Subject: Public Hearing on the Water Meter Surcharge
1. WHY THIS MATTER IS BEFORE THE BOARD
This matter involves a public hearing prior to adopting an ordinance establishing a
water meter surcharge. The Board conducts this hearing.
2. HISTORY
At the October 1 meeting, the Board gave staff direction to move forward with the
Water Meter Project. In order to implement this surcharge, a public hearing must be
held to receive comment.
3. NEW INFORMATION
Notices were placed in both the Sierra Sun and Moonshine Inc. In addition,
Proposition 218 required notification to all parcels liable for payment of water fees.
Letters were mailed as of October 17. To date, 44 Public Comments have been
received by the District. The comments are attached.
At the conclusion of the public hearing, the Board is able to take action regarding an
ordinance establishing a monthly water meter surcharge to fund a portion of the Water
Meter Project.
4. FISCAL IMPACT
There is no fiscal impact with this agenda item.
5. RECOMMENDATION
Conduct the public hearing and receive comment from the public.

I am just wondering if,when and if water meters are installed,will my property be
provided with a meter? I know I am late in getting to you,but my property is seldom occupied so
little water is used,but I am still required to pay the same amount monthly as those people that
live there full time. When I was up there last summer,the people next door to me had their
sprinkler on in their back yard from early morning until night one day,and they don't even have a
lawn. That is a waste of water.
I won't mind the meter surcharge if I have a meter and only pay for the amount of water
that I use.

This letter is written to support, not protest,the proposed water surcharge of$5 per month for five
years. Even though our personal budget is smaller in these difficult times,we believe water metering
should be installed and used as soon as possible.
In the meanwhile,we'd also like to propose rotating watering schedules,as done in other communities,

Re: Water Surcharge
Dear Sirs:
I am writing to protest the implementation of the proposed water surcharge for the
installation of water meters. I have been a customer of TDPUD for over twenty years
and have seen rates increase at a rate that seems much higher than costs and inflation
would dictate.
As customers we were promised that the purchase of the Glenshire and Donner Lake
water systems would.not affect our rates,but shortly after those transactions, our water
rates started to rise dramatically. I think prior to raising rates any higher that the District
should spend some time seeing where savings might be made in other areas instead of
putting additional burden on the rate payers.
If this is an unfunded state mandate,perhaps a protest by the Board to our state
representatives would be in order. Truckee is at the water source and quite frankly
should not be lumped in with the downstream users in the Sacramento valley and
southern California. Fight for an exception or a change in the rules,but do not just pass
this through to your rate payers.

This protest is addressed to all members of the Truckee Donner PUD board
and is assumed to be part of the agenda of the public hearing on December 3,
2008, 6:00 pm, District Board Room at 11570 Donner Pass Road, Truckee,

My husband and I---and later CBR Enterprises—have owned this property since
1972.. During this time we also owned a second parcel for which we were billed for
water from various entities.
This letter will not address the bundle of costs from the various agencies paid for
properties owned. It only addresses the subject property at Donner Lake and the
associated water charges.
I am up in arms about the proposed assessment and additional tax. You may call it a
surcharge but I agree with Webster's Collegiate Dictionary when it lists the number
one definition of "surcharge"as: "an a"tional tax, cost, or impost". The second
definition calls it "an excessive load or burden".
From about 1994 to 2000 we send checks to the Del Oro Water Company; our water
cost for that period of time amounted to $2866.43. It was about that time the owner
of Del Oro pulled the plug and called it quits. The service was taken over by the
present municipality, the Truckee Donner Public Utility District. It was decided the
previous owner left his water wells and sources muddled and befuddled. There was
much work to be done by the PUD to correct the many"problems". AND WHO
SHOULD ASSUME RESPONSIBILITY FOR THIS?Why, the customer, of course.

We were informed each of us would have an assessment, a tax--WebsterI s again--
and the meaning of to assess: "to determine the rate or amount of(as a tax)"; "to
impose (as a tax) according to an established rate; "to subject to a tax, charge, or
levy, to make an official valuation of(property)for the purposes of taxation". The
assessment for our cabin at Donner Lake was $6925.52,to be paid in total or over a
period of time, with interest charged. We dutifully wrote check number 4048 to the
Truckee Donner PUD. I know property owners who chose to pay over time and
never did have to pay the entire assessment.
I don't care what kinds of problems they are having or assuming they will have. We
currently pay a monthly charge of$55.21 plus $6.65 upgrade charge—really another
tax—for a total of$742.32 a year. Let them find the money someplace else.
I wish I could personally address the board,but we are seasonal owners. We have
always paid our share.

