An act to add Section 16485 to the Public Utilities Code, relating to
public utility districts, and declaring the urgency thereof, to take
enact immediately.

LEGISLATIVE COUNSEL'S DIGEST
AB 2890, Chappie. Public utility districts: charges.
Authorizes prescribed public utility districts to charge and collect
standby or immediate availability charges on all lands within the
district. Limits the annual amount of such charge to $20 per acre or
$10 for a parcel of less than one acre. Authorizes district boards of
directors to exempt classes of users from the charges and to vary the
amount of charges according to stated factors.
Requires funds from such charges to be applied to electricity sup-
ply facilities.
To take effect immediately, urgency statute.
The people of the State of California do enact as follows:
SECTION 1. Section 16485 is added to the Public Utilities Code,to
read:
16485. (a) A public utility district which acquires, constructs,
owns, operates, controls or uses works for supplying its inhabitants
with electricity,may fix and collect charges in the manner provided
in Article 3 (commencing with Section 16461) and Article 8
(commencing with Section 16641), Chapter 4, Division 7 of the
Public Utilities Code, for an electricity standby or immediate
availability charge on all lands within its boundaries to which
electricity is made available for any purpose by the district,whether
the electricity is actually used or not.
(b) The board of directors of the districts which fixes such a
charge may exempt certain classes of users from such a charge and
may establish schedules varying the charges in different months and
in different localities within a public utility district depending upon
factors such as the uses to which the electricity is put, the cost of
transmitting the electricity to the user, the degree of availability or
-- quantity of use of such electricity. The board may not,however, fix
an annual charge in excess of twenty dollars ($20) per acre or in
excess of ten dollars ($10) for a parcel of less than one acre.
(c) Any funds derived from the charges levied pursuant to this
section may be used by the district for all purposes which a public
utility district is authorized to expend funds insofar as these purposes

relate to the acquisition, construction, operation, control, or use of
works for supplying its inhabitants with electricity.
SEC. 2. This act is an urgency statute necessary for the

immediate preservation of the public peace,health,or safety within
the meaning of Article IV of the Constitution and shall go into
immediate effect. The facts constituting such necessity are:
In order that urgently required funds for capital and operational
expenditures may become available to public utility districts, it is
necessary for this act to take effect immediately.

;4 I discussed the timing for adoption of this and a
similar water standby ordinance with Dan Cook. Mr. Cook
Is performing his end with the County on the parcel size
' print out. Mr. Cook feels that adoption on January 21, 1975
(next regular meeting) will be timely.
I have not prepared a water standby ordinance draft
but will do so immediately after today' s meeting depending
upon -the inital review and discussion by the Board.
The water standby charge is similar, contained in
P. U. Code, Sec. 16475 .
In Sec. 16475 :
a) The charge may not be levied on lands perma-
nently dedicated exclusively to transportation of persons
or property. (This may exclude Southern Pacific and
Greyhound. )
a b) $10. 00 per acre; $5_ 00 for parcel less than
+b an acre.
c) An exemption applies to persons who for more
than one year obtains substantially all his water require-
• ments for contiguous parcels of land which he occupies from

` TRUCKEE-DONNER PUBLIC UTILITY DISTRICT
FIXING A CHARGE OR CHARGES FOR AN ELECTRIC
' STANDBY OR IMMEDIATE AVAILABILITY CHARGE ON
ALL LANDS WITHIN THE DISTRICT BOUNDARIES TO
WHICH ELECTRICITY IS MADE AVAILABLE. FOR ANY
2 PURPOSE WHETHER USED OR NOT, AND PROVIDING
-X MEANS FOR COLLECTION THEREOF

BE IT ENACTED by the Board o f� Directors of TRUCKEE-DONNER

5 PUBLIC UTILITY DISTRICT, as follows :
6 1. General Authority: The electric standby charge or
7 immediate availability charge fixed by this ordianace is hereby
8 enacted and imposed by virtue of Section 16485 of the Public
9 -Utilities Code of the State of California, and the means for
10 collection thereof by virtue of Sections 16461 , et. seq. , and
21 Sections 16641, et. seq. , of said code.
12 2. Application: The standby charge or immediate
13 availability charge shall apply to all lands within the
14 boundaries of the District to which electricity is made avail
15 able for any purpose by the District, whether the electricity is
actually used or not.

! 17 3. Rate: The rate for such standby charge or immediate
Ig availability charge shall be an annual charge of Twenty Dollars
19 C$20. 00) per acre for all parcels consisting of an acre or more,
20 " and Ten Dollars ($10. 00) for all parcels of less than one acre.
21 4. Exemptions: Unless specifically hereafter authorized
22 by the Board of Directors of the District, there shall be no
23' exemptions to the charge or charges fixed and imposed by this
24 ., ordinance. Exemptions, if any, shall be only those authorized
25
by law as set forth in Section 16485 (b) of the Public Utilities -
26 Code, and only if approved by the Board of Directors of the
' 27 District.
5. Payment In Advance: Except as otherwise provided
29 herein, the annual charge or charges hereby imposed are subject
30 to payment in advance.
31 6. Standby Charge Year: The annual charge or charges
32 hereby imposed are fixed on a basis of twelve calendar months,

1 commencing on the lst day of July of each year and ending on the
,P 2 last day of June of each succeeding year thereafter.

3 7. Responsibility for Payment: The owner of the lands
4 within the boundaries of the District shall be responsible for

5 the payment of the charge or charges hereby imposed.
6 S. Parcel Determination: For the purposes of this
7 ordinance, determination of lot or parcel size, location and
g ownership thereof shall be based upon the latest available
9 records of the Assessor's office of the Countv of Nevada, State
10 of California.
11 9. Availability Defined: For the purposes of this
12 ordinance, electricity shall be deemed available and the charge
13 or charges her imposed shall be applicable to all lands ,
14 parcels or lots within the District, as follows : (here is where
' 15 I will need guidance or recommendation from Board and Staff,
16 that is, if the Board determines to make such a definition) .
17 10. Collection and Payment: Pursuant to the aforesaid
18 provisions of the California Public Utilities Code, the charge
19 or charges fixed and imposed by this ordinance shall be added
20 to and become a part of the annual assessment levied by the
21 County of Nevada, State of California, on the lands, parcels
22 or lots to which applicable. Said charge or charges shall be
23 . added to the assessment and are hereby declared to be a lien on
24 the land. Said charge or charges may be divided pursuant to
25 - county assessment practice and payable in two installments. By
26 this ordinance , and pursuant to the authority granted bylaw, the
? 27 District does hereby avail itself of and elects to use the
. 28 assessment and collection procedures of the County of Nevada,
f 29 State of California, and said County, by and through its
assassor, auditor, tax collector, and any or all other offices
30
31 or Persons connected therewith are authorized and directed to
32 4ssess and collect the charge or charges all as enacted herein

1 at the same time and in the same manner as county taxes. when
2 collected, the charge or charges so collected shall, pursuant
3 to law and the practice of the County, be paid over to the
4 District. Enforcement of the collection by the County of Nevada

