Resolution of the Board of Directors of the Truckee Donner
Public Utilities District Authorizing the Grant Application,
Acceptance, and Execution for the Donner Creek Restoration
WHEREAS, the Truckee Donner Public Utility District intends to implement Donner
Creek Restoration in partnership with the Truckee River Watershed Council;
WHEREAS, the Truckee Donner Public Utility District has the legal authority
and is authorized to enter into a funding agreement with the State of
California; and
WHEREAS, the Truckee Donner Public Utility District intends to apply for grant
funding from the California Department of Water Resources for the Donner
Creek Restoration;
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Truckee Donner
Public Utility District as follows:
1. That pursuant and subject to all of the terms and provisions of the
budget Act of 2021 (Stats. 2021, ch. 240, § 81) and the California
Drought, Water, Parks, Climate, Coastal Protection, and Outdoor Access
for All Act of 2018 (Pub. Resources Code, § 80000 et seq.), the Truckee
Donner Public Utility District General Manager, or designee is hereby
authorized and directed to prepare and file an application for funding
with the Department of Water Resources, and take such other actions
as necessary or appropriate to obtain grant funding.
2. The Truckee Donner Public Utility District General Manager, or
designee, is hereby authorized and directed to execute the funding
agreement with the Department of Water Resources and any
amendments thereto.
3. The Truckee Donner Public Utility District General Manager, or
designee, is hereby authorized and directed to submit any required
documents, invoices, and reports required to obtain grant funding.
PASSED AND ADOPTED by the Board of Directors of the Truckee Donner Public Utility
District at a meeting held within said District on June 6, 2023 by the following roll call vote:

Director
of Transportation District 3 (Caltrans) to delegate CEQA Lead Agency status to TDPUD

Resources and The Middle Truckee River watershed, including its tributary Donner Creek, is listed as
Risk Management Clean Water Act impaired by sediment by the U.S. EPA, with an approved TMDL
Board of Directors (Lahontan Water Board, 2008). The goal of the Project is to improve water quality and
Joseph Aguera habitat along Donner Creek, and decrease excess sediment reaching the Truckee River,
Jeff Bender in support of the TMDL.

Tony Laliotis Three of the four Project sites are within the Caltrans right-of way. This is a locally
funded project to be authorized by a Caltrans encroachment permit. The project meets
the criteria for Categorical Exemption 15333, Small Habitat Restoration Projects due to
net positive environmental benefits for habitat and water quality, small size, and lack of
adverse environmental impacts. The text of this CatEx is as follows:
15333. Small Habitat Restoration Projects.
Class 33 consists of projects not to exceed five acres in size to assure the maintenance,
restoration, enhancement, or protection of habitat for fish, plants, or wildlife provided
that:
(a) There would be no significant adverse impact on endangered, rare or threatened
species or their habitat pursuant to section 15065,
(b) There are no hazardous materials at or around the project site that may be disturbed
or removed, and
(c)The project will not result in impacts that are significant when viewed in connection
with the effects of past projects, the effects of other current projects, and the effects of
probable future projects.
(d) Examples of small restoration projects may include, but are not limited to:
(1) revegetation of disturbed areas with native plant species;

(2) wetland restoration, the primary purpose of which is to improve conditions for
waterfowl or other species that rely on wetland habitat;
(3) stream or river bank revegetation, the primary purpose of which is to improve
habitat for amphibians or native fish;
(4) projects to restore or enhance habitat that are carried out principally with hand
labor and not mechanized equipment.
TDPUD respectfully requests to be the CEQA Lead Agency and Caltrans to be a CEQA
Responsible Agency. TDPUD will perform all studies necessary to document and support
the CEQA CatEx.
