PublicUtili'ty District
CONSENT
To: Board of Directors
From: Jim Wilson
Date: December 17, 2014
Subject: Consideration of Adopting a Resolution to Dispense with
Competitive Bidding in Relation to the Ancillary SCADA Building
HVAC.
1. WHY THIS MATTER IS BEFORE THE BOARD
This item involves adopting a resolution to dispense with further competitive bidding
and awarding a contract for the installation of a heating, ventilation, and air
conditioning (HVAC) system for the Ancillary SCADA Building.
2. HISTORY
Staff sent out a request for quotes on September 17, 2014, for the installation of the
HVAC System, in which the District supplied the major components. After the thirteen
day time period had expired, we had received no quotes.
On October 24, 2014, staff sent out a request for bids, in which the contractor was to
supply all labor and materials. The bid was publicly advertised, sent to CATT, and to
five vendors. At the date of the bid opening on November 19, 2014, the District had
not received any bids.
3. NEW INFORMATION
Staff is asking for authorization to dispense with competitive bidding and negotiate with
a responsive contractor for the supply and installation of the Ancillary Building HVAC
system.
Various California court decisions, including Graydon v. Pasadena Development
Agency, 104 C.A. 3d 631 (1980), hold that if the subject of a contract is such that
competitive proposals would be unavailing or would not produce an advantage and the
advertisement for competitive bids would thus be undesirable or impractical, a public
agency may dispense with competitive bidding.
4. FISCAL IMPACT
This project for the supply of equipment, materials and installation of the SCADA
Building HVAC system is estimated to be less than $27,500. Sufficient funds exist in
the FY14 budget for this project.
5. RECOMMENDATION
A) Adopt a Resolution No. 2014 - 26 directing that further competitive bidding be
dispensed for the supply and installation of a HVAC system for the Ancillary
SCADA Building.
B) Authorize staff to negotiate and enter into a contract for the installation of the
Ancillary SCADA Building, HVAC System in an amount not to exceed $27,500.