5 shall be by the same means as is provided by law for enforcement
6 of- liens for county taxes to and including sale of delinquent
7 property, penalties, interest and redemptions, all as provided
g by law.
9 11. General :
10 a) If any provisions of this ordinance or the applica-
11 tion thereof to any person, land, lot or parcel be held invalid
12 or unconstitutional by a court of competent jurisdiction, such
13 decision shall not affect the other provisions of this ordinance.
14 b) Except as otherwise provided herein, the Manager
15 of the` District is charged with the enforcement of the provisions
16 of this ordinance. Nothing herein contained shall be construed
' 17 - to limit the authority of the Board of Directors of the District
18 to amend, supplement or change this ordinance at any time or
19 from time to time. And, the Board of Directors may adopt rules
20 and regulations consistent with the terms ofthis ordinance and
21., pursuant to law, to the end that the terms hereof be efficiently,
22 fairly and uniformly applied, and to the further end that
23 cooperation with the County of Nevada be achieved for the
24 purposes as stated herein.
25 c) All other rules, regulations, resolutions ,
26 ordinances, and charges applicable to the District' s electrical
. . 27 system, works and facilities are hereby ratified and shall
• continue in effect, unless the same be deemed inconsistent
29 herewith.
30 d) The funds derived by the District under this
31 ordinance may be used by the District for all purposes which a
32 public utility district is authorized to expend funds insofar

3 to users within the District.
4 12. Appeals : Any person who shall be dissatisfied with
5 any determination hereafter made hereunder may, at any time
6 within thirty- days after such determination, appeal to the
7 Board of Directors by giving written notice to the General
g Manager setting forth the determination with which such person
,y
9 is dissatisfied. The General Manager shall investigate and
10 transmit to the Board of Directors a report upon the matter
11 appealed. The Board of Directors shall cause written notice to
12 he given at least ten days prior to the time fixed for hearing
13 to all persons affected by such ab_ plication of the time and
14 place fixed by the Board of Directors for hearing such appeal.
15 The Board of Directors may, at any time, upon its own motion,
r~ 16..- revue any determination made by the General Manager.

r 17 Pending decisions upon any appeal relative to the amount
Ig ` of charges made hereunder, the person making such appeal shall

19 pay such charge. After the appeal is heard the Board of
20 Directors shall order refunded to the person making the appeal
21 and paying such charge such amount, if any, as the Board of
22 Directors shall determine should be refunded.
23 . 13. Effective Date : This ordinance shall become effective
24_, thirty (30) days after its enactment and shall be posted and .
25 _, ; published pursuant to law, provided however, the charge or
26 charges ,set forth herein shall not be deemed effective until the
27 lst day of July, 1975_

Dear Mr. Whitford :
Submitted herewith is the test result of the re-test
of the Northside Well conducted Wednesday , December 18 ,
1974 . This test was conducted after Butte Pump Company
of Chico pulled the damaged pump and replaced it with
a new 4 stage , 12 inch Byron Jackson Pump assembly.
This pump replacement was completed the same day we
performed the pump test . The test procedure and results
were witnessed by Dan Cook and Ken Krajewski of the
Truckee Donner Public Utility District as well as
Byron Jackson , the pump supplier . The pump test was
observed at 800 gpm with horsepower draw of 67 hp .
The attached sheets summarize the test method and test
results .
Since the well was pumped for only 1 1/2 hours , it is
probable that with many hours of continuous pumping, such
�- as heavy summer use , the equilibrium water level in the
well might lower below the 140 foot level to a different
j I would not expect the pumping
equilibrium point . However ,
rate to fall below the 700 gpm rate even during heavy summer
use . Also , keep in mind that since the new pump is of
the "open runner" type , that the shaft thrust nut on
top of the 100 hp motor could be backed off thereby setting
a closer impeller - runner tolerance resulting in some
additional pump capacity.

Summary & Conclusions
Initial pumping rate was observed at 900 gpm (the total system
head not fully developed since water level in well not pulled
down to equilibrium point) .
Final pumping rate observed at 800 to 840 gpm after 1 1/2 hours
of pumping (water level in well established at 140' from
ground surface - static level in well at 105 ' from ground
surface) . Horsepower and efficiency readings checked with the
pump curve ; the existing 100 hp drive has + 30 hp in reserve .
The Hersey meter visual register sweep needle and accumulator
recorder agreed very accurately with the steel tape and
gauge board readings made from the Northside Well Tank.
Test Procedure Followed
Data : 1) Static water level in well 105 '
2) Gauge pressure reading while pumping to Donner Trails
Tank and Gateway System
gauge #1 = 41 psi (gauge location ahead of 8" Cla-Val check)
gauge #2 = 38 psi (gauge location behind of 8" Cla-Val check)
3) Northside Well Tank = 17 ,475 gallons per foot of rise.
Test No . 1
Test Method : Pumping into the Gateway - Donner Trails System for
recording of the discharge pressure reading at the
Northside Well pump . Unable to continue extensive
pumping into this system since all tanks full.
Observations : Pumping rate observed at 900 gpm and slowly dropping as
the water surface in the well lowered to an equilibrium
point which finally established itself at the 140 foot
level .

