TRUCKEE-DONNER PUBLIC UTILITY DISTRICT
AMENDING RESOLUTION NO. 6912
WATER RATES
Defining and classifying types and users of water service , system and
facilities thereof; establishing water rates and charges applicable
thereto ; providing for the establishment and enforcement of rules and
regulations regarding said water system, service and facilities ; pro-
viding means for the collections of water rates and charges and enforce-
ment measures in case of non-payment of certain violations , providing
for appeals .
BE IT ENACTED BY THE BOARD OF DIRECTORS OF THE TRUCKEE-DONNER PUBLIC
UTILITY DISTRICT AS FOLLOWS:
SECTION 1. DEFINITIONS: For the purposes of this Resolution, the terms
and words below are herewith defined as follows :
1. 1 THE DISTRICT: The Truckee-Donner Public Utility District
and/or its duly authorized officers or employees acting within
the scope of their respective duties .
1 . 2 UTILITY: Water service, system, facilities and appurtenances
of Truckee-Donner Public Utility District.
1. 3 CUSTOMER: The person, firm, association, corporation, or
governmental agency in whose name service is rendered as evidenced
by the signature on the application or contract for that service ,
or in the absence of a signed document , by the receipt and payment
of bills regularly issued in his name regardless of the identity
of the actual user of the service .
1. 4 PREMISES: All of the real property and apparatus employed
in a single integrated business activity operating under one name
in one or more buildings and/or locations providing (a) such
buildings and/or locations are located on a single unit of
property, or (b) such buildings and/or locations are situated
on two or more units of property which are immediately adjoining
adjacent, or contiguous , or (c) such buildings and/or locations
are situated on two or more units of property which would be
immediately adjoining, adjacent or contiguous except for inter-
vening public highways , streets , alleys , railways , or waterways .
1 . 5 TARIFF SCHEDULES: The entire body of effective rates ,
rentals , charges , penalties , and regulations set forth or pro-
vided for herein.
1 . 6 PUBLIC USE: Provision of water service to a municipality
or other public body.
1 . 7 APPLICANT: The person, firm , associations , corporation, or
governmental agency applying for water service .
1 . 8 APPLICATION: The written request from an applicant for water
service as distinguished from an inquiry as to availability or
charges for such service .
1 .9 AVERAGE MONTH: Thirty (30) consecutive days .
1 . 10 BILLING PERIOD: An average month, except for special services .
1. 11 CONNECTION FEE : The charge made by the District to establish
a new service , and includes , but is not limited to, the cost of
preparing all forms and cards necessary for each new account and
reading of meters .

1. 12 CONSUMER: The person, firm, association, corporation, or
governmental agency using water service .
1 . 13 CUBIC FOOT: The volume of water which occupies one cubic
foot, equal to 7,481 gallons .
1 . 14 DATE OF PRESENTATION: The date upon which a bill or notice
is mailed or postmarked or delivered to the customer by the District.
1. 15 FACILITIES FEE: The charge made by the District for but not
r-- limited to a pro rata share of the cost of the basic supply facil-
ities , and any expansions thereof or additions thereto, necessary
to serve a customer or customers .
1. 16 GALLON: The volume of water which occupies two hundred and
thirty-one (231) cubic inches .
1. 17 HOUSE PIPING: All piping and fittings installed within the
house or building up to and including the last fitting inside or
outside the wall .
1. 18 MAIN EXTENSION: An extension of water distribution mains
and necessary facilities beyond existing service facilities .
1. 19 MAINS: Water distribution pipes located in streets , high-
ways , public ways or private rights of way and easements .
1. 20 PERSON: Any individual , partnership, corporation, govern-
mental agency, or other organization operating as a single business
entity.
1. 21 SERVICE CONNECTION: The point of connection of the customer' s
piping with the District' s facilities .
1 . 22 SERVICE PIPE: The connection between the District ' s main
�-' and the service connection, including all of the pipe , fittings ,

