HomeMy WebLinkAboutORD 2019-04 - Board �+ F-3Ublic Utility District Ordinance No. 2019 - 04 ESTABLISHING AN ELECTRIC AMI METER OPT-OUT PROGRAM AND FEES WHEREAS, District Staff evaluated cost of service for providing a voluntary Electric AMI Meter Opt-Out Program and Fees; and WHEREAS, a public workshop was held June 5, 2019 to receive comments from the public concerning a proposal to provide an Electric AMI Meter Opt-Out Program and Fees; and WHEREAS, notice of a Public Hearing for adoption of the proposed Electric AMI Meter Opt-Out Program and Fees was advertised on August 23rd and August 30th, 2019; and WHEREAS, a Public Hearing was held on September 4, 2019 to receive public comments on the proposed Electric AMI Meter Opt-Out Program and Fees; and NOW, THEREFORE, BE IT ENACTED, by the Board of Directors of the Truckee Donner Public Utility District as follows: Section 1. Effective October 4, 2019, the following Electric AMI Meter Opt-Out Program (Opt-Out Program) and Fees shall be effective: Electric AMI Meter Opt-Out Fees Setup and Exit Fee: $158 Meter Reading Fee: Monthly $30 Section 2. If no protest is made pursuant to Public Utilities Code Section 16078, then the terms of this Ordinance shall be effective 30 days after adoption by the Board of Directors of the District. Section 3. The Opt-Out Program is limited to residential customers only. Customers who rent shall obtain landlord approval to participate. Net-metering accounts and seasonal rentals or leases are specifically excluded from the Opt-Out Program. Section 4. The Setup and Exit Fee includes the cost of a standard residential type Form 2S, Class 200 digital meter. The current cost of this meter is $36 including tax. The cost for other residential meter types, such as Class 320 or Form 12S network meters, shall be based on the actual cost of the meter plus tax. Therefore the total Setup and Exit Fee for other residential meter types shall be based on the actual cost of the meter plus tax. Section 5. Customers can enroll in the Opt-Out Program at any time during the year. Once enrolled, they will continue to be enrolled unless one of the following occurs: the customer requests to exit the Opt-Out Program; District personnel are unable to read the meter twice in any 12 month period (due to snow/ice accumulations, locked gates, fences, dogs, other obstructions or impediments to access or personnel safety); change in home ownership; or the customer-renter vacates the property. When any of these events occur, the customer will exit the Opt-Out Program and an AMI meter will be installed at the expense of the District. Section 6. Fees will be reviewed and reevaluated periodically, or as-needed, against the actual costs to provide the service. Any recommended fee adjustments up or down will be brought to the Board for review and consideration. Section 7. Application requirements, billing cycle placement, issues related to determining if District personnel are unable to read a meter, and other procedural and administrative details shall be as approved by the General Manager. Section 8. The Clerk of the District shall immediately cause a copy of this Ordinance to be published in a newspaper of general circulation and posted in three places within the District. Section 9. The provisions of other Ordinances shall remain if effect to the extent that they do not conflict with this Ordinance. PASSED AND ADOPTED by the Board of Directors of the Truckee Donner Public Utility District at a regular meeting thereof duly called and held within said District on the fourth day of September, 2019 by the following roll call vote: AYES: Directors: Aguera, Finn, Vice President Bender, and President Ellis.
