Subject: Consideration of Voting for a Nevada County Local Agency
Formation Commission (LAFCo) Special District Member
1. WHY THIS MATTER IS BEFORE THE BOARD
This matter involves casting a ballot for a candidate to serve on the Nevada County
Local Agency Formation Commission (LAFCo).
2. HISTORY
When a vacancy occurs in the position of a Special District Member on LAFCo, it has
been the practice to begin the process of selecting a replacement by asking the
boards of the districts to nominate candidates. After the nomination process is
completed, the special districts are asked to cast ballots thus electing a person to fill
the vacancy.
The current position is held by Mr. Jeff Bender. His term ends in May 2014. On
January 21, 2014, LAFCo sent a letter requesting nomination for a District Voting
Member. The Board was polled and chose not to nominate a member from the
TDPUD Board.
3. NEW INFORMATION
Deborah Gilcrest, Clerk/Analyst of the Nevada County LAFCo informed the District of
the nominations received for the position of the Special District Voting Member
position. The letter and candidate bios are included as Attachment 1.
There were two nominations for the Special District Member position
• Heino Nicolai, Beyers Lane Community Service District, and
• Nick Wilcox, Nevada Irrigation District.
Timeline:
• The ballot must be received in the LAFCo office no later than 5:00 p.m. on April
30, 2014 (Attachment 2);
• The votes will be tallied by LAFCo staff in the presence of a witness not
affiliated with LAFCo or any nominee, within seven days; and
• Results of the election will be sent to each special district and each nominee.
4. FISCAL IMPACT
There is no fiscal impact associated with this item.
5. RECOMMENDATION
Authorize the Board President to mark the attached ballot in the manner directed by
the Board for the election of a Special District Member of the Nevada County LAFCo.

Beyers Lane Community Service District(BLCSD) is responsible for the maintenance and improvement of
approximately five miles of gravel road serving 62 parcels of which 48 are developed.The majority of
road maintenance is accomplished by volunteers with occasional outsourcing of major grading
requirements.The organization of brush clearing and pothole filling parties provides the opportunity to
meet and develop relationships with neighbors that would otherwise not occur and does,to some
extent, form a basis of community.
Since September of 1992 we have resided in our home here on Beyers Lane and I have served on the
Board of BLCSD as a member or officer for approximately 18 years.Although BLCSD is a small district
(both in physical size and budget), I/we have had our share of experiences and challenges. From the
typical financial constraints associated with any organization,to property line disputes(requiring
mediation skills), to law enforcement involvements, personal injury, legal actions and negotiations with

Bio for Nick Wilcox
Nick Wilcox was elected to the Nevada Irrigation District Board in November 2008
representing Penn Valley, Rough and Ready and parts of greater Grass Valley. He
serves on numerous NID committees, including the Engineering Committee and the
Water and Hydroelectric Operations Committee. He brings wide experience in the
water industry to his elected position. He worked for many years for a local engineering
firm (Cranmer Engineering) as an environmental chemist. He is now retired from the
State Water Resources Control Board where he was a supervising Environmental
861entist in`Wo'Division of Water Rights, working on Bay/Delta water quality issues.

Dear Truckee Donner Public Utility District Directors,
I write to introduce myself to you as a candidate for one of the special district positions on the
LAFCo Commission. I am currently a Director of the Nevada hrrigation District representing
portions of western Nevada County, including Penn Valley, Lake Wildwood, Rough and Ready and
parts.of greater Grass Valley. I have served in this capacity since 2008 and find the work both
interesting,and challenging.
I have been involved with water issues for most of my professional career. I worked with Crammer
Engineering in Grass Valley for many years as Director of the Water Analysis Laboratory,
providing analytical services to many of the special districts that belong to Nevada County LAFCo.
After leaving Cranmer, I took a position with State Water Resources Control Board in the Division
of Water Rights,where I dealt with state-wide water quality issues. I ultimately became chief of the
Bay-Delta program.where I gained a detailed knowledge of water districts throughout the entire
state and an appreciation of the complex political issues around water.
My experience has been useful on the NID Board and I trust that it would be useful to LAFCo as
well. Accordingly, I ask.for your support of my candidacy for the-LAFCo commission. As a
commissioner,.I pledge to support the interests of Special Districts,both large and small and on
both sides of Donner Summit.