and valves necessary to make the connections .
1 . 23 YARD LINE: All piping between the house or building
piping and the service connection.
SECTION 2 . TYPES AND CLASSES OF SERVICE: For the purpose of this
Resolution, there is hereby established the following types and classes
of service:
A. TYPES OF SERVICE:
2 .A-1 FLAT RATE SERVICE: Provision of water service in unmeas-
ured quantites charged for on a fixed periodic charge .
2 .A- 2 METERED SERVICE: Provision of water service in measured
quantites charged for on metered rates .
2 .A-3 TEMPORARY SERVICE: Service for construction work and
similiar uses , which, because of the nature thereof, will not be
used steadily or permanently.
2.A-4 SEASONAL SERVICE: Service to premises , enterprises , or
activities which are seasonal in character and where it is known
in advance that the service will be for a special period of time .
2 .A-5 PERMANENT SERVICE: Service which, in the opinion of the
District, is of a permanent and established character. The use
of water may be continuous , intermittent , or seasonal in nature .
B. CLASSES OF SERVICES:
2 .B-1 DOMESTIC SERVICE: Provision of water for household and
residential purposes , including water for sprinkling lawns ,
gardents and shrubbery, watering livestock, washing vehicles ,
and other similar and customery purposes .

2 .B-2 COMMERCIAL SERVICE : Provision of water to premises where
the customer is engaged in a profession, trade or business , or is
engaged in the buying, selling, or providing of goods or services .
2 . B-3 INDUSTRIAL SERVICE : Service to customers engaged in a
process which creates or changes raw or unfinished materials into
another form or product. (Factories , mills , machine shops , mines ,
oil wells , refineries , pumping plants , creameries , canning and
packing plants , shipyards , etc . , i .e . , extractive , fabricating,
or processing activities . )
2 . B-4 FIRE PROTECTION SERVICE : Provision of water for fire
protection:
a. Private Service : Service to customers supplied for fire
protection of specific private facilities.
b. Public Service : Service to customers supplied for fire
protection of the general public .
2 . B- 5 UNCLASSIFIED: Any water service provided to customers or
premises, having unusual characteristics or requirements and not
within the classification set forth above .
2 . B-6 IRRIGATION SERVICE : Service to customers for agricultural
floracultural, or horticulture use .
SECTION 3. WATER SERVICE AREA: The area in which water service is or
may be furnished y the Truckee-Donner Public Utility District are
described as follows :
3. 1 SERVICE AREA NO. 1 : Comprising the South 1/2 of Section 10
and 11 , and North 1/2 of Section 14, all of Section 15 , all
Township 17 North, Range 16 East, M.D.B. $ M. (TRUCKEE)
3. 2 SERVICE AREA NO. 2 : Comprising the South 1/2 of Section 8
and 9, all of Section 16, and Section 17 , all Township 17 North,
Range 16 East, M.D.B. & M. (GATEWAY AND MEADOW LAKE)
3. 3 SERVICE AREA NO. 3 : Comprising the South 1/2 Section 7 , all
of Section 18 , in Township 17, North, Range 16 East, and the South
1/2 0£ Sectiors 11 and 12 , and all of Section 13 and 14, all Township
17 North, Range 15 East, M-D.B. & M. (DONNER LAKE)
3 . 4 SERVICE AREA NO. 4 : Comprising all other parts, parcels
portions , or sections lying within the exterior boundaries of
Truckee-Donner Public Utility District .
3. 5 SERVICE AREA NO. 5 : All land outside the exterior boundaries
of Truckee-Donner Public Utility District .
The Truckee-Donner Public Utility District specifically reserves
the right, in the discretion of its Board of Directors , to apply special
or restricted service, rates , charges , or regulations within any of the
service areas described which may differ from the service , rates , charges ,
or regulations applicable in another area.
SECTION 4. WATER SERVICE RATES, CHARGES, AND FEES : In order to provide
revenues for the purposes of undertaking, conducting any of the business
and affairs of the District as allowed by law, there is hereby established
and levied, and they shall be collected, according to the following rates
and classifications , the following amounts :
A. SCHEDULE GS-1 - GENERAL WATER SERVICE
4.A-1 AVAILABILITY: Water service hereunder is available to
customers located throughout the District ' s Service Areas No . 1
thru No . 4 inclusive.
4 .A-2 APPLICABILITY: Water service hereunder is applicable to
any customer for any purpose.