Test Method : First ; valved off the Gateway - Donner Trails
system and diverted all the flow into the adjacent
Northside Tank. Next ; pumped into the tank at
1100 gpm to draw down the well water level.
Then; throttled the discharge butterfly valve
to impose the system pressure head of 41 psi on
the discharge side of the pump ; recorded by direct
steel tape soundings into the Northside tank, gauge
board readings and Hersey meter readings during the
next 75 minutes .
Observations : Pumping rate recorded at 800 to 840 gpm (against system
TDH) . Water level in well stable at 140 feet below
ground surface. Horsepower demand on motor checked
with expected demand (67 hp) .

This letter is pursuant to our recent telephone
conversations relevant to the circumstances which will
apply with the proposed recording of Prosser Lake
Heights Unit No. 5.
To summarize the current situation, the final map of
the subject subdivision must be recorded by December
27 , 1975, without possibility of another extension.
Current information indicates that the new Truckee
Tahoe Sanitation Agency regional plant will not be
available to serve the property at that time. In fact,
it is indefinite just when that plan will be available
Consequently. your clients have indicated that they
propose to record the final maps and post improvement .
bonds which will cover all improvement costs including
water, roads, sewer, etc. , but will include a statement
in the public report on the subdivision that there may be
no construction within the subdivision by the subsequent
lot owners until such time as the sewer is connected to
the new regional plant.
The fact that the subdivision would not be eligible for
lot development by new owners for an indefinite period of
time was a source of concern to the Planning Department
and Department of Public Works. However, after lengthy
discussions among ourselves and with the State Department
of Real Estate, we have. come to the conclusion that we
will not object to recordation of the final map with
conditions stipulated to by your client and outlined above,
with the understanding that the county will not accept any of
the improvements within the subdivision until such time as

Dear Mr. Craig:
It has seemed to me for some time now that
Truckee Donner may need a source of funds other than its
earnings for expansion of its power system. I expect that
Mr. Hobensack may have had some experience in this field,
and I merely state the problem here for your further
consideration.
The District established its credit with the
U. S. Rural Electrification Administration in the 1960' s
and borrowed substantial sums of money -for plant additions
at an interest rate of two per cent. Under our statute
we cannot borrow money for power purposes without a vote
of the people on a, general obliqation bond issue, unless
it is from an agency of the federal government. In 1963
the District sponsored a legislative proposal that added
the last sentence to Section 16578 of the Public Utility
District Act which meant in effect that the District
could issue unvoted bond to REA-
After Mr. Longo left, Mr. Cattan believed that
the District had sufficient funds for expansion of its
power system from its earnings_ An application for a
third loan to REA was prepared, but never carried through
for this reason.
Subsequently there has been a further
development: The Congress has changed REA into a
supplemental lender so that as a practical matter now
all loans for rural electrification are made in part by
a co-op bank, established by the co-operatives and
approved by REA, and in part by REA. As a result of this
mix of private financing, the interest cost has risen

from -two per cent to between seven and eight per cent.
However, these interest rates are not nearly so objectionable
as they once would have been thought to be, and many co-ops
have found the arrangement to be a lifesaver.
�--- Our District cannot borrow money from the co-op
bank under its present legislation and would need a
legislative amendment to Section 16578 in order to do so.
I wanted to call your attention to the availability of
these monies and to the legal problem involved at an early
stage so that if funds for expansion of the electric
system are required, advance provision can be made.

