Subject: Adopt a Resolution to Authorizing the Board President to Sign the
Truckee River Operating Agreement
1. WHY THIS MATTER IS BEFORE THE BOARD
Only the Board can approve a resolution.
2. HISTORY
The Truckee River Operating Agreement (TROA) applies to the Truckee River Basin,
Tahoe Basin and the Carson River Basin in Nevada, from Reno/Sparks to Pyramid
Lake. The Truckee River Operating Agreement has had a long and complex history
going back to the 1800's.
Truckee-Carson-Pyramid Lake Water Rights Settlement Act (1990) Public Law
101-618 requires five parties to sign the Agreement. TROA provides equitable
apportionment of the water of the Truckee River, Carson River and lake Tahoe
between California and Nevada. TROA also clarifies the District's water rights to
Donner Lake and the Martis Valley.
3. NEW INFORMATION
At the August 20th Board Meeting, Carroll Hammon gave the District a highlighted
presentation on the Truckee River Operating Agreement. All parties involved in the
settlement have approved the Agreement. There is to be a signing ceremony
September 6, 2008 in Reno, Nevada. The District is one of the signatories to the
agreement.
4. FISCAL IMPACT
There is no direct fiscal impact associated with this item.
5. RECOMMENDATION
Approve the attached Resolution and authorize the Board President sign the Truckee
River Operating Agreement.

Authorizing the President of the Board to Sign the
Truckee River Operating Agreement
WHEREAS Public Law 101-618, enacted by the United States Congress in 1990 established an
interstate allocation of the water resources of the Truckee River Basin, and required negotiation of a
Truckee River Operating Agreement(TROA)to manage the limited resources and provide mitigation
for any significant environmental impacts resulting from the operation of the River; and
WHEREAS the California Department of Water Resources is the lead agency in negotiating
California's interest in the TROA and is the co-lead with the U.S. Department of Interior in preparing
the environmental impact report of the Agreement; and
WHEREAS Truckee Donner Public Utility District is a member of the Truckee River Basin Water
Group, and the District is a purveyor of water in the greater Truckee Community and as such has a
significant interest in management of water resources in the Truckee River Basin; and
WHEREAS the TROA has undergone environmental review pursuant to the California Environmental
Quality Act which must disclose all potentially significant environmental impact and identify mitigation
measure to reduce said impact; and
WHEREAS Truckee Donner Public Utility District has reviewed the Truckee River Operating
Agreement.
NOW THEREFORE BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE DISTICT that the
President of the District Board of Directors is authorized to sign the Truckee River Operating
Agreement.
PASSED AND ADOPTED by the Board of Directors at a meeting duly called and held within the
District on the third day of September 2008 by the following roll call vote:
