Subject: Consideration of an Ordinance Amending the Miscellaneous Fees
Schedule
1. WHY THIS MATTER IS BEFORE THE BOARD
Only the Board can amend an ordinance.
2. HISTORY
In prior years, the fees for miscellaneous services were described in a Miscellaneous
Fees Schedule ordinance and also in various titles of District Code.
Last year, staff reviewed the costs to provide miscellaneous services, and the Board
adopted an ordinance revising the Miscellaneous Fees Schedule effective March
2008.
Staff has revised all titles of the District code in the past twelve months. One goal of
those revisions was to list all miscellaneous fees in the Miscellaneous Fees Schedule.
Code was modified by referring to fees as listed in the Miscellaneous Fees Schedule,
but the Miscellaneous Fees Schedule has not been updated to include those fees yet.
3. NEW INFORMATION
Staff has reviewed the costs to provide miscellaneous services and recommends no
change to the fees listed in the Miscellaneous Fees Schedule that was adopted last
year.
It is, however, necessary to amend the Miscellaneous Fees Schedule to include the
fees as referenced in the revised District Code titles.
There was a workshop held on July 1, 2009, and a public hearing held on August 5,
2009 to discuss the proposed amendment.
Since the Miscellaneous Fees Schedule was adopted by ordinance last year, it only
can be amended or superseded by the adoption of another ordinance. During the July
1st workshop, the Board stated that the Miscellaneous Fees Schedule be amended by
ordinance in the future.
Attached is a list of proposed fees (Attachment 1) to be added to the Miscellaneous
Fees Schedule so that the schedule is consistent with the previous revisions to District
Code.
Also attached for your reference, is the existing Miscellaneous Fees Schedule
(Attachment 2) and the draft ordinance (Attachment 3).
4. FISCAL IMPACT
There is no material fiscal impact associated with this item.
5. RECOMMENDATION
Adopt the Ordinance amending the Miscellaneous Fees Schedule.

Amending the Miscellaneous Fees Schedule
WHEREAS, the District revised the Miscellaneous Fees Schedule on February 20, 2008 to
update the cost of material and labor to provide the various services performed by District
employees; and
WHEREAS, the fees for miscellaneous services were described in the Miscellanies Fees
Schedule and also in various titles of the District Code; and
WHEREAS, the District Code has been revised to refer to the Miscellaneous Fees Schedule for
all miscellaneous services; and
WHEREAS, the Miscellaneous Fees Schedule needs to be updated to include the fees referred
to in the District Code for miscellaneous services; and
WHEREAS, the Board has directed staff to amend the Miscellaneous Fees Schedule, a copy of
which is entitled Exhibit A and is attached hereto; and
WHEREAS, the Board wishes to impose fees in a fair manner to its customers and others
requesting services; and
WHEREAS, the Board of Directors has held a workshop to discuss the proposed amendment,
published a notice of public hearing in the local newspaper, and make the fees schedule
available at the front counter; and
WHEREAS, the Board of Directors has held a public hearing on August 5, 2009 to receive public
comment on the proposal to update the Miscellaneous Fees Schedule.
NOW, THEREFORE, BE IT ORDAINED that the Board of Directors of the Truckee Donner Public
Utility District does hereby enact the following:
Section 1 The Board of Directors hereby adopts the above recitals as its findings.
Section 2 Payment and collection of services performed and listed on the Miscellaneous
Fees Schedule (Exhibit A attached):
The person, company or organization requesting the service shall pay and the District will
collect the fees listed on the Miscellaneous Fees Schedule for the performance of any of the

services listed thereon. When possible, fees will be collected in advance of District staff
performing such services. Otherwise, the District will bill the person, company or organization
requesting to have such service performed for the fees or actual charges incurred. In cases of
damage to District facilities, the District will bill the responsible party.
Section 3 Methods of payment
Payment may be made by any method that has been established by the District for that
service. Persons, companies or organizations will be informed of the available methods of
payment at the time of the charge or at the time of the billing.
Section 4 Future Miscellaneous Fees schedule updates
District staff will update this schedule each year for the Board's consideration.
Section 5 Effective with the effective date of this Ordinance, all prior resolutions and
ordinances pertaining to the Miscellaneous Fees Schedule are rescinded and of no further
force and effect.
Section 6 This ordinance shall be effective thirty (30) days after the date it was adopted by
the Board of Directors.
Section 7 The Clerk of the District shall immediately cause a copy of this ordinance to be
published in a newspaper of general circulation and posted in three places within the District.
