The first document is a letter dated May 25, 2001 from Carl Lischeske of the California Department of Health Services. This letter states that there is an emergency situation at Donner Lake and asks TDPUD to initiate improvement to the lake intake by June 11. Following is a series of recommended actions which, if approved by the Board, would allow us to move forward quickly to deal with the emergency situation and satisfy the June 11 date suggested by DHS. 1. Resolution declaring an emergency and dispensing with bidding: Attached is a draft resolution which would dispense with bidding and allow the Board to approve a contract to upgrade the lake intake as the first step in dealing with the emergency at Donner Lake. 2. Engineering contract with Luhdorff&Scalmanini: The Luhdorff& Scalmanini engineering firm has been working on plans for the upgrade of the lake intake, replacement of the Southside Tank and replacement of the transmission line between the intake and the tank. Their plans are close to complete. it is to our advantage to continue to work with Luhdorff & Scalmanini to complete the plans and get these projects built. Attached is an engineering proposal from Luhdorff& Scalmanini 3. Professional services contract with Garcia & Associates: As in the case of Luhdorff & Scalmanini, Garcia & Associates has completed most of the work necessary to secure permits to proceed with the three high priority projects. If we continue to work with Garcia & Associates we have a good chance of completing the three projects this year. We believe completion of these three projects could eliminate the boil water order. Attached is a proposal from Garcia & Associates. 4. Contract for replacement of the lake intake: Plans for replacement of the lake intake had reached the point where Donner Lake Water Company was about to enter into a contract with F & M Engineering Contractors of Watsonville, California. Ed Taylor and the engineering staff of Luhdorff& Scalmanini have been working with F & M to get an updated proposal. A copy of that proposal is attached Recommendations I recommend that the Board: 1. Adopt the resolution directing that competitive bidding be dispensed with in connection with the District's repair of the Donner Lake water system. 2. Approve the contract with Luhdorff& Scalmanini 3. Approve the contract with Garcia &Associates 4. Box 309 Truckee, CA 96160 Sent by Facsimile Dear Mr. Holtzmeister: EMERGENCY WATER SYSTEM CONSTRUCTION AT DONNER LAKE The Nevada County Superior Court issued an order dated May 18, 2001 that authorized and empowered Truckee-Donner Public Utility District (TDPUD)to "fully possess and use the (Donner Lake Water Company) property". As you are aware, the water system supplying the Donner Lake Water Company (DLWC) service area is in extremely poor condition, and is considered in a state of public health emergency by the Department of Health Services (DHS)._A description of the system deficiencies and why they constitute an emergency is enclosed. Because of the critical problems in the water system, DHS has issued a number of Orders and Citations against the DLWC that required the water company to issue boil water notices to its customers, imposed a ban on connecting new customers to the water system, and imposed a schedule for correcting the deficiencies. We realize that TDPUD is well aware of the problems with the DLWC system, and that it sought ownership of the water system at the behest of the Donner Lake Community in order to correct these deficiencies. We appreciate the TDPUD's willingness to step in deal with these issues. It is now TDPUD's responsibility to comply with the outstanding directives of the enforcement actions previously imposed upon the DLWC. These are as follows: • Citation No. 01-09-CIT-001 (issued June 28, 2000; imposes a boil water order) • Compliance Order No. 01-09-00-ORD-001 (issued October 31,2000; imposes a ban on new connections) Compliance Order No. 01-09-00-ORD-002 (issued November 20, 2000; imposes a schedule for correcting system deficiencies) We understand that TDPUD, having only recently taken possession of the DLWC system, will not be able to meet the all the deadlines imposed in Compliance Order No. 01-09-00-ORD-002. Mr. Daryl Noel of my staff will be meeting with you and your staff to develop a workable schedule that conforms with the one established in Compliance Order No. 01-09-00-ORD-002 to the maximum extent possible. Our goal is to be able .d Peter H. Holzmeister May 25, 2001 Page 2 to lift the boil water order and the connection ban by the end of October 2001. In order to meet this goal, we have determined that TDPUD will have to correct the following critical system deficiencies by the end of this year's construction season: 1. Replace the lake intake, 2. Replace a substantial portion of the distribution system, and 3. Replace the Southside storage tank. We understand that TDPUD has the same objective. With this in view, we strongly urge TDPUD to take immediate action to formally determine that the water supply situation at Donner Lake is a public health emergency, and should be considered as such for the purposes of contracting and environmental review. Furthermore, we urge TDPUD to initiate work on replacing the lake intake at the earliest possible date, but in no case later than June 11, 2001. In a letter dated May 17, 2001 (enclosed)we informed DLWC that we expected construction activities on this project to commence no later than May 26, 2001, and that failure to do so would be regarded as a violation of Directive 1(e) of Compliance Order No. 01-09-00-ORD-002. In view of the present circumstances, we have concluded that it is reasonable to extend this deadline to the date specified above. Again, we appreciate TDPUD's commitment to correct the serious deficiencies of the Donner Lake water system and will do whatever we can to help expedite the process. Sincerely, Carl Lischeske, P.E., Chief Northern Califomia Region Division of Drinking Water and Environmental Management Critical Deficiencies of the Donner Lake Water System Intake Pipeline The safety of the water supply is compromised by the holes in the intake line near the shoreline. These allow water to be drawn into the water system that is higher in pathogen content that the water farther out into the lake, which acts as a natural settling basin. Replacement is necessary because effective repair is uncertain at best, and is probably impossible. The situation is exacerbated by the fact that the shoreline where the intake line is located is a beach/marina area, where uncontrolled body contact recreation is allowed. This potentially allows the direct introduction of human pathogens into the intake line. It should be noted that the Department's draft recreation guidelines call for a protected area defined by at least a 500-foot setback from the intake line, both along the shoreline and in the lake. It should be further noted that this setback should be extended when body-contact recreation is allowed in the lake, due to the direct pathway for introduction of human pathogens into the lake by such recreation. (Setbacks of over 1,500 feet are common under such circumstances.) The situation is further exacerbated by the inadequate treatment provided by the water system. Chlorine disinfection is the only treatment provided, which is ineffective in destroying many organisms that cause waterbome disease. The distribution system piping Donner Lake Water Company experienced severe, unexpected water outages in the late spring and early summer of 2000. The cause was determined to be a sudden increase in the number of leaks from the distribution system and certain storage tanks. Upon investigation, it was found that the distribution system piping was corroded to the point where much of it had lost its structural integrity. The outages created a vacuum condition in the distribution system that could draw contaminants into the pipes. This possibiliby.of contamination entering the water supply is a serious public health threat. Southside and Eastern Green Point Water Storage Tanks Water is leaking from the Southside and eastern Green Point storage tanks at such a rapid rate that it contributed to the water outages experienced during the last two summers. In addition, inspections of these tanks by qualified experts revealed that they are so badly deteriorated as to be structurally unstable. The Southside tank is in danger of collapse under reasonable anticipated seismic loads, and the bottom of the eastern Green Point Springs tank appears to be so badly deteriorated as to be in danger of collapse. Such collapse could result in loss of, or damage to, life, health, or property in the area down slope of the tanks. Working through these issues has made it necessary to defer some of the deadlines given in Compliance Order No. 01-09-00-ORD-002. We anticipate that this will, at a minimum, affect the deadlines specified in Directives 1(c), 1(e), 3(e), 3(c), 3(e), 6(b), 6(c), and 6(d). It is our intention to require Donner Lake Water Company to begin construction of a particular project element within 10 (ten) working days of the issuance of the permit(s) for that element. We will send a letter to that effect for each project element as the permits are issued. We note that the permit for the lake intake was issued on May 15, 2001. We understand that, while you complied with the letter of the Order by commencing fabrication of the intake line, you were unable to undertake actual construction activities at the site until the permit was issued. You are hereby notified that we expect such activities to commence no later than May 26,2001. Your failure to do so will be regarded as a violation of Directive 1(e), and will result in the imposition of civil penalties. Thank you for your attention to these matters. Gustayson LuhdorfP and Scalmanini 500 First Street Woodland, CA 95695 RESOLUTION NO. 01-_ OF THE TRUCKEE DONNER PUBLIC UTILITY DISTRICT DIRECTING THAT COMPETITIVE BIDDING BE DISPENSED WITH IN CONNECTION WITH THE DISTRICT'S REPAIR OF THE DONNER LAKE WATER SYSTEM WHEREAS, the District has recently taken possession of the Donner Lake water system from the Donner Lake Water Company, pending a final determination of the value of the system and its formal acquisition by the District; and WHEREAS, customers served by the Donner Lake water system have been under a boil water order issued by the State Department of Health Services since June 28, 2000 due to the poor condition of the system; and WHEREAS, the present condition of the Donner Lake water system's lake intake and distribution system poses a danger of contaminants entering the water supply, and the condition of the Southside and eastern Green Point storage tanks is such that both are in imminent danger of collapse, which could result in loss of life, injury. or property damage; and WHEREAS, the District has been ordered to repair and/or replace several parts of the Donner Lake water system, including (i) the lake intake, (ii) most or all of the distribution system, and (iii) the Southside and eastern Green Point storage tanks, by the end of the 2001 construction season; and WHEREAS, the District has been urged by the Department of Health Services