DECLARING CERTAIN REAL PROPERTY SURPLUS. AND PRO-
3 VIDING FOR SALE THEREOF AT PUBLIC AUCTION ON SEALED
4 BE IT RESOLVED BY THE BOARD OF DIRECTORS OF TRUCKE -+
5 DONNER PUBLIC UTILITY DISTRICT AS FOLLOWS-
6 ' 1. That said Board of Directors does hereby find, declare, and
7 determine that the following-described real property is surplus and no
8 longer needed, and that disposition thereof by sale at public auction will
9 I� be for the benefit and best interests of the District;
10 Said real property is situated in the County of Nevada, State of
11 I California, and more particularly described in Exhibit "A" attached beret

12 and bti- this reference incorporated herein.

13 I 2, That sale of said parcel shall be at public auction on sealed
14 i bids, which bids will be opened, examined, and declared before this

of Section 14 , aforementioned; thence from the true point of
beginning N. 02°00 ' 05 E . , a distance of 462. 064feet ; thence
N . 69025115 W . , a distance of 28 . 30 feet; thence S. DO' 34145 W.
a distance of 139 . 34 feet ; thence S. 27043145 W. , a distance of

Re: Dr. William Warmkessel
Purchase of Brockway Shortcut
Road Property
Gentlemen:
This office has been retained by Dr- Warmkessel in
connection with his recent purchase from your agency of
the above-mentioned land_
As you know, at the time of Dr- Warmkessel` s in-
spection of the land your surveyer had located boundry
stakes on the corners of the parcel. An official of your
agency accompanied Dr. Warmkessel to the site and represented
to Dr. Warmkessel that the boundry stakes were the true
corners.
Dr_ Warmkessel purchased the land with the intent
of placing a dental building on the north-east half. He
intended to convey the south-west half of the land to his
church for the construction of a church.
It appears now that the boundry stakes were improperly
placed and that the land is approximately one-third less
in area than shown by the stakes and as represented by your
agent. It is now impossa..ule for Dr. Warmkessel to locate
a dental building and a church on the land.
Accordingly, Dr. Warmkessel has instructed me to give
you notice of his claim against the Truckee-Donner Public
Utility District. His claim is in the sum of Seven Thousand
Dollars ($7, 000. 00) , representing the difference between the
land as represented and the actual amount of land conveyed.
All correspondence in connection with this claim should,
of course , be sent to this office.
It is possible , however, that the land would still be
useful to Dr. Warmkessel if your agency were willing to convey
additional land to him- Either land at the south-east of
the parcel_ or land at the north-west of the parcel could

be conveyed, provided that the proposed road to the north-
west of the parcel be re-located. If the Board is interested
in this proposal, please advise.
In any event, I would appreciate it if you would let
me know your intentions at your earliest convenience.
