Beavers , et al. , Nevada Co. Super. Ct. No. 17142 Defendants took the deposition of Francis Longo this afternoon, and I was in attendance. It will be written up soon, and I will send you a copy. It lasted only a little more than an hour. I think his story was completely factual, although I want your views on that when you see the reporter ' s tran- script. He said that the negotiations on the 1962 contract were handled by the Board, he being merely its agent, and that Paul Chamberlain .worked on it too. He said that it was then the general plan of the district to construct a 250, 000 gallon tank on the site i"' obtained from Beavers, to use in conjunction with the devel- opment of Sawtooth Springs; it was the best tank site around, and under the plan it would have been used for areas other than the Beavers su!.<:ivif-:ions . :he district had actually bought a surplus tank for this purpose. But the Walters study indicated that this development was not feasible. When the 1962 agreement was entered into, the dis- trict was levying a charge of $100 for each lot that was con- nected up. Later this charge was increased to $250, but then the increase was discontinued. The district did install a 3" pressure main from the boundary of the subdivision half way up the hill, where uaroi W (d + aro N ro a 4) w  v 0000A U  ar 0 0 a ul H NCO) '413 +► m •  aM :3 ro U+► ur 0 00 cn Coro v, a0 •, 4-J d0) 0 N '-I00u1  3 Nro  N roa rn3 vv roH+1 04X4 4) M0 N•.i 0 m 0 x to 0 ro > O'iUAE+ b+ 0 a , 0 + 0ro0 ro00 0 0 ' `  ,  0 o +x row .u0 ro•H4J 010 N 44 044 0 N  40 UU+► vv rood a•.ro0+ 00tnd0 v J0wV . 4 + ro  3ro O 0p0)4CU4i4JrhH -14 +JR • vo V u tV ar 4J-H 0 4J >i 4 0 +r A 4J•H W >10 U N .I 0  0ar 4J 4) 4u nr 0ar >1 o00 +►ro 4J0vw 4) + 04j w0 +► > Uv 0 N +► 0 v 94 41 0 UA O N N. > u (4 4J +► ro ro d 0 d+ N>x +J +J (0 3 U ro +J + v. a N 4 d >I-ri >Y 0 N b'v ro +1 bN 0N m r0) 0 04 ro 3 mao arroro a 0 M4 m 41 N ar > m 0 O N V) v UV v d 3xro ai4 rnou 0 t +JWWoo > •u 11 0 4J'0 MV4JMw Na.00 w9v NN ro 0 v j xroro 'dN >, 0 ro00 9U•H0 a1 HroF. 004J oWnU rd ro3m 0 4J 4 NaN0 o• WpU) m 414 ro"a 0NNN00 +r0 aJ 4Jrd •4 W 00 3 A ro M0u1 040 E Ua.1. a3Nl x rov+J•rl J 0 a) (d0 0 N N00' 41 41  ANON Oro 04 0 > N -1 U . 414 a) Nar N A . .0 m +1 N1-I v ro 0) 0 +J 3Aw d •4 N +J rd u a vro N roH ro ++ 0 04 +Jv, a 00 0N0PN -: 0 0 0100 00EnEa A Oro + a d 4ro Nr1z  •, N  a) cTN4J00 ,OwroLA 30 414u N 04m  k0v 4JNcn0' >4J bN  a   Q) s4 E  ro '  14 i ro0)-H00ar•H0) a0 0Nrdvrro ro-1u ro 41  >40 0uJ ,N a) 3 3 N 0 v + a) N N C) arW Our 0 ,.. 0 0d 0 v rori +1 ro ur 0 rq 0,04 OA Na rorn aro AM row 41 N +1 > 4rdw 3 wrn 4J . w a 0 x 4) (d ro x N A •u 0 a) ro a).0 0 41 > ar ro N H 0 >4 ar O 'o O N rd ar E r u 0 a) x •4 A A A•H O N am ro 41 +J rd 4 0)0 >  0 •iw0 A 0 4 (d4J4J 4J4J Ua+1 bvoo 3H ur .j +J0m ro +l d v N a W ro N u1 4J :3 0 •-I•r rA E N N 4!ro 4 Qr rooaui0uv4i44)) 0 u3900 4 U)) (n N[ropN uwLo a) urea 1dmu0 041v O +jA v, 4j9ro v  a k V. 0 a ro O N w0 U++ u, Ord ro 00-H OurUW N +J 4J 0 4 A 0 4j -4 41 a) A N rota N OA "1 .1J w k H ro roU >,roroxurs •Pi043: 4J ►k 0) rev v 0 4j0 Hu IN10vro +' 0ro0N0 +J •. • rUH4J 0+Pw ,a 0 :1 4J  4v, ro•, rlNoNN 0 uaHro  0 . 0oU u, Uu,• u U .aO > 00 +Jro0 ro • •+ro0 vN 04J 3W U 0 r C a>13 QNJ U W 0 0 r, a) N  0 0 N -H A a1 I 04.► 0 OUa  ) 0x ro • oM4J4Jroro xNOWar  +► JJ + N  0d0N to ro 0 U to-H to • 4J N4 (n O ro auJ 0 N ro 0 NA O ro N 3r441 ro vv v  tnv 0 +J ro•r+ ro 0 +J o 41 +r .q N ro 0 0 4-) +J Nr. 0 rov x0 +1vvxro3 0 1 m 0 vroaro, $4 vau'i   v ur   Naxro . ob arorou a om u ro u 3 +1 0 &4H000rd-0 34Jx +AacnA roro (d Aroro Nto 4U-H4J Mr. George Cattan - 3 - May 12, 1971 he was not dishonest; that he was not sued on his bond; that he has no hard feelings toward the district or the directors. It seemed to me that he had not hurt the district on his direct, and I did not cross-examine him; we will have a chance to do so later if it becomes necessary. Mr. Beavers will be available for deposition soon after June 1; they will let me know, and I will go into the whole transaction in detail with him, by deposition. Lefendants ' counsel want to examine the minutes for the 1961-62 period preceding the execution of the con- tract, and obtain copies of relevant material. They are en- titled to this, and I told them they could do so without a court order; they are to let me know who will visit you and when, and I will notify you. Meanwhile I want to come to Truckee and look at the minutes and look at the territory, and discuss the whole thing at length with you, so we can expedite the taking of testimony. Sincerely yours, Martin McDonough Attorney Uklc D:p a P. S.
