WHY THIS MATTER IS BEFORE THE BOARD The Board conducts public hearings. The Board must adopt an ordinance to revise Net Metering and a resolution to revise District Code, Title 7, Electric Services. 2. HISTORY California Assembly Bill 58 modified the Net Metering program to include systems up to 1,000 kilowatts or 1 megawatt. This made the program available to both residential and commercial customers. On June 4, 2008, the Board adopted a Resolution to change Net Metering from Domestic-NM to NM. When the ordinance was revised, the following language was also included: "This evaluation and reconciliation for electricity used or generated may be standardized by the District for the 12 month billing period ending with the May billing, rather than using each customer's respective anniversary month." As part of the District code review, a Net Metering Chapter was added to Title 7, Electric Service. This chapter also included the statement above. 3. NEW INFORMATION When the SB1 program first started, staff knew there would be procedural changes going forward. A number of customers have requested the evaluation and reconciliation month be changed to March. The reason being, the vernal equinox (same amount of day and night) occurs in March; after the vernal equinox solar generation increases significantly. By moving the true-up date back to March, this allows the individual generators to use up any banked credits they may have. Additionally the majority of the solar generation will occur after the equinox allowing the customer to build up credits to be used in the up coming winter months. To revise an Ordinance, a public hearing must be held for public review and comment and a new ordinance must be adopted. A Resolution must also be adopted to reflect the change in Chapter 7.64.020.3(B), Net Metering Special Conditions. 4. FISCAL IMPACT There is no direct fiscal impact with this action item. 5. RECOMMENDATION Schedule a public hearing for December 2, 2009 to accept public review and comment on the month change in the Net Metering Process. Stephen Hollabaugh Michael D.