We are voicing our protest on the$5.00/month water meter surcharge. We are extremely water
conscious and are already paying a very high flat fee considering our usage. We already have a
water meter at our home an if our meter had been read these past 10 years we would have saved
a considerable amount of money. We have a low maintenance yard,don't hose down our
driveway and are a household of two. Why should we have paid the same flat fee a family of 5
has paid and now also pay the same surcharge amount? We grew up in an area where water
rationing was enforced and know how to conserve. I suggest you police the neighborhoods and
find the water wasters and surcharge them. Those people will continue to waste water regardless
of a meter or not. Don't penalize those who are responsible and conserve.
Thank you for considering our position against implementing this surcharge.

We have made several attempts to request that our 5 unit condo complex not be
charged on an individual basis&one meter be placed into effect. This is a very
reasonable request.
We are located at 12575 Northwood's,Truckee. There are 5 units and none of us are
full time residents. We have no gardens to water and since these are our second
homes,the number of days spent to use the water is minimal. Each of us is currently
paying$63.90 which is $766.80 a year and with 5 units that is a total of$3,834.00.
Now you want to add another$5.00 to each unit for another$300.00 a year for 5
years of$1,500.00.
Fair is fair, so lets be reasonable and do what is right! Put one meter in and let us pay
for what we use. If you order a glass of wine would you expect to be charged for the
whole bottle and that is what you would be doing.

I received your notice of Public Hearing for a Water Surcharge to be added to the service
in the Truckee Donner area. I have a tenant in my property at 10512 Iris in Prosser
Lakeview Estates in Truckee,APN 16-480-3 1-000, who is responsible for paying the
water usage.
I strongly protest this charge since I do not feel it is the responsibility of the homeowner
or the tenant to pay for maintenance and improvements for the District services. That is a

Dear Deputy Clerk of the District:
I am glad you thought of me in connection with your proposed customer water surcharge implementation
plan. Such an increase in rates should prove interesting considering my property has been for 11 years
already equipped with the automatic meter reading technology.
Although modest amounts of money pass through my bank account,no provision has been made to spend it
for the sort of work entailed in your request. This has been such a bad year for my work I am overwhelmed
by debt. I am sorry I do not have the money to assemble. If it were available I would be glad to send it
along with my monthly customer billing. Is there a way I might receive a reprieve from the proposed
surcharge as the automatic meter has already been installed and certainly paid for by a previous district
budget?
If you enlist the help of your manager and district staff,I imagine you will be able to reduce salaries,
expenses,benefits and positions from your annual budgets. If not,the manager can probably secure an
inexpensive,temporary,benefit-free work force from a local jail, prison or perhaps third world country(as
the local ski areas do)with which the district can develop employee exchange programs.
Should there be any other advice I might provide you,please let me hear from you. In the meantime,good
luck to you with implementing the customer water surcharge.

As the property owners of the above-referenced property within the Truckee
Donner Public Utility District,we protest and object to the proposed water surcharge for
the Water Meter Project.
The District has imposed no charges nor budgeted for such costs in the past
despite long-held knowledge that the day of required water meters was inevitable. A
future flat five dollars per month for five years is neither equitable nor necessary. Just
like the service lines that carry water throughout the District,meters are part of the
infrastructure and should be paid from service rates based on water usage. Ratepayers
who have long enjoyed and used unlimited amounts of water for a flat rate, while other
ratepayers have conserved water or used little for the same flat charge, can repay the past
subsidies by future payments for metered water service. If any additional sums are truly
needed, future water rate charges or increases to cover the costs of meters provide an
equitable basis for meeting such costs, and will encourage water conservation at the same
time.

Re:Water Surcharge
We protest the surcharge being considered by the Truckee Donner Public Utility Distrist,
effective January,2009.
Six years ago, when we applied for permits from the Water"District," we were told that
our water meter would not be read; instead all homes would be charged $50/month
to cover water costs. However, we were required to install a water meter.
This seemed odd,but we accepted it ,otherwise, no building permit would have been issued.
For years,we have been paying a disproportionate amount for water;in effect, subsidizing
the homeowners who live in the area year-round and use most of the water.
We were required to install water meters.The choice was not ours,and we complied.
Why should we now be forced to pay for the homeowners who have benefited the most
over the years?
Let them install,at their cost, water metering equipment just like we were required to do.
This is the only equitable solution.

I am protesting the water surcharge. I live in Glenshire and we out here have
to pay more for our water ($68.58 per month) than the rest of Truckee. Then
if we get assessed more that even makes it more difficult for us.
We also have a rental. We pay the water for that property because our tenants
cannot afford this cost. That makes our monthly water bill at $137.16 per
month. That is $1,645.92 per year. That is HUGE!! If the water surcharge
goes through we will be paying more than we can afford.
Since we own property at 14974 Donnington and 14756 Donnington I want
this letter to count as T WO,2rot_ests.

district issues exemptions for senior citizen on their Measure C and other bond issues.

I hereby submit my protest to the $5.00 per month water surcharge. Basic
reason is that being a part time resident, we used very little water compared to
the full time residents and already we are paying one of the highest water rates in
the State.
I do agree that metering the water instead of having a flat rate is needed, but full
time residents should bare the majority of the cost of meter installation or
increase the permit fees to the developers to cover the funding.

Dear Truckee Donner PUD,
I am writing to protest the proposed water surcharge pursuant to the requirements of Prop
218 and CA constitutional article XIII. We are Tahoe Donner property owners and our
address is 14185 Swiss Lane, Truckee CA.
The reason for the protest is twofold. First what are the benefits of installing new water
meters and the new automatic meter reading technology,they are not clearly defined nor
the reason for the state not funding them made clear. If the State decides not to fund it
then the requirements should no longer be mandated.
My second point of protest is our property in Donner, as are the majority, is a 2nd home
and therefore we use less water defacto,having us pay the same flat$5 per month
surcharge is an inane and unjust proposal.
In conclusion, I'm unaware of the benefits of installing the new water meters and
therefore protest a tax without any benefit, secondly if.there are any benefits, being a
second home owner we would see less if any of them yet still be required to pay the
surcharge.
Hope this resonates but in this time of shrinking economies I hope you'll approve my
protest and not install or tax me for an unnecessary water meter.

Dear Deputy Clerk,
I am writing in protest to another water surcharge being proposed to
our cabin at 16046 Northwoods Blvd. Truckee, Ca. APN#44-330-05-000
We have owned this second home since 1994. And since we use it for
vacation purposes, it is unoccupied most of the time. Also, the Tahoe
Donner area has changed from properties like ours. To those that have close
to, if not more than, a 50% full time occupancy.
Over the years we have seen our monthly water bill go from
approximately $30.00 a month. Through the numerous water surcharges,
implemented over the years. To what is now almost $65.00 a month!
I agree that the Tahoe Donner area needs to have the water metered!
And this should have happened years ago. As properties like ours have
funded the additional water usage of those occupied by full time residents.
So let these properties exclusively fund this additional water
surcharge, until the metering is installed! It should be very easy to determine
which properties house full time residents and which do not, through electric
and gas usage. Let them get used to paying their fair share of water usage
costs! And quit penalizing those of us who have been unfairly subsidizing
their water usage for years! I hope that this point has been taken, and any
surcharges assessed will be levied fairly!
I hope that other vacation property owners like myself will take the
time to express a similar view. And that any more unfair water surcharges
will be paid by those who use it!!!!!

Under Proposition 218, if you are the owner of record for a parcel or parcels or a tenant directly
liable for payment of the water fees subject to the proposed water surcharge, you may submit a
written protest regarding the proposed surcharge. If a tenant pays the water fees, then it is the
responsibility of the property owner to provide tenants with this water surcharge notice.
Protests must be filed in writing with the Deputy Clerk of the District. It may be filed with the
Deputy Clerk at any time before the close of the public hearing. Written protests may.be mailed or

