WHY THIS MATTER IS BEFORE THE BOARD This matter involves amending the assessment for certain parcels within the Donner Lake Assessment District. Only the Board can make changes to the assessments. 2. HISTORY The Donner Lake Assessment District can only assess parcels that benefit from the water system. Since the District took over providing water services to the Donner Lake area, amendments to parcel assessments have been made for: * A parcel was deemed unbuildable. * A parcel should have a one and a half assessment for a main house and a second unit. * Lots merged into one parcel should have one assessment. * A parcel was too small to build on. * A parcel was too isolated from the water system improvements and would not receive a benefit. * A parcel is used for utility purposes only. 3. NEW INFORMATION The following parcels require assessment amendments: * Stephen Cook, APN 18-390-23: parcel should be charged a one and a half assessment for a main house and second unit. Mr. Cook has been charged a double assessment. The reduction will be $3,462.77 * AT&T, APN 17-170-22: parcel is used only as communications site and will never benefit from the water system. The assessment has been paid through 06/07. AT&T requested a permanent waiver for the remaining balance of $5,012.09 (see attached letter). * John Pawek, APN 069-130-58: assessment impound was part of his development agreement. Official Board action is required. * Jon Dickson, APN 17-182-01: parcel too small to build on. The common area parcels still need board action to officially remove them from the Donner Lake Assessment District. A workshop will be held in July regarding this issue. 4. FISCAL IMPACT The fiscal impact is a reduction of $8,474.86. 5. RECOMMENDATION Adopt the resolution amending parcels impacted by the Donner Lake Assessment District. Box 309 Truckee, CA. 96160 RE: Donner Lake water assessment, APN 17-170-22 AT&T has maintained a communications site at 10065 Donner Lake Road since June 2003. The building on the site will only require electric services from Truckee Donner Public Utility District and will never need water services. AT&T would like to request an exemption from the Donner Lake Assessment District charge for the tax year 2008/2009 forward. The assessment has been paid through the tax year 2006/2007. The parcel will never benefit from the rebuilding of the Donner Lake water system. AT&T would appreciate your consideration on this matter. IAA �I All • dPublic Utility District Reso ution No. 2008-XXX Amending Resolution No. 2001-09 by Amending Certain Donner Lake Assessments WHEREAS the Board of Directors adopted Resolution No. 2001-09 which made determinations, confirmed assessments and proceedings, ordered the acquisition and construction of improvements and took certain other actions relating to Donner Lake Water Assessment District No. 00-1; and WHEREAS, subsequent to adoption of Resolution No. 2001-09, certain information has come to light regarding specific property of record as follows: 1. Specific property owner of record whose parcel was assessed as two full assessments and should be assessed as multiple dwelling units; and 2. That certain parcels are too small to build on, should be removed from the water system improvements and shall therefore never benefit from the improvements made by the assessment district; and 3. Certain parcels are used for public purposes and will never benefit from the improvements made by the assessment district; and 4. A certain property owner's development agreement states responsibility for the assessment; and WHEREAS THE District determines that, based on the above findings, certain assessment confirmed in Resolution 2001-09 should be amended or repealed; NOW THEREFORE BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE DISTRICT AS FOLLOWS: 1. The parcel assessment for Stephen Cook, 13264 Donner Pass Road, Truckee, CA., APN 18-390-23 shall be adjusted to$10,388.28, rather than$13,851.05.This exception is consistent that a parcel should get a one and a half assessment when there is a main house and a second unit on the same parcel. 2. The parcel assessment for AT&T, 10065 Donner Lake Road, Truckee, CA., APN 17- 170-22 will only require electric services and will never need water services, therefore shall never benefit from the improvements made by the assessment district and assessment should be exempted. 3. The parcel assessment for John Pawek, APN 069-130-058, shall be assessed according to a development agreement dated November 2001. 1 Resolution 2008-XX 4. The parcel assessments on the following parcel, said parcel being too small to build on or being located such as to not benefit from the water system improvements, shall be rescinded: Jon Dickson, APN 17-182-01. 5. All other resolutions adopted by the Board of Directors shall remain in effect except to the extent that the terms therein conflict with the terms of this resolution.