to initiate work on replacing the lake intake for the Donner Lake water system no later than June 11, 2001; and WHEREAS, the total cost of performing the repairs to and replacements of portions of the Donner Lake water system which have been ordered completed this year by the Department of Health Services is likely to exceed $1,000,000; and WHEREAS, the Public Contract Code Section 20201 generally requires that the District engage in competitive bidding on any expenditure in excess of and d� WHEREAS,it will take approximately until the end of the 2001 construction season to complete the necessary repairs even if work is commenced immediately; and WHEREAS, it has been determined by District staff that it is not possible to engage in I competitive bidding for the repair of the Donner Lake water system without serious delays which would place the District at risk of noncompliance with the order from the Department of Health Services that repairs to portions of the Donner Lake water system be completed in 2001, and would continue the unacceptable risk posed by the condition of the system to the safety and health of persons using water from the system; and WHEREAS, Public Contract Code Section 22050 provides that in the case of an emergency, a public agency, pursuant to a four-fifths vote of the governing body, may repair or replace a public facility, take any directly related and immediate action required by that emergency, and procure the necessary equipment, services, and supplies for those purposes, without giving notice for bids to let contracts; and WHEREAS, the District's need to repair the Donner Lake water system immediately has created a great emergency which,pursuant to Public Contract Code 22050, is justification for the District to dispense with the competitive bidding procedures for the repair of the system; and WHEREAS, the District has been "strongly urge[d]" by the Department of Health Services, in a letter dated May 25t", 2001, to declare the water supply situation at Donner Lake a public health emergency. NOW, THEREFORE, BE IT RESOLVED that the Board of Directors adopts the above recitals as its findings; and BE IT FURTHER RESOLVED by the Board of Directors that for the reasons set forth above, the District finds that the condition of the Donner Lake water system has created an emergency and that the emergency will not permit a delay resulting from a competitive solicitation for bids, and that repairs to, or replacements of, major portions of the Donner Lake water system are necessary to respond to the emergency. BE IT FURTHER RESOLVED that the District shall therefore dispense with competitive bidding for the repair and/or replacement of the following portions of the Donner Lake water system: (i) the lake intake; (ii) most or all of the distribution system; and (iii) the Southside and eastern Green Point water storage tanks . Included with the summary are our recommendations for proceeding from this point toward your goal of constructing those improvements during this construction season. We understand that you wish to proceed under the provisions of SRF funding and to not contract for work until your District has procured such funding (or assurance that any work will be eligible for reimbursement from SRF funding). Depending on those funding details, we understand that you may not proceed directly to construction; however, we have attempted to organize our summary such that you can proceed whenever you so decide with an understanding of where the design work is, what might be involved in finalizing or modifying it for conformance with TDPUD's standards, what remains to be permitted,what contractual (fabrication)work has been started, and what bidding and construction-related engineering work needs to be undertaken to complete the work envisioned for 2001. Finally, in response to your request, the recommendations incorporated into our summary can be interpreted as a the scope of a proposal to provide the recommended engineering services for finalization of designs and technical assistance during construction. Plans and specifications were completed over a month ago; based on those plans and specifications,DLWC solicited bids and received two responses. The low responsible bidder was F &M Engineering Contractors of Watsonville, California. DLWC verbally authorized F &M to commence work by constructing the intake screen. The permits for the work have been received from the RWQCB and the California Department of Fish and Game, and the installation of the intake was to have proceeded once the executed contract/insurance requirements were received from F &M by the DLWC_ From our discussion with you, it is apparent TDPUD.would prefer a modification of the intake facility to include submersible pumps instead of utilizing the existing booster pumps. Under that scenario,the intake screen fabricated by F &M would still be utilized, but with different pipe into the lake to accommodate the submersible pumps. The electrical equipment for the submersibles would be housed within the existing pump building. Further enhancements could include the installation of some limited filtration within the building. As part of our design of a surface water treatment plant for DLWC,we designed a lake intake that incorporated submersible pumps in the lake intake in a manner identical to the TDPUD's concept. That design also included plans and specifications. Recognizing that the head-capacity requirements of the submersible pump(s) for your proposed operational scenario will be different than that for the water treatment plant, some minor modifications to