excessive if you consider the percentage increase. Since the state has made the

Board Members,
We STRONGLY protest the proposed customer water surcharge on all TDPUD water
customers for the installation of water meters. We do fully agree with metering, but are
against the proposed $5.00/mo for 5 years charge to ALL the customers.
We are Tahoe Donner Homeowners and customers of TDPUD. This is a second home
and we are there weekends and holidays during the winter and holidays during the
summer, along with a few other days per year. We turn off the water every time we
leave and have no irrigated landscape. We have no children or guests at our home. We
have long been concerned that our water fees effectively subsidize full-time residents,
as well as part-time residents with more than one family member, guests, etc. The flat
rate system is very unfair and we have been paying a very high rate for years. To ask
us to pay and additional $5.00 per month for 5 years (if it only lasts that long!) is unfair!
We are residents of Alameda County and therefore are not able to vote in your district
on these issues. This unfair and there are other ways to fund this project instead of
making customers like us pay more, again! We should pay less, if anything!
TDPUD has had more than enough time to budget and plan for the transition to meters.
I believe that you have put your head in the sand on this issue and now want to pass
the expense to us. Over 4 years ago, when the TDPUD was "looking for every way to
cut costs", you did not have an a-bill option. I called and spoke to one of the directors
and he said, "we haven't explored that, maybe we should look into it". The savings on
paper, postage, and handling is significant. We also pay a higher rate for our electric
portion of the bill because we are second home owners. Another inequity that we
couldn't vote on and other customers benefit from.
Please vote NO on this proposed rate surcharge!

Board Members,
I really must protest the recent decision to impose the customer water surplus on all
TDPUD water customers.
I am a Tahoe Donner Homeowner and I pay monthly fees to TDPUD. I am a single,
part-time resident of my second home. I turn off the water between visits, which
average fewer than 10 days per month. I do not maintain an outdoor sprinkler system
or a hot tub or any other high water use. I have long been concerned that my water
fees effectively subsidize full-time residents, as well as part-time residents with more
than one family member. By my estimate, based on actual use, more than half of my
monthly fee amounts to a subsidy under the current flat rate system. Since I have
owned my home, a conservative estimate puts my subsidy amount in the neighborhood
of$2,000. To ask me to pay an additional $300 to fix the problem, while the
beneficiaries of the cost—shift still pay less than their fair share, is extremely inequitable.
I cannot state strongly enough that penalizing those who, by definition, cannot vote in
District elections, is discriminatory and misguided.
I remember hearing about the requirement for individual meters some time ago and I
have to believe the District has been aware for considerably longer, so has had more
than enough time to budget and plan for the transition. In the interim, why hasn't the
District managed its expenses conservatively to prepare for funding the transition?
notice that the District's offices were recently painted along with some other cosmetic upgrades to the exterior, and I wonder why this work was undertaken when the District
knew of this upcoming expense? Wouldn't funding the transition have been a better
use of the District's resources?
I hope the Board will take my comments under advisement and seriously reconsider the
proposed surcharge. Thank you, in advance for your consideration.

I am in receipt of your communication related to the Public Hearing-Water Surcharge and your plan to
comply with Proposition 218 and the California Constitution Article XIII consideration of a proposed
water surcharge for the Water Meter Project.
We object to the proposed surcharge for this project for one simple reason,when my father in law built
this residential building in 1968,we were required to purchase and install a water meter as condition of
obtaining a connection. This water meter has been in place for 40 years without the district having
bothered to read and compute our;bill ngs'for the water we have used. It appears to me the district:is
attempting to double charge the property at 12324 Greenwood Drive for a water meter we have had since
the original connection was made to the Districts system. We OBJECT to any surcharge on these
grounds. 12324 Greenwood is in compliance with the California Constitution Article XIII.
I have no knowledge of the Districts practice of not having enforced the continued water meter
installation requirement as a condition for service. This should not result in this residence having to pay
for this failure by the District.
I'm quite sure if you check your records for connections during the period 1968 you will find many
customers with water meters already in place. These meters may be verified by field inspection of the
shut off/meter box.

Board of Directors,
As a long time property owner and customer I am writing this letter in
form of protest to the proposed water surcharge to fund the water
meter project. Specifically my main issues with this proposition are:
❖ Our water bill has gone from a flat fee of $24.00 per month to
$68.58 per month. That is an increase of 184.5%. We already
pay a water system upgrade charge of $10.75 per month. Why
were the meters not included in this fee?
❖ The board wants this surcharge to cover 38% of this project —
which comes to an additional $60.00 a year or $300.00 over the
5 year period. That means that each meter costs $790. That
seems excessive! There must be a less expensive alternative.
Who will pay for the meters on the REO properties?
❖ When will they begin installation of the meters? The letter says
the district must install meters and meter reading technology on
all customers over a specific period of time and then charge for
water service but no timeline is given!
I think that the meters should be paid for entirely by the meter
reserve fund and we should be made aware when the meters will be
installed and how much we will be charged per gallon and if we will
be charged a meter reading fee. In the current economy more and
more homeowners are being pushed into foreclosure and this just
adds insult to injury and will force more people into default meaning
less revenue for TDPUD!
