Agenda Item # 9 TRUCKEE O ACTION To: Board of Directors From: Kathleen Neus Date: April 07, 2010 Subject: Consideration of Voting for a LAFCo Special District Member 1. WHY THIS MATTER IS BEFORE THE BOARD This matter involves casting a ballot for a candidate to serve on the Nevada County Local Agency Formation Commission (LAFCo). 2. HISTORY When a vacancy occurs in the position of a special district representative on LAFCo, it has been the practice to begin the process of selecting a replacement by asking the boards of the districts to nominate candidates. After the nomination process is completed, the special districts are asked to cast ballots thus electing a person to fill the vacancy. Board President Jeff Bender was nominated by the Board of Directors at the March 3, 2010 Board meeting. A letter from Director Bender to the TDPUD Board is included as Attachment 1. 3. NEW INFORMATION Attachment 2 is a letter from Katherine Hudson, Clerk/Analyst of the Nevada County LAFCo informing the District of the nominations received for the position of the Special District Member position. The current position is held by John Drew of the Nevada Irrigation District Board. There were three nominations for the Special District Member position: • Ed Beckenbach, North San Juan Fire Protection District • Jeff Bender, Truckee Donner Public Utility District • Nick Wilcox, Nevada Irrigation District Timeline: • The Ballot must be received in the LAFCo office no later than 5:00 p.m. on April 27, 2010 • The votes will be tallied by LAFCo staff in the presence of a witness not affiliated with LAFCo or any nominee, within seven days • Results of the election will be sent to each special district and each nominee 4. FISCAL IMPACT There is no fiscal impact associated with this item. 5. RECOMMENDATION Authorize the Board President to mark the attached ballot in the manner directed by the Board for the election of a Special District Member of the Nevada County Local Agency Formation Commission. As all of you already know, I have been involved in public service and local business in our area for many years. I am also an active member of Rotary International, a licensed professional engineer and a small business owner and employer. My experience as a small business owner with a focus in the fields of energy efficiency, mechanical engineering and sustainable development has provided me the knowledge and familiarity regarding the discouragement of urban sprawl and conservation of our natural resources. I have also served on the Town of Truckee's Planning Commission including acting as Chairman of that commission for a portion of my tenure. During my term of service, the Commission was committed to planned growth within its purview and spent many hours updating the Town's Development Code and reviewing many of Truckee's larger development projects. I believe my background in public service, my ability to work well with others and my varied life experiences make me an excellent candidate as the Special District Member of LAFCo. My name is Ed Beckenbach, and last summer I asked for your vote for the position of Alternate Special District Member of Nevada County LAFCo. I want to thank not only those of you who favored me with your vote, but also those who were kind enough to consider my request but decided to vote otherwise. In the months since then, I have tried to represent all of you on the Commission, contributing to the discussion when I had something to say, and, I hope, usually shutting up when I didn't. I attended the California Association of LAFCos'annual meeting last September in Yosemite (yeah, I know,tough duty) and learned a lot about the wider functioning of all the county LAFCos as they strive to fulfill their mandate to ensure orderly urban growth using logical boundaries and providing for efficient delivery of services. Less known but equally important is the LAFCo mandate, particularly dear to my heart, to preserve agricultural and open spaces whenever possible. l respect John Drew and his work for the Commission, and it was only when I learned that he would not seek another term as Special District Member that I decided to run for that position. I remain convinced of the importance of the LAFCo goals, and of my ability to help things along. Besides, don't you think it would be a little on the wussy side to run for Alternate and then not be willing to step up to the plate when the opportunity arises to run for a position as a regular, voting, responsibility-taking commission Member? i I hope that your District believes that I can, and will, do a good job representing your interests on Nevada County LAFCo as a Commission Member.
