As of the January 5, 2000 board meeting, the California Environmental Quality Act(CEQA)review
period will be closed for the Brockway Well negative declaration. The State Clearinghouse review
period will close on December 31, 1999, I contacted the State Clearinghouse and no comments were
received from the agencies on their distribution list. The Board of Directors has scheduled a Public
Hearing for January 5, 2000. The District did receive one written comment letter from the Town of
Truckee. The comment letter is included with this report.
The comment letter from the Town of Truckee include comments on land use and planning, aesthetics,
and the adjacent church property. A response letter has been prepared and forwarded to the Town.
The response letter is included with this report.

RECOMMENDATIONS
Providing no comments are received at the January 5 public hearing that can not be adequately
addressed at the public hearing,I recommend the Board of Directors take the following actions:
Adopt the Final Negative Declaration.
Approve the project for purposes of CEQA.
Authorize the filing of the Notice of Determination with the Office of the Nevada County Clerk
and the Governor's Office of Planning and Research.
Adopt the De Minimis Impact Finding and authorize the filing of the Certificate of Fee
Exemption with the Nevada County Clerk.
Adopt a finding that the draft documents as circulated and the negative declaration reflect the
District's independent judgement.

PROJECT DESCRIPTION:
Acquisition of property for and construction of a new production well, well pump station, and
pipeline.
Finding: It is hereby found that the above named project will not have a significant effect upon
the environment.
Initial An initial study of this project was undertaken and prepared in accordance with
Study: Article V of the District's local environmental guidelines and Section 15063 of the
EIR Guidelines for the California Environmental Quality Act for the purpose of
ascertaining whether this project might have a significant effect upon the
environment. A copy of such initial study is attached hereto and incorporated herein
by reference. Such initial study documents reasons to support the above finding.

Re: Brockway Well environmental review
Dear Peter,
Thank you for the opportunity to review the proposed negative declaration for the Brockway
Well project. The Town supports the adoption of a negative declaration for the project based
upon the current initial study with the following comments:
1. Land Use and Planning- The initial study, page 9- section 1, states that the well
project requires approval of a special use permit from the Town. It is our view that
California Government Code Section 53091 excludes this project from the
requirement of obtaining a special use permit from the Town. In addition,
Government Code Section 66426.5 excludes the division of property for the purpose
of the PUD's acquisition of the well site from the requirement of a parcel map subject
to the Town's review and approval. We would request that a ertiftcate of compliance
be recorded on the remaining parcel held by the Church following the acquisition of
the well site. We would be happy to discuss the procedures to complete the
certificate of compliance with your project engineer.
2. Aesthetics- The proposed well building will be visible from a public street and
other properties in the area. The design of the building is important to assure that it
does not detract from the appearance of the area, resulting in aesthetic impacts. In my
view the design of the Glenshire Well building was excellent for its setting and
avoided what could have been a negative visual impact. We would request that the
Brockway Well project incorporate architecture and site design that is compatible
with the neighborhood to avoid negative visual impacts. The Truckee Design
Guidelines provide recommendations regarding building material and site design that

may be applicable to this project. The Planning staff will be happy to review these
guidelines with your project engineers and provide advice regarding the design issues.
3. General Comments- A site plan was not provided with the initial study routing.
For the purpose of the Town's comments I have assumed that the well project will not
affect access or remove parking or landscaping associated with the Seven Day
Adventist Church. If the project would impact these church related facilities, please
let me know as soon as possible.
