Holzmeister Date: July 28, 2000 Donner Lake water system issues A public meeting has been scheduled and advertised to discuss Donner Lake water issues. I will be prepared to make a brief introduction describing why we are considering this matter at this time and something about the need for our District to adhere to certain water system construction and operating standards. If the input from the public strongly supports further involvement by the District, there are a few initial steps I would suggest you consider. 1. We need to verify our authority to serve water in that territory. SR Jones, Executive Director of Nevada County LAFCo is on vacation until Monday, July 31. 1 will call her and begin researching this issue. 2. We need to understand the role of the California PUC. What is the precise territory covered by Donner Lake Utility Company's certificate? I do not know if PUC approval is needed for our District to replace Donner Lake Utility Company(Del Oro). 3. We need to prepare a preliminary Donner Lake water system rehabilitation plan describing the facility improvements, a budget, a schedule and a source of funding. 4. We then need to confirm the interest of the Donner Lake customers. Initiating these steps may be the appropriate action for the Board to take Wednesday evening, assuming the public asks us to become involved. If, on the other hand, the public asks us to remain out of this issue,the Board can certainly do just that. Short term relief The public may ask the District to take steps to relieve the short-term need for water. We can establish a community water spigot near Donner State Park if the Board feels such action appropriate.We may be able to take other helpful actions if it is appropriate for us to do so. We ate writing to raquest your aid in resolving the problems the residents cf Donner Lake, in the Town Of Truckee,have had with the Donner Lake Water Company_ The Department of Health Services(DHS)and the Public Utilities Commission (PUC',) are un,,,lilac or unable to solve these problems,so we ate Honing to you as a last resort, v The Donner Lake Water Company is the sole provider of water to 1232 connections at Donner Lake. The company has been owned since 1993 by the Del Oro Water Company, which is in turn owned by Robert Fortino: Roughly one third of the customers are full-time residents or businesses; the rest are second homeowners or the owners of vacation rental properties T Tie customers pay a yearly flat rate for water, regardless of actual usage. Water customers in the rest of the Town are served by the Truckee-Donner PUD. The problems we have had with the Donner Lake Water Company have occurred in three areas: water quality and safety,water availability,and the inappropriate use of ratepayers' funds. The PUC and the DHS have consistently either ignored these problems or have failed to enforce their regulatory decisions, and have given the impression of being solely concerned with facilitating Mr. Fortino's business and unconcerned with the welfare of the publ is they are charged with protecting_ In this letter we will document the specific problems with the water company and the actions and inactions of the PUC and the DHS. 1. Water quality The Donner Lake Water Company was notified by the DHS in 1991 and again in 1992 that"it must provide a plan and schedule for modification of its existing treatment facilities by June 29, I993" as a result of noncompliance with the California Code of Regulations, Title 22, Chapter 17, Surface Water Filtration and Disinfection Treatment Regulations, and on August 13, 1993 was served Compliance Order 06-001, as a result of continued failure in meeting the regulation(Attachment A). Del Oro Water Company purchased the Donner Lake Water Company in 1993, with full knowledge of the Compliance Order. On November 30, 1994,the water company issued a Notice of Proposed Rate Increase, requesting funds to"construct a SLI million treatment plant facility." Since most second homeowners could be expected to be at Donner Lake for the holiday, the notice appears to have been timed so that most customers would not see it until too late to comment. On July 6, 2000, the water company published a notice in the local newspaper, the Sierra Sun, regarding a Water Conservation and Rationing Plan, however the notice didn't state which water company and to which customers the notice was for , (Attachment H). At the present time,the Truckee Planning Department has approved plans for the filtration plant, but a requested easement from the Donner Lake Village for the intake pipe between Donner Lake and the plant is the subject of litigation, with no indication of when or even if this obstacle will be overcome. We continue to be under a Boil Water Notice and the water in our system continue; to be treated,as it has been for many years, unmonitored and with toxic levels of chlorine. In addition to failing to build the filtration plant, the Donner Lake Water Company has consistently failed to inform its customers of the poor condition of the water. For example, when we eaIled the water company office in Truckee on June 291(we spoke to "Debby")to complain about discolored, foul-tasting water, we were not informed of the Boil Water Notice of June 2e We finally received the Notice on July I,nine days after it had been issued. Many customers 'we know have never received the notice,either by mail or by hand delivery. Although the DHS has required the water company to issue its customers quarterly notices of noncompliance, the company has issued these notices only yearly(Attachment I), using benign language, like doesn't comply", rather than what Mr. Morehouse wrote,that"the water system faits to meet tF,e treatment requirements".' The context of Mr. Morehouse's statement was that he felt that hir Fonino was adequately alerting customers. In a finding from a recent Grand Jury hearing, the DHS +vas required to instruct Donner Lake Water Company to re issue a Quarterly Public Notification using the proper alerting language. (Attachment.I) In addition while the Safe Drinking Water and Toxic Enforcement Act of 1986 (Proposition 65) requires California businesses to warn the public quarterly of potential public exposures to toxic chemicals, urrii the summer of 1999,the water company refused to divulge to customers the amount of MTBE it, the drinking water. (A study done in 1997 by a John Reuter from the University of California, Davis, found MTBE levels in Donner lake of 12 ppb (Attachment K). The maximum DNS- altoiwcd. level is 13 ppb (Attachment L). . 2. Water availability The problem of water availability is closely tied to that of water safety, since low water pressure and water outages allow bacterial infiltration into the water system. The Donner Lake Water Company customers have had periodic water outages for years. These outages vary in frequency depending on location,but are well-known to all residents. They are most frequent in the summer, particulary on weekends and holidays, when usage is closer to a normal full residential demand. In a letter to the PUC dated July 31, 1999, we documented three outages of six hours or more that summer. This year residents on Denton Ave. have had outages since 'Dept. The outages,according to the water company, at_- due to undersize intake and transmission litres, as well As multiple leaks in the lines and tanks, The lines, Which are Severely deteriorated, have never been replaced since the system was constructed. The intake Iine is scheduled to be replaced when and if the filtration plant is v er built. Despite the ongoing and well-documented inadequacy of the water system to serve the existing customers,the Donner Lake Water Company continues to hook up new c xstomers, while the DHS has insisted that there is no shortage. This appears to be in direct vioiation of the Compliance Orders of September 22, 1999 and June 23, 2000, The Order states under the "VIOLATION"section, Section 64568, that"water service connection may be added to a distribution system only if the water system will comply with section 64562,"'which states "California Code Regulations require water supplier to have sufficient available water from the water sources and distribution reservoirs to supply adequately, dependably, and safety the total requirements of all users under maximum demand conditions."' The Nevada County Department of Envirorm ental Health, in a series of letters beginning in 1995, informed the DHS of the ongoing problems of outages mud questioned the quality and quantity of available water. (Attachment M) Despite these warnings the DHS has allowed the water company to issue "willingness to serve"notices to two new subdivisions new Donner Lake, the Fciton Woods/Donner Creek Woods and Wolfe Estates developments. A letter from the DIiS dated April 10, 1995, confirmed the creation of the new connection and stated that they would "not create new problems to existing system as far as quality and quantity of water'."As recently as in its Citation Notice of June 28,2000, the DHS states that since 1993,"no water outages were previously reported to the Department". The problem of inadequate water delivery appears to extend to other Del Oro Water Company subsidiaries as well. For example, customers of the Magalia Water Utility have been on water rationing and under a Boil Water Notice since Apri I, 2000. (Attachments N�. 3. Use of funds Our information regarding the water company's use of the funds collected from the ratepayers is sketchy at this point_ We are attempting to obtain copies of the annual PUC filings from the Donner Lake Water Company and other water companies owned by the DPl Oro water company. We have received partial copies of filings from the Donner Lake Water Comaazy 'Compliance Order 01-09-99-CIT, September 22, 1999, pp. 2 and 4. 'Ibid, p. 1. In addition S77 Company and hence to ,000 was transferred from the Denney Lake WatCr COlnpany tO the Safor Corporation,a separate company owned by Robert Fortino. These sorts of financial irregularities do not a Companies. A source in the P appear limited to the Donner take Water Paradise area,who asks to remain anonymous, reports that the Paradise Pines Water Company.owned by the Del Oro Water Company, raised S 1,000,00C between 1991 and 1992 to carry out improvements on that system; to date that work has net been done. This source reports that Mr.Fortino and his companies appear to be heavily indebted; perhaps this explains the shifting of funds from company to company, 'Flu S information is at present unsubstantiated. *' 4.Actions of the PUC and the DHS a Based on a letter written to the PUC on July 31, 1999 and published in the Sierra Sean (Attachment O) the Donner Lake Water Company and its regulation by the PUC and the DHS were investigated by the Nevada County Grand Jury(Attachment p). The Grand Jury found that the DHS `has maintained a lenient position by excusing the company for missed deadltnrs and noncompliance and continuing to grant it excessive time extensions to complete the "w a water treatment facility without fines and penalties."9 This attitude of leniency is seconded b5 David Landcaster previously of the DHS, who reportedly authored the Citation of September 24, 1999 (which went out over the signature of less Morehouse), Mr, Landcaster apparently resigned from the DHS, and informed the Nevada County Environmental Health Department that he believed that the DHS did not plan to enforce the citation. Despite the in ability of Mr. Fortino to adequately manage the water companies he already owns,the PUC continues to support his continued acquisition of more water companies, while they allow him to let them fall in disrepair or remain in a state of non construction. Where does he get the money? On July 10,2000,a public meeting was held to discuss a proposed water rationing plan and the water crisis generally. At that meeting Mr. Fortino sat at the podium flunked by Burt Ellsworth from the DHS and Leslie Tench from the PUC. Mr_ Fortino chaired the meeting, Mr. Ellsworth and Ms. Tench spoke when instructed to do so by Mr. Fortino. During their prepared statements and during the question and answer period, both Mr Ellsworth and Nis. Tench maintained a position of total support for Mr. Fortino and the water company,despite the unanimous response of dissatisfaction with the water company expressed by the large audience. This last assertion repeatedly drew angry responses from the audience, tnanv members of which have complained repeatedly over the years to the PUC,the DHS, and the company. 1 have bad several g-mgils with Leslie Tench, and they had a hostile and repremanding tone and assisting very little. Following the meeting the Mayor of?ruckee, Msis Schneider, wrote a letter to the editor published in the Sierra sun on July 13, 2U00 which stated "The meeting held Monday(and attended by a standing-room-only crowd of concerned residents)regarding the water issues at Donner Lake clearly showed a lack of leadership among the various agencies to deal with the ongoing issues."(Attachment Q) The D? 4S and the PUC continue to maintain that they have received few complaints,disregarding the continuous pt ess coverage in the "Sierra Sun, the Sacramento Bee, and the Reno Gazette Journal". (The Sierra Sun now publishes articles under a special"Water Crisis"logo.'. The Mayor called a closed door meeting with many involved agencies to problem solve some of the short term water issues, as a result of the complete lack of short term planning from the DHS, PUC or Donner Lake Water Company(Attachment R), Our personal dealings with the agencies have reinforced the opinions expressed by the Mayor and the Grand Jury. On June 29,2000 one of us(Emilie)spoke with Mr Ellsworth of the DHS. I informed him of the problems with poor water quality, outages, lack of notification, lack of repair of leaks,two rate increases with no result,and lack of progress . Mr. Ellsworth completely defended the water company. I specifically requested that the DHS supervise a collection of water samples sent to the DHS for testing based on the rational that I could detect a wide variation in the levels of chlorination in the water,and that Donner Lake Water Company has had a very long and poor track record for doing tasks such as fixing leaking pipes, responding to calls,alerting people to poor water conditions, and frequent staff turnovers.. (Currently these samples are provided by water company employees without any independent verification as to their source. Mr Ellsworth refused this request, stating that "I completely trust the people at Donner Lake Water Company to take the samples correctly." As a result of my feeling that Mr. Ellsworth was ignoring public concerns I wrote a letter of protest to the PUC.. (Atttschmeat S) Several of us who were attending the July 10 meeting observed Mr. Fortino and Jess Morehouse of the DHS dining together in an atmosphere that appeared to he one of camaraderie. The appearance, at least,of this dinner was one of impropriety. This did not appear to be a meeting with an agency that is to oversee a chronically delinquent owner of a privately held water company who has been in non compliance for 7 veers,but a party of friends. At best there should be some pretense of an overseeing agency conducting business with some professionalism, keeping the consumers interest at hand, Of interest, In our monthly water bill, then is a fee taken for both the DHS and the PUC. I do not think that we have been getting what we paid for. There arc many more should you like to look.(Attachment T) We ask the Attorney General to do the following. 1. Conduct a full audit of the Donner Lake Water Company, the Del Oro Water Company,the Safor Corp_, and Robert Fortino, and identify how the funds raised by the rate increases of the last seven years have been used. 2. Investigate the relationship between Robert Fortino, the PUC, and the DHS, to determine the reasons that the Donner Lake Water Company has been allowed w remain out Of compliance for seven years—although multiple citations have been issued there has been no consequence for Mr. Fortino or his companies and no discernable effect on his actions. 3. See to it that the citizens of Donner Lake have a safe and reliable source of drinking water, before someone is harmed or dies. The agencies charged with { doing this seem unable to accomplish it. Perhaps you can. 4. Find out why DOWC is allowed to drag their feet in providing a fundamental need in life, clean, safe, drinkable water,yet they collect fees, buy land, spend money, buy companies,allow the physical plant of a water utility to become derelict and unusable and then charge consumers to rebuild it in their time frame, to their specifications, and for their profit, 5. Investigate why consumers are submitted to the health hazards of contaminated drinking water without notice and chronic and unmonitored chlorination of said water for an extended length of time(7 years) . Why Del Oro has been ncgligent with regard to the Domestic Water Quality and Monitoring Requirements of the Surface Water Treatment Rule, Chapter 15, Article 3, and Chapter 17,articles 1,2,3,5,6 and 8 with regards to Primary Drinking Water Standards-Bacteriological Quality, Surface Water Treatment,Treatment Requirements, Watershed Protection and Requirements and Performance Standards, Filtration, Disinfection, Monitoring Requirements, Operation,Reporting, and Public Notification 6.
