's request for comment on the Truckee-Donner Recreation and Park District' s proposed night lighting for two baseball fields. The P.U.D. is involved in this proposed project only to the extent that we furnish electricity for lighting. Inasmuch as the fields will be lighted primarily in the summertime after 7:00 P.M. , the extra load created by this project will have no effect on our daily peak loads, and thus will not effect our capacity. The energy used by the Recreation and Park Dis- trict will be paid for by them. The only Recreation and Park District facility that is currently getting free electricity is the tennis court facility; this was done in earlier years by joint agreement between the two districts. Based on the P.U.D. 's interest in load management and most efficient use of our electric plant, I recommend the Board direct me to respond to the Sierra Planning Organization with a favorable comment. 9. REPORT & RECOMMENDATION ON SUPPLEMENTAL FINANCING FOR R.E.A. LOAN Following the special meeting on January 10, 1978, the staff continued to meet with the R.E.A. and R. W. Beck representatives. The net result was that, based -2- ios MANAGER'S REPORT January 16, 1978 Page 3 REPORT & RECOMMENDATION ON SUPPLEMENTAL FINANCING FOR R.E.A. LOAN - Continued on the two-year work plan prepared by R. W. Beck, the total cost providing for the necessary work to be done in the 1977-78 period is approximately $416,000. Of this amount, $300,255 is eligible for partial R.E.A. financing; $58,255 can be derived from existing R.E.A. loan commitments; $169,000 is available on the basis of a new loan. $73,000 would have to come from District revenue bonds; $115,745 could come either from District revenue bonds or from other sources, such as the General Fund. R.E.A. Cost Estimates and Loan Budget for Electric Borrowers has been attached. Additional information required for the loan application includes a brief en- vironmental statement, letter to, and response from, the State Historic Pre- servation Office, Board resolutions accepting the construction work plan, fin- ancial forecast and power requirement study, a letter from S.P.P. Co. agreeing to the increase in capacity for Truckee substation, and a five-year tabulation of service interruptions. If the Board is to go ahead with the R.E.A. loan application, they should im- mediately authorize the employment of bond counsel and financial consultant, and take the necessary preliminary steps to hold a special election to obtain voter approval of revenue bonds in an amount sufficient to finance not only the present loan, but anticipated future loans for the next two to five years. 10. MISCELLANEOUS a) EMPLOYEES' PAY DATE CHANGE Because of a previous resolution of the Board changing pay dates from the last day of the month and the 15th of the month to the 3rd of the month and the l8th of the month, pay for the final two weeks of December 1977 was made in January, 1978. This causes undue complications in the bookkeeping, and affects various quarterly reports; also, it results in a slight increase in employees ' taxes. I recommend resolution re paydate change be amended to provide for the last pay date of a quarter to be on the last working day of that quarter. (77-10) b) WEST RIVER STREET ASSESSMENT DISTRICT FUND The Board is requested to authorize a temporary transfer of General Fund monies to the West River Street Assessment District fund to enable the redemption of interest coupons on the West River Street Assessment District bonds. The short- age in the fund occurs because of delinquencies in the paying of assessments. c) CORRESPONDENCE WITH SIERRA PACIFIC POWER RE PROVIDING NEW SERVICE Sierra Pacific has a request for electrical service to a 20-acre parcel adjacent to Ponderosa Palisades South. They are having difficulty serving this parcel because the best route to the parcel is blocked for lack of an easement. The property from which the easement must be obtained is current- ly in escrow and, therefore, it is not possible to obtain the necessary easement. They have asked us to temporarily serve this 20-acre parcel and receive the revenue from it for a period of perhaps two years, or until they can properly r... -3- iaT MANAGER'S REPORT January 16, 1978 Page 4 CORRESPONDENCE WITH SIERRA PACIFIC POWER RE PROVIDING NEW SERVICE - Continued serve the parcel themselves. They will construct a single span of high voltage line, mount a transformer , (provided by P.U.D.) and run the underground service connections. We will make the high voltage connections to our lines, provide the meters, and pro- vide the distribution transformer. I have agreed to do this, charging S.P.P. only our out-of-pocket costs for making the high voltage connections. The procedures used by Sierra Pacific correctly calculate the differences in revenues due to the acceptance by the Federal Energy Regulatory Commission of the revised tariff sheets in Docket No, ER76-87. The refund is in excess of the $150, 000 which we had originally estimated last July rather than the lower amount quoted by Mr. Branch in the local newspaper. Our estimate of $150, 000 was only for the year 1976 and included interest through February 28, 1977. The actual refund for 1976, including interest through December 15, 1977, was $188, 315. 31. The $38, 000 difference is due to variances in the fuel adjustment and the interest calculations. During the first ten months of 1977, Sierra Pacific used an esti- mated fuel adjustment factor of 12. 84 mills per kilowatt-hour to calculate the District's billings. Sierra Pacific's calculations used the actual fuel ad- justment factors incurred by them during 1977 for calculating the 1977 por- tion of the refund. During the first ten months of 1977, the fuel adjustment factors ranged from 12. 82 mills to 15. 09 mills per kilowatt-hour. This procedure allowed Sierra Pacific to underbill the District so that, in effect, the District actually started receiving a portion of its refund prior to Dec- ember 15, 1977• Mr. Martin McDonough - 2 - January 6, 1978 The District's overall cost of energy during the first ten months of 1977 actually increased by $22, 000 because the actual fuel adjustment factors were higher than those billed to the District, even though the net of the demand and energy charges decreased. The refund of $166, 303. 85 has been calculated correctly and would have been greater if Sierra Pacific had- used the actual fuel adjustment factors rather than undercharging for fuel in the first ten months of 1977. Box 309 Truckee, CA 95734 Dear Milt: Yesterday morning I talked to Mr. Richard M. Frank, a deputy Attorney General who is handling the case of State v. Dart, et al. , the proceeding to enjoin the Donner Lake diversion. He tells me that the State is eager to resolve the controversy, and is going to proceed to draft a proposed agreed judgment for consideration by the parties ; if an agreed decree can be presented to the Court, this will be the best solution, he says. Meanwhile, however, he is confronted by the statute which provides for dismissal of causes not brought to trial within five years, unless he can obtain the consent of the parties. The case was filed July 3, 1973, and the five year period will expire July 3, 1978. Mr. Frank is preparing a stipulation that the case not be required to be brought to trial within the five year period, and he wants Moskovitz and me to sign it. I propose to sign the stipulation on behalf of the District, unless promptly advised against it; I think it is within the meaning of the original agreement on this case. Any of us can bring it to trial under established procedures when desired. Mr. A.
