Subject: Consideration to Designate the President of the Board as Labor
Negotiator for General Manager Contract and Compensation
1. WHY THIS MATTER IS BEFORE THE BOARD
Only the Board can appoint a negotiator.
2. HISTORY
District Code Section 2.48.010 states:
Performance Evaluations and Salary Adjustments for the General Manager - The
General Manager shall be employed by the Board of Directors at a salary established
by the Board. The Board shall work with the General Manager to set performance
goals and objectives. At least annually, the Board will appraise the General
Manager's performance as described in the General Manager's Employment
Agreement with the District.
The General Manager's anniversary date with the District is January 14.
3. NEW INFORMATION
A formal process for dealing with the General Manager compensation adjustment
involves five steps:
• Step 1: Appoint the President of the Board as District Negotiator(This Action)
• Step 2: Meet in Closed Session for the purpose of reviewing the General
Manager's performance over the past year and providing comment and
feedback to the General Manager on his goals for the upcoming year. (This
step is agendized for this evening.)
• Step 3: As a Board, without the General Manager present, meet in Closed
Session to discuss the General Manager performance and establish a
negotiating parameter, if any, for adjustments to the General Manager's
compensation. (This step is agendized for this evening.)
• Step 4: The Labor negotiator and the General Manager will meet to discuss
past performance and any compensation adjustment.
• Step 5: If a compensation adjustment is authorized, an open session Action
Item will be agendized for the next regularly scheduled Board Meeting.
For this step in the process, the Board of Directors needs to appoint a Labor
negotiator to discuss compensation with the General Manager.
4. FISCAL IMPACT
There is no fiscal impact associated with this matter as it relates to appointing a
negotiator.
5. RECOMMENDATION
Appoint the Board President, Jeff Bender, as the labor negotiator in regards to the
General Manager's contract.
