WHY THIS MATTER IS BEFORE THE BOARD The developer of the Machado project has requested that the District provide water service to the project. The subject parcel is not currently within the Districts water service territory and an application for annexation must be submitted to the Placer County LAFCO. The Placer County LAFCO requires a resolution by the Board o Directors to submit the annexation application. 2. HISTORY Chapter 5.53 of the District Code governs the annexation of property to the District's service territory. 3. NEW INFORMATION The Machado project involves the redevelopment of Placer County parcel APN 080- 270-038. A veterinary hospital and boarding kennel are currently located on the property. Electric service to the property is provided by Sierra Pacific Power and water is provided by a private domestic well. The location of the parcel is shown on the attached Figure 1. The proposed annexation involves only the District's water service territory. Sierra Pacific Power will continue to provide electrical service to the project site. The following information is provided in accordance with Chapter 5.53.010.3 of the District Code: a. The parcel to be annexed is Placer County APN 080-270-038. b. The parcel is within the District's Sphere of Influence as defined in Plate 3 of the Sphere of Influence Report, October 1996. c. The proposed redevelopment project consists of two commercial buildings. Sufficient water supply capacity exists to serve the project. There is an existing 14- inch pipeline in close proximity to the project site. The developer will be required to install a new 10-inch pipe connecting the project site to the existing 14-inch pipe, along with constructing all required on-site improvements. d. The Developer has agreed to pay the costs of processing the annexation application as evidenced on the attached form. Attachments: Figure 1 Payment agreement Draft Resolution 4. FISCAL IMPACT There is no fiscal impact to the District. The developer of the project has agreed to t pay the costs of processing the annexation application. The project will be subject o the District's normal Connection Fee and Facility Fee schedules. 5. O ' V k a 4 Q o P .a N. o @_o ClMOURN ) w x 1,p CP 9 Machado Project 26j SCHAFFER MILL RD Figure 1 TRUCKEE DONNER Location of Machado Project Public Utility District Placer APN 080-270-038 '00,04 TR UCKEE DONNER Public Utility District Resolution No. 2008- XXX Application by Truckee Donner Public Utility District Requesting the Local Agency Formation Commission of Placer County to Take Proceedings for the Annexation of Placer County APN 080-270-038 for the Machado Development WHEREAS, the property owner of Placer County Assessor's Parcel No. 080-270-038 has requested the District to initiate the annexation process in order to provide water service to the Machado Development, a reconstruction of the existing veterinary hospital and boarding facility and the addition of approximately 17,000 square foot commercial retail/office building development located in Placer County; and WHEREAS, the Truckee Donner Public Utility District desires to initiate proceedings pursuant to the Cortese-Knox-Hertzberg Local Government Reorganization Act of 1985, commencing with Section 56000 of the California Government Code, for the annexation of Placer County Assessor's Parcel No. 080-270-038; NOW THEREFORE BE IT RESOLVED by the Board of Directors of the District as follows: 1. Application and proposal are hereby made to the Placer County Local Agency Formation Commission for the annexation of certain territory to the Truckee Donner Public Utility District. The exterior boundaries of such territory are described in the legal description attached hereto and by reference made a part hereof. 2. It is desired that the proposed annexation provide for and be made subject to the following terms and conditions: the property owner shall finance all connection expenses, water system modifications and annexation costs. 3. The reason for this proposal is to provide potable water service to the above- described territory. 4. This annexation is consistent with the sphere of influence adopted for the Truckee Donner Public Utility District by Nevada LAFCo in 1983. The District's sphere plan was updated in 1998 to comply with new Nevada LAFCo requirements. The District therefore requests that Placer LAFCo proceed with this proposal in consideration of the following: the District has documented its ability to provide sufficient and sustainable service to the project, the District serves adjoining properties and the District believes that the proposal is generally consistent with both Nevada and Placer LAFCo's policy objectives. 5. The District certifies that, pursuant to Government Code Section 56663, the owner of the subject property has provided written consent to annexation. The Board of the Truckee Donner Public Utility District, as the only agency that will gain or lose territory as a result of this annexation, hereby consents to a waiver of the final protest hearing by Placer LAFCo. 6. Truckee Donner Public Utility District staff is hereby authorized and directed to file a certified copy of this resolution with the Executive Officer of the County of Placer Local Agency Formation Commission.
