WHY THIS MATTER IS BEFORE THE BOARD Only the Board can amend an ordinance. 2. HISTORY The Board held workshops on April 21, 2010 and May 19, 2010 to review proposed revisions to the Miscellaneous Fees Schedule and to receive public input. 3. NEW INFORMATION Information on this agenda item is being presented during the Public Hearing presentation. 4. FISCAL IMPACT Changes to the Miscellaneous Fees Schedule are not expected to be material to the District. 5. RECOMMENDATION Adopt the Ordinance amending the Miscellaneous Fees Schedule. 7Y)OU&&9;!�cyy-�&,� Mary Ch' an U Micha ley Administrative Services Manager General Manager r TRUCKEE DONNER Ordinance No. 2010 - XX Amending the Miscellaneous Fees Schedule WHEREAS, the District revised the Miscellaneous Fees Schedule on February 20, 2008 and August 5, 2009 to update the cost of material and labor to provide the various services performed by District employees; and WHEREAS, the fees for miscellaneous services were described in the Miscellanies Fees Schedule and also in various titles of the District Code; and WHEREAS, the District Code has been revised to refer to the Miscellaneous Fees Schedule for all miscellaneous services; and WHEREAS, the Miscellaneous Fees Schedule needs to be updated to include the fees referred to in the District Code for miscellaneous services and to provide for further clarification of the charges; and WHEREAS, the Board has directed staff to amend the Miscellaneous Fees Schedule, a copy of which is entitled Exhibit A and is attached hereto; and WHEREAS, the Board wishes to impose fees in a fair manner to its customers and others requesting services; and WHEREAS, the Board of Directors has held workshops on April 21, 2010 and on May 19, 2010 to discuss the proposed amendments, published a notice of public hearing in the local newspaper, and made the fees schedule available at the front counter; and WHEREAS, the Board of Directors has held a public hearing on June 2, 2010 to receive public comment on the proposal to update the Miscellaneous Fees Schedule. NOW, THEREFORE, BE IT ORDAINED that the Board of Directors of the Truckee Donner Public Utility District does hereby enact the following: Section 1 The Board of Directors hereby adopts the above recitals as its findings. Section 2 Payment and collection of services performed and listed on the Miscellaneous Fees Schedule (Exhibit A attached): 1 Ordinance 2010-XX The person, company or organization requesting the service shall pay and the District will collect the fees listed on the Miscellaneous Fees Schedule for the performance of any of the services listed thereon. When possible, fees will be collected in advance of District staff performing such services. Otherwise, the District will bill the person, company or organization requesting to have such service performed for the fees or actual charges incurred. In cases of damage to District facilities, the District will bill the responsible party. Section 3 Methods of payment Payment may be made by any method that has been established by the District for that service. Persons, companies or organizations will be informed of the available methods of payment at the time of the charge or at the time of the billing. Section 4 Future Miscellaneous Fees schedule updates District staff will update this schedule each year for the Board's consideration. Section 5 Effective with the effective date of this Ordinance, all prior resolutions and ordinances pertaining to the Miscellaneous Fees Schedule or miscellaneous service fees are rescinded and of no further force and effect. Section 6 This ordinance shall be effective thirty (30) days after the date it was adopted by the Board of Directors. Section 7 The Clerk of the District shall immediately cause a copy of this ordinance to be published in a newspaper of general circulation and posted in three places within the District.
