Defendants took the deposition of Francis Longo
this afternoon, and I was in attendance. It will be written
up soon, and I will send you a copy. It lasted only a
little more than an hour.
I think his story was completely factual, although
I want your views on that when you see the reporter ' s tran-
script. He said that the negotiations on the 1962 contract
were handled by the Board, he being merely its agent, and
that Paul Chamberlain .worked on it too.
He said that it was then the general plan of the
district to construct a 250, 000 gallon tank on the site
i"' obtained from Beavers, to use in conjunction with the devel-
opment of Sawtooth Springs; it was the best tank site around,
and under the plan it would have been used for areas other
than the Beavers su!.<:ivif-:ions . :he district had actually
bought a surplus tank for this purpose. But the Walters study
indicated that this development was not feasible.
When the 1962 agreement was entered into, the dis-
trict was levying a charge of $100 for each lot that was con-
nected up. Later this charge was increased to $250, but then
the increase was discontinued.

the boundary of the subdivision half way up the hill, where

he was not dishonest; that he was not sued on his bond; that
he has no hard feelings toward the district or the directors.
It seemed to me that he had not hurt the district
on his direct, and I did not cross-examine him; we will have
a chance to do so later if it becomes necessary.
Mr. Beavers will be available for deposition soon
after June 1; they will let me know, and I will go into the
whole transaction in detail with him, by deposition.
Lefendants ' counsel want to examine the minutes
for the 1961-62 period preceding the execution of the con-
tract, and obtain copies of relevant material. They are en-
titled to this, and I told them they could do so without a
court order; they are to let me know who will visit you and
when, and I will notify you.
Meanwhile I want to come to Truckee and look at the
minutes and look at the territory, and discuss the whole thing
at length with you, so we can expedite the taking of testimony.

TRUCKEE DONNER PUBLIC UTILITY DISTRICT
AUTHORIZING PRESIDENT AND MANAGER TO
SIGN SERVICE AGREEMENT.

WHEREAS, the Department of Parks and Recreation,
State of California, desires to enter into an agreement to be served
with 5,750 feet of underground electric power to the Donner Memorial
Park near Truckee, Nevada County, California, and
WHEREAS, a Service Agreement has been presented and is
in order,
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS

OF THE
TRUCKEE DONNER PUBLIC UTILITY DISTRICT
RESCINDING REA CERTIFICATION OF AUTHORITY
OF DECEMBER 4, 1963, AUTHORIZING NEW SIGNATURES.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE
TRUCKEE DONNER PUBLIC UTILITY DISTRICT AS FOLLOWS:
The Certification of Authority dated December 4, 1963 signed by
Edward N. Aweeka, Chairman of the Board, and Francis Longo, Secretary,
is hereby rescinded effective this date. President and Manager are
authorized to sign new certifications of authority.