Policy for the Administration of Water Rights
in the Lake Tahoe and Truckee River Basins
1. Issuance of new permits in the Lake Tahoe Basin shall
be limited so that their aggregate face value in combination with
existing permits and licenses and use under other rights, in—
eluding ground water will not exceed a figure computed as follows:
Subtract from 23, 000 the actual use charged. to California, and
divide the remainder by the percentage of the face value of the permits
in the Lake Tahoe Basin for which licenses have been issued. The
figure obtained from this operation is then. added to actual use
to obtain the limit. When applications are subject to rejection
because of this limitation, an applicant may, subject to the pay—
ment of an annual application fee as required by Water Code
Section 1535, maintain the application and priority until such
time in the future as water may become available as a result of
the reduction of the allocated amount under other permits and
licenses. All permits hereafter issued shall provide in substance
that if the California—Nevada Interstate Compact becomes effective
i and California' s allocation is fully used before use is complete
under this permit, a license shall be issued only for the amount
of water, if any, which in combination with the total use under
prior rights shall not exceed California's allocation. '

2. The initial time allowed to complete construction
work and full beneficial use of water shall not exceed eight years.
3. After adoption of this policy, initial extensions
of time to complete construction work and beneficial use of water
shall not exceed three years from the date the extension is granted.
Any additional extensions shall not exceed three years from the
expiration of the previous extension.
4. The quantity of water allowed in new permits and in
all existing permits as they come before the Board upon petition
for extension of time shall be limited as follows:
a. Allowance of water for domestic purposes shall be
limited to 540 gallons per day per dwelling during the month of
maximum use, or equivalent as provided for in the Board' s report,
unless otherwise satisfactorily demonstrated.
b. In any event, the annual acre—foot limitation of
each permit shall not exceed seven and five times, respectively,
the maximum monthly requirement for municipal (including domestic)
!' and irrigation uses.
Land use densities in the place of use as authorized
by local ordinance or as they may be modified by the final order
of the Tahoe Regional Planning Agency shall be used in determin—
ing the extent of water requirement.
5. Use of water under license will be reviewed period—
ically, with a view to a reduction of the licensed amount if it
appears that the use of water has substantially declined since
the date of issuance of license.

6. The Board will maintain close liaison with Tahoe
Regional Planning Agency and Placer and El Dorado Counties so as
to be advised of all land zoning changes affecting the place of
use of the permittees and licensees within the Basin.
7. The Board will periodically update its estimate of
depletion of the Tahoe allocation under the proposed interstate
compact.
8. The Board will make a study and prepare an estimate
of the diversions in the Truckee Basin which should be charged
against California. This estimate will be periodically updated.
9. The Board will notify each applicant at such time
as action can be taken on his application, and take such further
action as may be appropriate.
10. The Board will process petitions for change in the
project or for extension of time regularly, i.e. , without delay
unless tied in with an application.

I have a cabin at the end of Lockwood Drive in Prosser
Lake Heights just outside of Truckee , off U. S. 89.
In the middle of the night on November 28, 1974, the
main water went off and so there was no water coming
into the house . As a result of this, the main line
down tt,e street went dry and sucked the water out of
my hot water heater, without my knowledge . I have an
electric hot water heater and, of course , without water
in the heater, both elements burned out.
I not only had to pay $31.16 for two new elements
(see receipt) , but I' ll also have to install a $7.00
"check valve" to prevent this from happening again,
since the reliability of the water system cannot be
trusted .
Although I have done the work, there is no labor charge ,
but I do consider it your resl:onsibility to reimburse me
for my expenses.
Please credit my account in the amount of $37.57.
If you don' t agree with this arrangement, please let me
know so that I can file a formal complaint with the P.U .C.
in San Francisco and let -them decide who should pay.

