Wright, General Manager RECOMMENDATION: A) Determine the bid received from Tiber Corporation for the District Administration Stucco Repair project to be non-responsive. B) Authorize the General Manager to execute a construction contract with JR Construction, for the District Administration Stucco Repair project in the amount of $248,388.92, plus a change order authorization of 10%, for a total contract amount not to exceed $273,227.81. BACKGROUND: The District Headquarters building was constructed in 1986, which houses customer service, the boardroom, administrative offices, and most support services. Since original construction, the stucco exterior walls have endured the variable weather elements typical in the Northern Sierra Nevada, including harsh winds, heavy rain and snow, and direct sun exposure. The exterior walls facing the west aspect are visibly damaged with bubbling and peeling areas in need of repair. Other cracks in the stucco finish have been identified in areas of the south and east aspects of the building, also in need repair. Staff assembled the scope of exterior stucco repair work recommended on the exterior walls of District Headquarters. All glazing and penetrations would be sealed, and exterior paint with an elastomeric masonry stucco paint would provide a final sealing layer of protection while restoring the building's aesthetic to a uniform color. On April 2, 2024, a request for bids for the District Administration Building Exterior Stucco Repair project was issued and published in the local paper, with a bid opening held on April 22, 2024. Page 1 of 3 Page 175 of 449 ANALYSIS AND BODY: Three bids were received. Two bids were determined responsive. The variance between bids received is significant. Staff has determined the apparent low bid submitted by Tiber Corporation to be non- responsive as the bid does not comply with the prescribed bid instructions requiring accurate unit prices. Unit prices appear unevenly weighted, with allocated costs for unit prices not reflective of the unit price for the listed scope of work items within the bid schedules (Bid Document Pg 11, Paragraph 19.C). Rather than submitting a bid in which the individual line items reflect the actual scope of work described, the bid schedule line items submitted by Tiber Corporation were completed with unit price values divided evenly and distributed across the listed scope of work items to reach the sum of the bid schedule. Pg.2 of Bid Documents The DISTRICT reserves the right to reject any and all bids, waive any irregularities or informalities in the bidding, be the sole judge of the suitability of the items offered, and accept any bid that it determines to be in its best interest. Pg.8 — paragraph 12.C. C. All Bids must be submitted on the Bid Forms furnished by the DISTRICT, and the Bidder is solely responsible to diligently follow all directions required by the DISTRICT with respect to the completion and submission of the Bid Forms, including these Instructions and as required under the Bid Documents. A Bid not submitted on the form furnished by the DISTRICT, or that does not comply with the DISTRICT's directions with respect to the completion and submission of the Bid Forms, may be considered non-responsive by the DISTRICT in its sole discretion. The DISTRICT reserves all rights to reject any or all Bids, and to waive any minor irregularity in the completion of the Bid Forms, within its sole discretion. Pg.11, paragraph 19.0 In evaluating Bids, the DISTRICT will consider whether or not the Bids comply with the prescribed requirements, and include such Alternates, unit prices and other data, as Page 2 of 3 Page 176 of 449 may be required in the Bid Forms and supplements thereto. Further, the DISTRICT may reject any Bid, which, in its opinion, does not accurately reflect the cost to perform the Work. The DISTRICT may reject as non-responsive any Bid which unevenly weights or allocates costs, including but not limited to overhead and profit to one or more particular bid items. Sections within the published bid documents support the District's option to reject the low bid received from Tiber Corporation as non-responsive. This was reviewed and approved by the District's Legal Counsel. GOALS AND OBJECTIVES: District Code 1.05.020 Objectives: 1. Responsibly serve the public. 6. FISCAL IMPACT: The Electric Utility's capital reserve fund balance of$10.8M has sufficient funds for the proposed services not to exceed $273,227.81. The extent of these stucco repairs are similar to new siding and extending the life of the building, and are accordingly a capital expenditure. ATTACHMENTS: 1. All WORK shall be performed to TDPUD construction standards outlined in the Project Specifications Manual provided. BID SCHEDULE B: Building Exterior South Wall Stucco Crack Repair and Paint All applicable sales taxes, State and/or Federal, and any other special taxes, patent rights, disposal fees or royalties shall be included in the prices quoted in this bid.
