Wright, General Manager RECOMMENDATION: Adopt Resolution 2023-08 and authorize the General Manager to sign any ancillary documents to secure grant funds in partnership with the Truckee River Watershed Council for the Donner Creek Restoration Project. BACKGROUND: In August of 2022, the Truckee River Watershed Council (TRWC) presented at a Board meeting for collaborative partnership with the District. As the TRWC and the District have a shared mission to work in an environmentally responsible manner, which includes both water quality and protecting and conserving our riparian and aquatic habitat. Furthermore, our successful partnerships to date have been the Truckee Wetlands project. The wetland project was a restoration within the District's property adjacent to the dirt parking lot by the Rodeo Grounds. To build on that success, restoring the resilience of Donner Lake, Donner Creek and the Truckee River, a natural partnership to assist and restore Donner Creek was envisioned. The Donner Creek Restoration Project entails restoring four sites along Donner Creek in order to improve water quality, reduction of fine sediment loading during high flow events, and reduction of pollutant loading from urban runoff. This will improve instream and riparian habitat, decrease excess sediment to the Truckee River and protect the existing infrastructure. "T• yam. 1 rKWY UP } r _ ANALYSIS AND BODY: At the August 2022 Board of Directors meeting, the Board's consensus was to partner and assist TRWC in taking the California Environmental Quality Act (CEQA) lead and assist in construction funding where possible. Three of the four sites are within the California Department of Transportation's (CALTRANS) right-of-way. Just recently, TRWC received notice that the requested 1.2 million dollar grant would be awarded in the amount of 1.24 million dollars from the Department of Water Resources. Working with stakeholders, the TRWC is ready to move to the next steps. Resolution 2023-08 will authorize the General Manager to take the CEQA Lead and work with TRWC in securing the grant funding agreement and any ancillary documents for the project. Construction and communication campaigns are slated for 2024. GOALS AND OBJECTIVES: District Code 1 .05.020 Objectives: 1. Responsibly serve the public. Page 2 of 3 Page 12 of 315 3. Engage with our customers and communities in a welcoming and transparent way to identify opportunities. 4. Take the best of private sector thinking to modernize the utility and add value to our communities. FISCAL IMPACT: There is no direct fiscal impact associated with this item. However, the District has infrastructure in site three, and staff will work with TRWS to monitor any potential work in the wetlands while restoration is underway. ATTACHMENTS: 1. r2023-08 TWRC Grant Page 3 of 3 Page 13 of 315 ■ UCKEE r ■ ublic Utility District Resolution No. 2023-08 Resolution of the Board of Directors of the Truckee Donner Public Utilities District Authorizing the Grant Application, Acceptance, and Execution for the Donner Creek Restoration WHEREAS, the Truckee Donner Public Utility District intends to implement Donner Creek Restoration in partnership with the Truckee River Watershed Council; WHEREAS, the Truckee Donner Public Utility District has the legal authority and is authorized to enter into a funding agreement with the State of California; and WHEREAS, the Truckee Donner Public Utility District intends to apply for grant funding from the California Department of Water Resources for the Donner Creek Restoration; NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Truckee Donner Public Utility District as follows: 1. That pursuant and subject to all of the terms and provisions of the budget Act of 2021 (Stats. 2021, ch. 240, § 81) and the California Drought, Water, Parks, Climate, Coastal Protection, and Outdoor Access for All Act of 2018 (Pub. Resources Code, § 80000 et seq.), the Truckee Donner Public Utility District General Manager, or designee is hereby authorized and directed to prepare and file an application for funding with the Department of Water Resources, and take such other actions as necessary or appropriate to obtain grant funding. 2. The Truckee Donner Public Utility District General Manager, or designee, is hereby authorized and directed to execute the funding agreement with the Department of Water Resources and any amendments thereto. 3. The Truckee Donner Public Utility District General Manager, or designee, is hereby authorized and directed to submit any required documents, invoices, and reports required to obtain grant funding.