STATEMENT FROM KEN KRAJEWSKI REGARDING ALLEGED DAMAGE TO GUZMAN PROPERTY
I have been requested to relay all possible history and records
that I may have which surrounds the Donner T-ndls tank: site in regards
to the Guzman case for water flowing through their yard. History as
far as I can tell is the redwood tank was erected for the Donner Trails
subdivision. The redwood tank has one ten-inch pipe into it ; no over-
flow and no drain line. The one pipe into the tank is a combination
inlet and outlet .
Over the years , woodpeckers have put holes in the tank just above
the existing water line. The District has taken several steps over the
years to patch these holes so that we can utilize the entire height of
the tank.
This tank is filled by the Donner Creek well . In order to provide
efficient service to the District consumers , the District installed
telemetry from the Donner Creek well to the Donner Trails tank. This
monitors the height of the water in the tank so that the tank will
not overflow and yet when the tank gets to a. certain level , the pump
will come on and fill the tank up to the predetermined height . This
telemetry level is located below the height of the lowest woodpecker
hole . We have tried stains and other chemicals on the tank to keep the
woodpeckers away. However, this has not been a deterrent.
Sometime in 1971 as a part of the Tahoe Donner development , it was
agreed upon between, at that time , Lakeworld and the District to erect
a steel tank next to the Donner Trails wooden tank. The steel tank would
be parallel with the wood tank with a valuing operation between the tank
so that in the future when water was to come from Donner Lake , there
would be a way to valve off this water so that it would not come into
the Truckee area. The steel tank would be used along with the new
pumphouse to provide water to Tahoe Donner ; and then at the same time ,
the wooden tank would still be used to supply the consumers in the
r=Donner Trails area. By having these tanks next to each other , we would
be able to serve in either direction yet still have separate operations
whenever necessary.
On the steel tank , there is a drain line. The drain line goes to
an existing. natural drainage ditch which runs under Northwoods Boule-
vard and down the hill towards Edmunds Drive . This drainage ditch
passes on the west side of the Guzman residence . However , does not
'o through or touch any of their property.
Under the supplemental water agreement , the Northside well was
drilled on District property near the Forest Service area. The ide-1 of
this well was to pump to the Donner Trails tank and then up to Tahoe Donner
to supply them until it was determined whether Donner Lake water would
ever he used or if additional wells would have to be used . It is in
conjunction with this that the incidence hanpened on the night of
October IS , 1974 .
Under the agreement , Tahoe Donner was to receive the water at
Donner Trails tank and pump it to their subdivision. It was our
responsibility to put this ,water into the tank. We wanted this respon-
sibility so that we would operate Northside well for our convenience
also . The procedure was for Tahoe Donner to let us know when they
needed water and then we would turn Northside well into our system
to Donner Trails .
On this evening , however, the man who was supposed to turn the
., well off completely forgot , and the water going into the Donner Trails
tanks was filling both tanks . However, due to the fact that there is
no overflow on Donner Trails wooden tank and the overflow on the steel
tank is higher , the water from Northside well was going out the wood-
pecker holes and out the top of the wooden tank and down the side of
the hill and into the Guzman residence .

8.6 A leave for a period of six (6) months or less shall be granted all regular
employees for urgent or substantial personal reasons. The leave may be extended for
an additional six (61 months provided an extension is requested and approved by the
Company.

cation lower thereto which the employee is willing to accept. If no such
vacancy exists on the day the employee applies for reinstatement, the
employee's leave of absence will be continued until such time a vacancy
a— occurs in the employee's former classification or in a classification lower
which the employee is willing to accept, vrovided that the employee has
complied with the conditions of Section 8.6(a) 1 or 2 and further that the
`total leave shall not exceed six (6) months or twelve ( 12) months when an
extension is approved.
In the event the employee is returned to work in a classification lower than
the employee's former classification, the employee will be given preferential
consideration over other employees in the filling of vacancies in higher
classifications until such time as the employee is returned to the employee's
