The resolution you adopted expressing your intent to consider acquiring Donner Lake water system by eminent domain, which resolution calls for a public hearing for the purpose of allowing the current owner of the water system to provide evidence and comments; and 2. A letter from Frederick Girard, attorney for Bob Fortino, expressing the desire to be heard at the public hearing This agenda item is called a public hearing. In the formal sense, it is a hearing for Bob Fortino to address the Board regarding our intent to consider condemnation of the Donner Lake water system. It is not a public hearing in the usual sense of that term, where any member of the public is invited and encouraged to provide comments. However, the Brown Act must certainly allow anyone to address the Board on this issue. Dennis DeCuir will attend the meeting and help you deal with any controversy that may arise regarding the public hearing, who should be allowed to address the Board, and what constitutes to official record of the public hearing.
