Cook RESOLUTION NO. 75 !8 OF TRUCKEE-DONNER PUBLIC UTILITY DISTRICT APPROVING THE PROJECT COMMONLY KNOWN AS "TTSA ELECTRIC DISTRIBUTION LINE" , AND FINDING THAT THE PROJECT IS A MINISTERIAL PROJECT FOR WHICH NO ENVIRONMENTAL IMPACT REPORT IS REQUIRED WHEREAS, TRUCKEE-DONNER PUBLIC UTILITY DISTRICT is a public agency which, among other things, provides and serves electrical energy to customers and users within its district boundaries located in Nevada County, State of California; and WHEREAS, TAHOE TRUCKEE SANITATION AGENCY, a public agency and potential customer of the District, proposes to construct and operate a regional sewer treatment plant on land owned by said Agency and located within the District boundaries and service area; and WHEREAS , said Agency has heretofore been given approval by other appropriate governmental agencies for its proposed work of construction and sewer treatment plant project; and WHEREAS , said Agency has requested electrical service from the District and has further requested that the District construct therefor an electrical distribution line as part of said overall sewer treatment plant project; and WHEREAS, to meet said requests for electric service and to construct said distribution line the District is required to comply with the California Environmental Quality Control Act of 1970 , as amended, and the Local Guidelines j of the District heretofore approved by the District implement- ing said Act; and WHEREAS , said Local Guidelines permit the approval of construction projects when the same are ministerial in nature without the necessity of an environmental impact report; NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of TRUCKEE-DONNER PUBLIC UTILITY DISTRICT, as follows : 1. The District approves the project known as "TTSA Electric Distribution Line" and authorizes its construction. 2. The District finds that said construction project is a ministerial project, as the same is defined in Article II, Section 4 , of said Local Guidelines of the District, because this particular project, which is but one segment of the overall sewer treatment plant project, is one which requires approval by the District as a matter of law, and the project involves minimal independent exercise of judgment by the District, and the project and development which has already been approved by other appropriate governmental agencies. i pacje 1. y i 3. By reason of the above, the District further finds that said Act and Local Guidelines do not apply to this project and thus is outside of the scope of the requirements for environmental impact reports and assessments. The Proposals will be opened and publicly read aloud. Proposals received after the time announced for opening will not be consi- dered. Proposals shall be addressed to the Truckee-Donner Public Utility District Donner Pass Road, Truckee, California,, The Contract Documents may be examined at the office of the District. The Contract Documents may be obtained at the office of the District or by writing Post Office Box 309, Truckee, California 95734 upon deposit of Fifteen ($15.00). for each set requested. Deposit checks shall be made payable to the Truckee-Donner Public Utility District. Deposits will be refunded upon return of the Contract Documents in au unmarked and usable condition. Each Proposal shall be accompanied by a certified or cashier's check payable to the order of the Truckee-Donner Public Utility District for a sum not less than five percent (5%) of the total bid amount; in lieu of a check, a bid bond may be submitted in an amount not less than five percent (5%) of the total amount bid, with a corporate surety licensed to do business in the State of Cali- fornia, conditioned that the bidder will pay the Truckee-Donner Public Utility District, as liquidated damages, the amount specified in the bond unless he enters Into a Contract in accordance with hip Proposal. If the bidder fails to enter into the Contract and furnish the required Performance and Contractor's Bond and Insurance certificates within ten (10) days from the date on which he is notified .- that his Proposal has been accepted, the amount of his check or bid bond shall be forfeited to the Truckee-Donner Public Utility District. The Truckee-Donner Public Utility District specifically reserves the right to reject any or all Proposals, to waive irregularities or informal- !ties in any or all Proposals, and to accept any Proposal which the Truckee- Donner Public Utility District deems to be in its best interest. Each Proposal shall be submitted only on the Proposal forms issued by the Engineer.