4 .A-3 WATER RATES : The monthly charge for water service to a
single family residential unit and trailer park resident hereunder
shall be :
LOT FOOTAGE : 0 - 8, 999 $ 5 . 00 monthly
9, 000 - 13, 999 $ 6 . 00 monthly
14, 000 - 19, 999 $ 7. 00 monthly
20 , 000 - and over $ 8 . 00 monthly
If after two written warnings within any three-month period an
unmetered occupant is using excessive water, a meter will be installed
�! and his minimum will be increased 50 percent . Usage over 4,000 gallons
will be billed at the rate of $1 . 00 per 1 , 000 gallons . The District
will determine the excessive use .
The $5 . 00 minimum will be applicable to residential occupants of
apartments , condominiums , duplexes, and individual cottages on one lot .
All commercial units shall be metered and will include but not be
limited to swimming pools, landscaping, laundry rooms , and recreation
rooms .
The following rates will be applicable for commercial , metered
units .

4.A-4 OTHER CONDITIONS: Customers requiring water service in
excess of 100 , 000 gallons per month shall be required to contract
with District for a minimum tern of not less than three years .
4.A-5 CHURCHES : The monthly charge for water service to churches ,
not including parsonages , shall be at the rate of $3. 00 per month
for the first 6 , 000 gallons or less consumed per month, instead of
$6 . 00 as shown in the above schedule , and the minimum monthly charge
for a 3/4 inch meter for such churches shall be $3 . 00 instead of
$6. 00 .
B. SCHEDULE FR-1 - FLAT RATE SERVICE
4.B-1 AVAILABILITY: Water service hereunder is available to
customers located throughout the District Service Areas No. 1
thru No. 4 inclusive, only when first approved and authorized by
the District.
4. B-2 RATES AND CHARGES: Shall be established in each case by the
District, depending on quantity to be used, type of service desired,
classification of service, special connections necessary, if any,
and any other conditions or circumstances which the District deems
applicable.
C. SCHEDULE C-1 - CONNECTION FEES
4.C-1 APPLICABILITY: Charges hereunder are applicable to all
applicants for water service throughout the District ' s Service
Areas No. 1 thru No. 4, inclusive , at locations not previously
served by the District.
4. C-2 SCHEDULE OF FEES: In addition to monthly service charges ,
the initial charge for water service to applicants for water ser-
vice to applicants shall consist of a connection fee for each water
service line where applicable , as follows :

4.C-3 PAYMENT: The applicable connection fee shall be due and
payable by the applicant to the District upon making application
for connection to the District facilities .
r--. D. SCHEDULE H-1 - FIRE HYDRANT SERVICE
4.D-1 AVAILABILITY - Water service hereunder is available to
customers throughout the District's Service Areas No . 1 thru
No. 4 inclusive.
4 .D-2 APPLICABILITY - Charges hereunder are applicable to public
and private fire hydrants .
4.D-3 RATES AND CHARGES - The yearly water standby service charge
hereunder shall be $1. 50 per hydrant.
E. SCHEDULE FP-1 - FIRE PROTECTION SERVICE
4.E-1 AVAILABILITY - Water service hereunder is available to
customers throughout the District' s Service Areas No . l thru 4
inclusive .
4.E- 2 APPLICABILITY - Water service hereunder is applicable to
fire protection system in specific facilities or locations .
4.E-3 RATES AND CHARGES - The monthly charge for water stand-by
service hereunder shall be :

4 .E-4 TERMS AND CONDITIONS - Service hereunder is for fire
protection systems to which cross-connections for other than fire
protection purposes are not made and which are installed and main-
tained by customers to the satisfaction of the District.
The District will supply only such water and at pressures here-
under as may be available from time to time as a result of the normal
operation of the District' s water system.
SECTION S . BILLING FOR AND PAYMENT OF WATER RATES AND CHARGES:
5 . 1 METERED SERVICE: Meters will be read at regular intervals
and as near to a calendar month basis as reasonably practicable
for the purpose of preparing regular bills , opening bills , closing
bills , or special bills . Should a monthly billing period contain
less than 27 or more than 33 days , a pro rata correction may be
made on the monthly minimum charge .

