TRUCKEE-DONNER PUBLIC UTILITY DISTRICT
AUTHORIZING THE EXECUTION OF A
r' QUITCLAIM DEED ON DISPUTED PROPERTY
WHEREAS, Wesley Scott Bentley appeared before the Board of Directors
at the meeting of December 21 , 1976, and provided evidence of a conflict
regarding the title to property located in the Northwest quarter of Section
16, Township 17 North, Range 16 East, Mount Diablo Meridian, according to
the official plat thereof; and
WHEREAS, exhibits were presented to the Board of Directors and an
opinion was made by a local title officer regarding the validity of the
potential claims of both the District and Mr. Bentley; and
WHEREAS, it has been represented to the Board that property tax
payments on subject disputed parcel have been regularly made by Mr. Bentley;
and
WHEREAS, the District was not aware of its ownership interest in
subject strip of land located between the southerly line of the former
state highway and the northerly line of Mr. Bentley's property; and
WHEREAS, it appears that the District is prohibited from develop-
ing subject disputed parcel due to language contained in the "Abandonment
of Superseded State Highways" in Nevada County, Roads III-Nev-37, 38-D, A,"
filed in the office of the County Recorder of Nevada County, California,
under document No. 2375, which reads " . and that such vacation and abandon-
ment will not cut off access to public highways of property which, prior to
said relocation, adjoined said superseded portions" ; and
WHEREAS, the Board of Directors have determined subject disputed
parcel to be of no value to the District due to said restriction; and
WHEREAS, The Boardof Directors considers taking action which will
avoid the necessity of defending a potential quiet title suit; and
WHEREAS, Mr. Bentley has agreed to reimburse the District for all
out-of-pocket expenses incurred in this matter in the sum of $500.00;
NOW, THEREFORE, BE IT RESOLVED by the TRUCKEE-DONNER PUBLIC
UTILITY DISTRICT as follows:
That the Vice-President and Clerk of the Board of Directors cause
to be executed a Quitclaim Deed of standard form surrendering the District's
interest, if any, in subject disputed property to Wesley Scott Bentley and
Elizabeth Ruth Bentley.
Passed and adopted by the TRUCKEE-DONNER PUBLIC UTILITY DISTRICT,
by its Board of Directors at a meeting held within the District on the
27th day of December, 1976, by the following roll call vote:
