Subject: Election of aftemate District Member to Nevada County LAFCo

Bob Nix currently serves as the alternate special district member of Nevada County LAFCo. Bob has
decided not to seek re-election to the Penn Valley Fire District, so he will no longer be eligible to
serve on LAFCo. Therefore,we must select a new alternate special district member of LAFCo.
Please review the attached letter from SR Jones dated October 17, 2000. It describes a revised
method for electing the alternate special district member of LAFCo. It appears that selection of the
new member will be conducted by the special district selection committee, made up of the presiding
officer of each special district in Nevada County. The meeting of that committee is scheduled for 1:00
PM on December 4, 2000.
RECOMMENDATION
I recommend that the Board discuss how we will be represented at that meeting and how the
representative will vote on selection of a new alternate special district member.

attend. Since there are twenty-five Nevada County independent special districts,
attendance by at least thirteen district representatives will be required to establish
a quorum.
To assure compliance with the statute governing district elections, each district is
requested to notify the LAFCo office by November 21, 2000, of the members of
its legislative body and the name of the person selected to represent that district
at the meeting. Attendees will be required to register their attendance, and the

meeting will not be convened until a quorum is declared present.
The meeting will be open and must comply with all applicable provisions of the Ralph M. Brown
Act. The first item of business for the selection committee should be election of a chairperson to
manage the election. Nominations will be made from the floor and voting will be by written
ballot. Each official district representative shall have one vote, and election will be by a majority
of the votes cast.
Meanwhile, I hope you will all join me in wishing Mr. Nix success and satisfaction in his future
endeavors and in expressing to him our appreciation for his dedicated service to the citizens of
Nevada County.

(2)Adopts regulations affecting the functions and services
of special districts.
In addition to the commission members selected pursuant
to Sections 56325, 56329, and 56330, two commission
members shall be selected by an independent special district
selection committee to represent special districts in the
county.
Independent special district (b) The independent special district selection committee
selection committee shall consist of the presiding officer of the legislative body
of each independent special district. However, if the
presiding officer of an independent special district is unable
to attend a meeting of the independent special district
selection committee, the legislative body of the district may
appoint one of its members to attend the meeting of the
selection committee in the presiding officer's place. Those
districts shall include districts located wholly within the
county and those containing territory within the county
representing 50 percent or more of the assessed value of
taxable property of the district, as shown on the last
equalized county assessment roll. Each member of the
committee shall be entitled to one vote for each independent
special district of which he or she is the presiding officer.
Members representing a majority of the eligible districts shall
constitute a quorum.
(c)The executive officer shall call and give written notice
of all meetings of the members of the selection committee. A
meeting shall be called and held under either of the following
circumstances:
(1)Whenever a vacancy exists among the members or
alternate members representing independent special districts
upon the commission.
(2)Upon receipt of a written request by one or more
members of the selection committee representing districts
having 10 percent or more of the assessed value of taxable
property within the county, as shown on the last equalized
county assessment roll.
(d) L11 If the executive officer determines that a meeting
of the special district selection committee, for the purpose of
selecting the special district representatives or for filling a
vacancy, is not feasible, the executive officer may conduct
the business of the committee in writing, as provided in this
subdivision. The executive officer may call for nominations
to be submitted in writing within 30 days. At the end of the
nominating period, the executive officer shall prepare and
deliver, or send by certified mail, to each independent special
district one ballot and voting instructions.
(2) As an alternative to the delivery or certified snail the
executive officer, with the prior concurrence of the district,
may transmit the ballot and voting instructions by electronic