5. 2 FLAT RATE SERVICE: Bills for flat rate are payable in
advance . Opening bills for flat rate service shall not be less
than the estimated monthly charge for the service . Any amount
paid in excess of the prorated period rate will be credited
against the charge for the succeeding month.
5 . 3 PAYMENT: Bills for water service are due and payable upon
presentation and payment may be made at the office of the District,
Truckee , California, or to an authorized collector . Bills are due
and payable by the loth of the month and become delinquent thereafter.

5 . 4 RESPONSIBILITY FOR PAYMENT : All bills for water service
and other charges shall be billed to the person requesting and
making application for service ; provided, however, that in the
event of delinquency such rates or charges shall be billed to
the owner of the premises afforded such service , whether or not
such owner requested or made application for service.
5. 5 DISPUTED BILLS: In the event of a dispute between a customer
and the District as to the correct amount of a bill rendered by
the District for service furnished a customer, the customer shall
deposit the amount billed with the Clerk of the District , and
r-, shall then proceed in accordance with Section 8 of this Resolution.
Failure to deposit said amount within 20 days from the date of said
bill shall warrant the district regarding it as a delinquent
account.
5. 6 MINIMUM: After applying for service , the customer will be
billed for actual use when it is feasible to read the meter. When
the meter is not read, the customer will be billed the minimum
charge. The customer will be required to pay a continuous
monthly charge unless he requests to discontinue his service .
There will be a charge made when the customer is reconnected.
SECTION 6. ENFORCEMENT OF COLLECTIONS, RULES, AND REGULATIONS :
The General Manager of said District hereby charged with the
enforcement of the provisions of this Resolution and all Rules and
Regulations made pursuant hereto. The Board of Directors shall make
and provide for the enforcement of such Rules and Regulations for
the safe, economic, and efficient operation, management and protection
of the District Water system, service and facilities , and such Rules
and Regulations as may be necessary for the regulation of water
services, the application for service, the establishment and collec-
tion of connection charges for various types of service, including
special contracts where necessary, the collecting, rebating or
refunding of charges , establishment of credit and reconnection charges .
a. In the event of a violation of any laws of the State of
California, the resolution of the District, or the rules and regula-
tions established pursuant thereto , the General Manager shall notify
the person or persons causing, allowing or committing such violation,
in writing, specifying the violation, and upon the failure of such
person to cease or prevent further violation within 15 days after the
date of such notice, the General Manager may exercise his authority
to disconnect said premises from water service ; provided, however ,
that in the event such violation results in a public hazard or menance ,
then the General Manager may enter upon the premises and do such
things and expend such sums as may be necessary to abate such hazard
or menace, and the reasonable value of the things done and expense
incurred or amount so expended thereon shall be a charge upon the
person and premises so in violation.
If a customer receives water service at more than one location
and the bill or charges for service at any one location is not paid
prior to delinquency, water service at all locations may be disconnected.
b . Upon the failure of any person or the owner of the premises ,
to pay any water service bill or charges applicable thereto , in
addition to the foregoing, any one or more of the following actions
may be taken:
1 . Each water service bill and/or charges levied by or pur-
suant to this Resolution and the Rules and Regulations thereunder,
or any premises within the District , is hereby made a lien upon
such premises , and any measures authorized by law may be taken
by the District to enforce payment of such lien.
2. Whenever a premise has been disconnected from the water
system for non-payment of water bills or charges , such premise
shall not be reconnected to said water system until all delin-
quent charges and penalties , if any, have been paid, together

