We are in the process of evaluating the acquisition and upgrade of Donner Lake water system. The
process involves three separate but related efforts moving along simultaneously. The three
processes are CEQA, assessment district formation and acquisition.We have retained consultants to
work on these efforts. Eventually, what emerges from these consultant efforts is the information we
need to make a decision.
We will eventually get to the point where we mail a notice to property owners at Donner Lake asking
them to approve formation of an assessment district. They will be, in effect, asked to agree to being
assessed for the cost of water system acquisition and improvement. By the time that notice is sent
out we will have a highly refined estimate of the cost of acquisition and upgrade and the amount that
each parcel will be assessed.
However, we cannot get to that point without first satisfying other procedures. As is explained in the
attached letter, we must first request authorization from the Town Council and from the Placer
County Board of Supervisors to form an assessment district. The attached resolutions accomplish
that.
RECOMMENDATION
I recommend that the Board adopt the following resolutions and authorize that certified copies be
transmitted to the Town of Truckee and the Placer County Board of Supervisors respectively:
• A resolution requesting consent of the Truckee Town Council to form and acquire
improvements for the benefit of Donner Lake Water Assessment District No. 00-1
• A resolution requesting consent of the Placer County Board of Supervisors to form and
acquire improvements for the benefit of Donner Lake Water Assessment District No. 00-1

Dear Peter:
As we discussed this morning, proceedings for the formation of an assessment district are
officially commenced by the adoption of a resolution declaring the intention of the legislative body to
form the district and to order certain improvements. However, pursuant to the provisions of
California Streets and Highways Code Section 10104, if the entity proposing to form assessment
district is not a city or a county, it must first obtain the approval of the legislative bodies of the cities
and/or counties in which the proposed assessment district is located. It is my understanding that
proposed Assessment District No. 00-1 includes territory within the boundaries of the City of
Truckee as well as unincorporated territory in Placer County, and will therefore need to obtain the
approval of the Truckee City Council and the Placer County Board of Supervisors.
In connection with obtaining such approval, California Streets and Highways Code
Sections 10104 requires that the proposed resolution of intention, together with a map indicating the
boundary line of the proposed assessment district, must be submitted to the respective legislative
bodies. In order to satisfy this requirement I have enclosed herewith the following documents:

An Assessment District And The Acquisition Of Certain Improvements.
Assuming they are otherwise satisfactory to you, the first two resolutions (but not the third
resolution) should be placed on the agenda for the next available meeting of the Board of Directors of
the District. In connection therewith, two exhibits will need to be attached to each of these
resolutions. The first exhibit, Exhibit A, is a description of the territory proposed to be included
within the Assessment District. In the absence of any other convenient description, the boundary
map being prepared by the Assessment Engineer will serve this function. The second exhibit,
Exhibit B, is the form of the proposed resolution of intention (the third item referred to above).
After these two resolutions have been adopted by the Board of Directors of the Truckee-
Donner Public Utility District, a certified copy of the appropriate resolution should be sent to the City
Council or Board of Supervisors, as applicable, along with Exhibit A and Exhibit B (and also the
boundary map of the District if it is not used as Exhibit A). There should also be transmitted to the
City Council or Board of Supervisors the form of resolution pursuant to which approval would be
granted(items 4 and 5 in the above list). The transmittal letter could say something along the lines of
the following:
The Truckee-Donner Public Utility District is considering the formation of an
assessment district and the acquisition of certain water system improvements located
within your jurisdiction. Pursuant to the provisions of California Streets and
Highways Code Section 10104, the [City Council] [Board of Supervisors] must
indicate its approval before the District can formally commence such proceedings.
The Board of Directors of the District has adopted a resolution (a certified copy of
which is enclosed herewith) requesting such approval. The territory proposed to be
included within the District is described in Exhibit A, and the proposed form of
resolution of intention is attached as Exhibit B [a map showing the boundaries of the
proposed assessment district is also included. USE THIS LANGUAGE ONLY IF
THE MAP IS NOT EXHIBIT A.] Also included for your convenience is the form of
a resolution by which the [City Council] [Board of Supervisors] could indicate its
approval.

RESOLUTION NO.
A RESOLUTION OF THE BOARD OF DIRECTORS OF THE
TRUCKEE-DONNER PUBLIC UTILITY DISTRICT DECLARING
ITS INTENTION TO TAKE PROCEEDINGS PURSUANT TO THE
MUNICIPAL IMPROVEMENT ACT OF 1913, AND MAKING
CERTAIN FINDINGS AND DETERMINATIONS IN
CONNECTION THEREWITH, ALL RELATING TO THE
FORMATION OF DONNER LAKE WATER ASSESSMENT

WHEREAS, the Board of Directors of the Truckee-Donner Public Utility District(the
"District") desires to provide to acquire a water supply system generally described in Exhibit A
attached hereto and made a part hereof(the "Improvements") and to order the formation of an
assessment district in order to pay the costs thereof under and pursuant to the provisions of the
Municipal Improvement Act of 1913 (the"1913 Act"); and
WHEREAS,the proposed assessment district, if it is formed, is to be known and designated
as Donner Lake Water Assessment District No. 00-1; and
WHEREAS, the proposed boundaries of the Assessment District are shown on a map which
indicates by a boundary line the extent of the territory proposed to be included in the Assessment
District,which map is designated"Proposed Boundaries of Donner Lake Water Assessment District
No. 00-l" (the"Map"),which Map is on file in the office of the Clerk of the Board of Directors; and
WHEREAS,this Board of Directors intends to comply with the requirements of by the
Special Assessment Investigation,Limitation and Majority Protest Act of 1931 by proceeding under
Part 7.5 of Division 4 of the California Streets and Highways Code ("Part 7.5 of the 1931 Act"); and

WHEREAS,the District has requested and received from the City Council of the City of
Truckee and from the Board of Supervisors of the County of Placer consent to the initiation of
proceedings for the formation of the Assessment District and the acquisition of the Improvements;
NOW,THEREFORE,the Board of Directors of the Truckee-Donner Public Utility District
DOES HEREBY FIND, DETERMINE, RESOLVE, AND ORDER as follows:
SECTION 1. The above recitals, and each of them, are true and correct.
SECTION 2. The Map is approved and the Clerk of the Board is authorized to record the
Map in the office of the County Recorder, County of Nevada, and the office of the County Recorder,
County of Placer..
SECTION 3. The Improvements consist of the acquisition of a water supply system as
generally described in Exhibit A.
SECTION 4. The Board of Directors hereby declares its intention to form the Assessment
District, to order the acquisition of the Improvements and to make the expenses thereof chargeable
upon the area included within the Assessment District.
SECTION 5. The Board of Directors further declares its intention to levy a special
assessment upon the land within the Assessment District in accordance with the respective special
benefit to be received by each parcel of land from the Improvements. There shall be omitted from
special assessments all streets and alleys owned by any governmental agency as shown on the Map.
In compliance with Article XIIID, Section 4 of the California Constitution,this Board of Directors
finds that all such governmentally-owned streets and alleys will receive no special benefit from the
Improvements.
SECTION 6. This Board of Directors finds and determines that before ordering the
acquisition of the Improvements it shall take proceedings pursuant to Part 7.5 of the 1931 Act and
pursuant to the 1913 Act.

SECTION 7. The District Engineer of the District is hereby appointed the Engineer of

Assessment Engineer. The Assessment Engineer is hereby authorized and directed to make and file
with the Clerk of the Board a written report with regard to the 1913 Act (the"Report"),which Report
shall comply with the requirements of Sections 2961 and 10204 of the California Streets and
Highways Code.
SECTION 8. Following the acquisition of the Improvements and the payment of all
incidental expenses in connection with the formation of the Assessment District and the issuance of
bonds, if any,pursuant to the Improvement Bond Act of 1915, any surplus remaining in the
improvement fund established for the Assessment District shall be used as determined by the Board
of Directors as provided in Section 10427 of the Streets and Highways Code.
SECTION 9. Bonds,bearing interest at a rate not to exceed 12 percent per annum,will be
issued in the manner provided in the Improvement Bond Act of 1915 to represent the unpaid
assessments. The number of annual installments shall correspond to the number and principal
amounts of the bonds maturing or becoming subject to mandatory redemption each year. The last
installment of such bonds shall mature not later than 39 years from the second day of September next
succeeding twelve months from their date.
SECTION 10. The provisions of Part 10.5 of the and Highway Code of the 1913 Act,
providing an alternative procedure for the division of land and bonds, shall apply.
SECTION 11. Except as specifically otherwise provided for herein,the Improvements shall
be made and ordered pursuant to the provisions of the 1913 Act.
SECTION 12. The Board of Directors hereby determines that the District will not obligate
itself to advance available funds from its treasury to cure any deficiency which may occur in the
bond redemption fund established for the Assessment District.

SECTION 13. The public interests will not be served by allowing the property owners to
take any contract to be let for the construction of the Improvements, and no notice of award of
contract shall be published.
SECTION 14. This Resolution shall take effect immediately upon its adoption.

PROCEEDINGS AND THE ASSUMPTION OF JURISDICTION
BY THE TRUCKEE-DONNER PUBLIC UTILITY DISTRICT IN
CONNECTION WITH THE FORMATION OF AN ASSESSMENT
DISTRICT AND THE ACQUISITION OF CERTAIN
IMPROVEMENTS
WHEREAS,the Board of Directors of the Truckee-Donner Public Utility District is
contemplating the formation of an assessment district and the acquisition of certain improvements in
the City of Truckee (the"City") under the provisions of the Municipal Improvement Act of 1913 (the
"1913 Act"); and
WHEREAS,pursuant to the 1913 Act,the consent of the City Council of the City is required
for the above proceedings; and
WHEREAS,the Truckee-Donner Public Utility District, in accordance with Section 10104 of
the Streets and Highways Code,has submitted to this City Council the Truckee-Donner Public Utility
District's proposed Resolution of Intention and a map indicating the extent of the territory to be
included in the proposed assessment district;
NOW, THEREFORE,the City Council of the City of Truckee DOES HEREBY RESOLVE
as follows:
SECTION 1. The City Council hereby approves of and consents to the initiation of
proceedings and the acquisition of improvements, as described by said proposed Resolution of
Intention,within the area shown on said map.
SECTION 2. Said Resolution of Intention is approved with the understanding that said
Resolution may be modified or amended in order to carry out the purpose of the assessment district
and the consent of this City Council hereby is given to the exercise by the Board of Directors of the
Truckee-Donner Public Utility District of exclusive jurisdiction over all proceedings necessary or
convenient for the purpose of consummating the same, all in accordance with the provisions of the
1913 Act.
SECTION 3. The City Clerk hereby is authorized and directed to certify to the adoption of
this resolution and to deliver two certified copies thereto to the Truckee-Donner Public Utility
District.

WHEREAS,pursuant to the 1913 Act,the consent of the Board of Supervisors of the County
is required for the above proceedings; and
WHEREAS, the Truckee-Donner Public Utility District,in accordance with Section 10104 of
the Streets and Highways Code,has submitted to this Board of Supervisors the Truckee-Donner
Public Utility District's proposed Resolution of Intention and a map indicating the extent of the
territory to be included in the proposed assessment district;
NOW,THEREFORE,the Board of Supervisors of the County of Placer DOES HEREBY
RESOLVE as follows:
SECTION 1. The Board of Supervisors hereby approves of and consents to the initiation of
proceedings and the acquisition of improvements, as described by said proposed Resolution of
Intention,within the area shown on said map.
SECTION 2. Said Resolution of Intention is approved with the understanding that said
Resolution may be modified or amended in order to carry out the purpose of the assessment district
and the consent of this Board of Supervisors hereby is given to the exercise by the Board of Directors
of the Truckee-Donner Public Utility District of exclusive jurisdiction over all proceedings necessary
or convenient for the purpose of consummating the same, all in accordance with the provisions of the
1913 Act.
SECTION 3. The Clerk of the Board of Supervisors hereby is authorized and directed to
certify to the adoption of this resolution and to deliver two certified copies thereto to the Truckee-
Donner Public Utility District.