those existing plans and specifications will be required. Work on those modifications can be completed within five working days. Assuming that to be the desire of your District, we would recommend the following to complete a new lake intake: • meet with TDPUD staff to discuss modifications to the existing plans and specifications; • modify the plans and specifications for the intake to conform with the TDPUD's desire to utilize submersible pumps; • resubmit the plans to the Department of Health Services and the TDPUD for review and comment; incorporate comments into the plans and specifications as appropriate; • TDPUD contract with F &M Engineering Contractors on the basis of its prior low bid; in effect"purchase"the lake intake screen already fabricated by F &M; and negotiate a change order (actually a revised bid) for the modified design to incorporate submersible pumps; EaLUHOOPFF a SCAI..MANNNI C.IJ 1'..T ING I'N II I 1 7.S 'MRY 23 '01 04.a0PM LUNDORFF & SCRLMRNINI P.4i6 Mr. Holzmeister and Mr. Taylor May 23, 2001 Page 3 • provide technical assistance during the installation and startup of the facility, including inspection as appropriate and startup testing; and . provide assistance with,if necessary,:mechanical drawings and specifications associated with the installation of a"bag"or other filter at the lake intake. Replacement of the Southside Tank Plans and specifications for the replacement of the Southside tank are presently 85 percent complete awaiting the completion of additional topographical work and permitting requirements from the RWQCB regarding wetlands issues at that site. An additional requirement entails the acquisition of a small parcel of land from an adjacent property owner since any improvements are restricted to the southeast comer of the parcel to maintain adequate separation from wetlands. To provide for additional site access, on behalf of DLWC,we contacted the property owner and have received a favorable response pertaining to a parcel split,with the understanding that the Water Company(presumably now your District)would purchase the split parcel and would furnish a recorded plat map. No purchase price details have been discussed with the property owner. From the completed topographical work(authorized by DLWC and scheduled to be presently completed),the civil site plan,with all finished grades, can be completed. Included with the tank design is a booster pump design, which is required to solve the problem of low pressure in the Mt. Judah-Devils Peak Road area. Based upon the above,we would recommend the following to complete the replacement of the Southside tank: • meet with TDPUD to discuss possible plan and specification changes; • assemble the completed topographical work; • complete the negotiated parcel acquisition,including the filing of a land division map,with the adjacent property owner; • complete the site grading-paving plan; • submit the plans and specifications to the Department of Health Services and TDPUD for review and comment; incorporate comments into the plans and specifications as appropriate; • solicitation of proposals from qualified contractors; and © LUHOORFP & SGALMANINI rrvc��r .n:r Erv..iNrc,.'fib` " MAY 23 '01 04:01PM LUHDORFF & SCALMANINI P.5i6 Mr. Holzmeister and Mr. Taylor May 23, 2001 Page 4 • provide technical assistance during construction of the tank and booster station, including answering questions during the bid process (including an on-site pre- bid conference);review proposals and recommend award;review contractor submittals; inspect the work at various project milestones; review contractor progress billings and recommend payment; and project closeout, including as- built drawings. Pipeline Replacement As you are aware, the original pipeline project was to entail the replacement of approximately 31,000 lineal feet of existing pipe along Southshore-Drive,Donner Pass Road, and Reed Avenue, terminating at Olympic Court. Since submittal of the plans and specifications for review by various regulatory agencies, several project complications(such as right-of-way, and wetlands issues) have come to light that will impede progress on pipeline replacement, as originally envisioned this summer. Subsequently, with the concurrence of the Department of Health Services, a modification was made to the original scope of the project. The modifications included the elimination of any work, for this construction year,proceeding beyond(east of)the intersection of Dormer Pass Road and Reed Avenue. Hence,the pipeline work for this construction season would now be confined to Devils Peak Road, Mt.Judah Drive, Southshore Drive and a portion of Donner Pass Road(from Southshore Drive to Reed Avenue). We have modified the plans to reflect not only the reduced scope of pipelines to be replaced,but incorporated some of TDPUD standards into the plans and specifications. Some minor modifications to the specifications still remain to be made,but we estimate that these changes can be completed in about three working days. Along with the above work, we are also close to completing the permit process with the RWQCB and the California Department of Fish and Game. The final plans and specifications will have to be resubmitted to the Town of Truckee for encroachment permitting. As we discussed there are several on-going environmental permitting processes occurring simultaneously with the Lahontan Regional Water Quality Control Board (LRWQCB), California Department of Fish and Game (CDFG), U.S. Army Corps of Engineers (USACOE), and the U.S. Fish and Wildlife Service (USFWS). The environmental processes pertain to various