with such additional charges or deposits for disconnection,
reconnection or establishment of credit as may be ordered from
time to time by the Board of Directors by rules and regulations
or other act.
SECTION 7. APPLICATION FOR SERVICE - PERMIT TO CONNECT :
No person shall connect, or cause to be connected any premise
with the District water system without having first made application
therefore to the District , and having obtained permission of the
r-- District to do in accordance with Rules and Regulations .
7. 1 Each applicant for service requesting an extension of
water distribution facilities and/or alterations to provide
additional capacity in existing facilities in order to obtain
water service shall be required to furnish, at his expense,
such extension and/or alteration.
7. 2 The District , at its option, however, may require such
applicant to install distribttion facilities with more capacity
or of greater length than would be required for the service
requested, and may select a route other than the most direct
and shortest available. In such event, the District shall
reimburse such applicant for costs incurred in excess of the
costs of a normal water system designed with facilities of
such size and along such a route that would be adequate to
provide the requested service .
7 . 3 All water distribution facilities installed hereunder
shall be and remain the property of the District .
7. 4 Size and location of facilities installed shall be spec-
ified by the District. Type and quality of material shall be
that specified in General Requirements , water specifications ,
as adopted from time to time by the District .
RESALE OF WATER
Customers shall not resell any of the water received from the
District nor deliver it to premises other than those specified in
such customer' s application for service except by written agreement
of the District.
SECTION 8. APPEALS:
Any person who shall be dissatisfied with any determination
hereafter made under or pursuant to this Resolution, or any amend-
ment thereof, or rules and regulations made pursuant thereto , may at
any time within thirty (30) days after such determination (disputed
bills provisions excepted) appeal to the Board of Directors of said
District by giving written notice to the General Manager and to the
Clerk by the Board of Directors , setting forth the determination with
which such person is dissatisfied. The General Manager shall then in-
vestigate and transmit to the Board of Directors within fifteen (15)
days from the date of said written notice a report upon the matter so
appealed. The Board of Directors after receipt of said report of the
General Manager shall, not less than thirty (30) days thereafter, have
a hearing in reference to said protest or matter appealed, and notice
of the date, place and time of said hearing shall be given to all
persons affected thereby not later than ten (10) days prior to said
hearing. The Board of Directors may at any time, upon its own motion,
reverse any determination made by the General Manager.
Pending decisions upon any appeal relative to the amount of
charges made hereunder, the person making such appeal , shall pay of
such charge under protest as more particularly provided in the rules
and regulations of the District. After appeal and hearing thereon
is had, the determination of the Board of Directors as a result thereof,
shall be final and conclusive, and in the event that a determination
be made, that any charge or amount previously paid under protest be
refunded; such refund shall be made forthwith.

SECTION 9. INVALID PROVISIONS
I£ any of the provisions of this Resolution, or the application
thereof to any person or circumstance is held invalid, such decision
shall not thereby affect the other provisions of the Resolution.
Nothing herein shall be construed to limit the authority of the
Board of Directors to amend, supplement or change this Resolution, or
any supplements thereof, or to change, modify or alter any rules ,
regulations or other determinations made pursuant thereto.
SECTION 10. EFFECTIVE DATE
Tins Resolution shall become effective upon adoption and super-
sede all other water rates .
Passed and adopted by the Board of Directors of the Truckee-Donner
Public Utility District at a regular meeting thereof duly called and
held in the District on the 17th day of July , 1973, by the
following roll call vote :

DONNER LAKE INTAKE & ENVIRONMENTAL IMPACT REPORT
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of
the Truckee-Donner Public Utility District:
WHEREAS, Dart Resorts has informed the District that it is
willing to retain and pay for the services of an environmental con-
sulting firm to prepare a draft environmental impact report on behalf
of both Dart Resort and the District as to all necessary applications
and petitions in connection with their activities at or near Donner
Lake, and Dart Resort has stated that it proposes to retain the en-
vironmental consulting firm of Jones and Stokes for such purpose, and
it is in the best interest of both the District and Dart Resorts that
work on the preparation of such a draft environmental impact report
be commenced as soon as possible.
NOW, THEREFORE, Be it resolved by the Board of Directors of
the Truckee-Donner Public Utility District that said District hereby
approves of and concurs with Dart Resorts retaining the environmental
consulting firm of Jones and Stokes to prepare a draft environmental
impact report on behalf of both the District and Dart Resort for
submission and in connection with (1) the District water right
application 23279 and petitions to change the points of deversion
of water right application 20443 and 22573, and (2) the application
to be filed by the District with the State Lands Commission for a
lease respecting the portion of the initial supply facilities for
deversion of water from Donner Lake located on and beneath the bed
l+ of Donner Lake, and (3) the application to be filed by Dart Resort
for leases respecting the land fill and concrete boat launching
ramp at Donner Lake.