aspects of construction activities associated with the improvements to the water system. Working from the flow diagram I provided yesterday the following overview and scope of services for either completing or complying with existing environmental permits is provided: Task la: LAKE INTAKE: • The LRWQCB has issued a permit for this component of the project. The TDPUD must comply with specific BMP's and erosion control measures, and follow up reporting once installation is complete. A biologist will also need to monitor the installation of the pipe only from the existing pumphouse to the distance of trenching within the lake, estimated at taking 3 days. Total estimated level of effort to complete, including 3 days field monitoring, is 32 hours. • The CDFG has issued a permit for this component of the project. The TDPUD must comply with specific BMP's and erosion control measures, and follow up reporting once installation is complete. A biologist will also need to monitor the installation of 1 the pipe only from the existing pumphouse to the distance of trenching within the lake. Total estimated level of effort to complete is 4 hours. (Please note that the level of effort for the field monitoring is already covered under time allocated for the LRWQCB stated above.) • The USACOE has issued a permit for this component of the project. The TDPUD must communicate and forward a copy of the LRWQCB permit to the USACOE before this agency's permit is valid. The TDPUD will also be required to comply with specific BMP's and erosion control measures, and follow up reporting once installation is complete. Total estimated level of effort to complete is 4 hours. Task lb: REPLACEMENT OF MAINLINE DISTRIBUTION for 2001: • The LRWQCB will issue a permit for this component of the project once specific responses to this agency's request for additional information dated May 8, 2001 is submitted. I have a draft response letter but it will need further coordination with the TDPUD regarding specific methods for placement of the pipe either above or below culverts, and specific detail for the 3 bridge crossings as discussed. The TDPUD will also be required to comply with specific BMP's and erosion control measures, and follow up reporting once the pipe replacement is complete. A biologist will also need to monitor the placement of the pipe only for the 3 bridge crossings, estimated at taking 3 days for each bridge crossing. Total estimated level of effort to complete, including field monitoring, is 94 hours. • The CDFG issued a permit for this component of the project this morning. Ron Perrault (CDFG Regional Warden-Truckee) phoned me at 8 am. with the news that the permit is being sent to me. The permit will need to be changed to the TDPUD (currently under the DLWC-Bob Fortino). The TDPUD must comply with specific BMP's and erosion control measures, and follow up reporting once replacement is complete. Total estimated level of effort to complete is 4 hours. Please note that the level of effort for the field monitoring is already covered under time allocated for the LRWQCB stated above. • The USACOE has been informed of this component of the project and are reviewing the proposed plans. The TDPUD must communicate and forward a copy of the LRWQCB and CDFG permits to the USACOE as part of this agency's coordination efforts, specifically pertaining to the creek crossings. Total estimated level of effort to complete is 4 hours. Task 1c: REPLACEMENT OF SOUTHSIDE WATER STORAGE TANK : • The USACOE has been sent a reconnaissance level wetland determination report as part of the permitting process for this component of the project. The USACOE needs to conduct a site visit and make a jurisdictional determination of the presence/absence of wetlands, based on USACOE criteria. The report which I submitted on April 17, 2001 states that it is my professional opinion that while potential USACOE wetland 2 conditions exist to the west of the existing tank, replacement of the tank will not impact Waters of the U.S. In addition, I state that it is my professional opinion that the leaking tank and associated piping has enhanced wetland conditions and that replacement of the piping from the existing tank to Mt. Judah Drive is not a USACOE jurisdictional wetland issue. The TDPUD must complete the wetland determination process with the USACOE, including any revised options for the piping (as we discussed moving it further to the east). Total estimated level of effort to complete is 8 hours and assumes no further wetland surveying will be necessary. • The LRWQCB requires a copy of the USACOE wetland determination, along with submission of a Form 200 for a Waste Discharge Permit and accompanying project description, construction details, precipitation containment, overflow containment, and other pertinent details to begin this agency's review process. (If the USACOE determines that any wetland area would be impacted, it could trigger additional Section 401 Water Quality Certification. However, for the purpose of this scope I have assumed that additional permitting is not necessary). This Work Authorization Order is being provided pursuant to and in accordance with the enclosed Scope of Services. The total level of effort to complete this task is 186 hours at a rate of$86 per hour plus 3 hours of contract administration time at$52 per hour. Other Direct Costs (ODCs)including mileage,phone/fax, and supplies are estimated at$768. 4 b. Invoicing and Payment. Consultant shall submit to Company an invoice within thirty (30) days after the end of each month on which Work is performed by Contractor hereunder.
