closed for the Glenshire Water System Acquisition and Improvements negative declaration.
Two comment letters were received during the review pe'fiod for the environmental documents.
The Board of Directors held a Public Hearing on October' 17,2001. Along with this memo are

Finding: It is hereby found that the above named project will not have a significant effect upon the
environment.

Initial An initial study of this project was undertaken and prepared in accordance with Article V
Study: of the District's local environmental guideli�j'es and Section 15063 of the EIR Guidelines for
the California Environmental Quality Act for'the purpose of ascertaining whether this project
might have a significant effect upon the environment. A copy of such initial study is
attached hereto and incorporated herein by r6ference. Such initial study documents reasons
to support the above finding.

COMMENTS AND RES ONSES
The following are responses to comments received durin�the circulation and review of the
proposed negative declaration and initial study for the"Glenshire Water System Acquisition and
Improvements." Copies of each of the comment letters re attached. PP
Letter from Town of Truckee dated October 17,2001: i,

Comment: District should consider expanding the proposed annexation boundaries to
include the area known as Tahoe Boca Estates.
Response: Comment acknowledged. The District is proposing to annex only the existing
service area of the Glenshire Mutual Watcr Company. It is the District's standard
practice to annex areas at the request of the prope�y owner requesting service and at the
property owner's expense, As of this date, there `s no request for District water service ry;
from the property owners representing Tahoe Boa Estates.

Continent: With rupcet to the ucw pipeline needed to serve Glenshire, the potential route
along Old Airport Koad is the least desirable rout' from an environmental and land
perspective. The Town requests that the District from
that the Glenshire Well route is the
preferred rote while: the Old Airport Read route s the least preferred.
Resgo_pse, Comment acknowledged. The District has only identified some possible
pipcliuc routes and has nut attempted to analyze t�a merits of any of the alternatives.
Additional potential routes may be identified as tl a District pursues identification of the
preferred alignment. Although the' reque.t to have the Glenshire We1I route the
preferred route and the Old Airport Road route th least preferred route is duly noted, it
would be premature for the District to make any statement with regard to a preferred
pipeline route.

Comment: The proposed negative declaration did not provide information on the size or p
location of the proposed replacement water tanksi The Town requests that site specific
cuvirunrueutul review be dune prior to cunstructit#n of the new tanks.
Kesponses: Section 8 of the Initial Study includes a discussion of the proposed
replacement water storage tank. The following information is intended to provide
Additional clarification as to the location and size of the tank. The District is proposing to
replace one of the two existing Strand Tanks with a larger capacity tank at the same
location. One of the existing tanks will be remov and a new tank erected in it s place.
The tank site is located at the south end of The nd ` Glenshire. The existing tank to
be replaced is approximately 24 feet high by 32 f et in diameter with a capacity of
420,000 gallons. The proposed new tank will have dimensions of approximately 32 feet
high by 75 feet in diameter with a capacity of 1,260,000 gallons. Because the rrcw idtak
will be on the same site as the existing tank, site v ork to accommodate the larger
diameter is expected to be minimal. Potential impacts associated with the construction of
the replacement tank is considered less than significant.

Letter from State Department of Health Services dated October 29,2001.
Comment: If the District plans to acquire,operate and maintain the Glenshire system,
DHS may need to amend the current water supply permit or provide a new water supply
permit. Before a permit or amended permit can be issued,DHS will need a copy of
environmental documentation.
Response: Comment aclrnowledged. The initial study identified the Department of
Health Services, Office of Drinking Water, as an agency whose approval will be required
as a part of this project. The District intends to comply with all permit or amended
permit application requirements including provision of environmental documentation to
DHS.
Comments by District Legal Counsel Steve Gross during Public Hearing on October 17,2001,
regarding adoption of mitigation measures with respect to growth inducing impacts,
CEQA allows agencies to streamline environmental review by following the procedure
set furth in section 21083.3 of the Public Resources Code and its counterpart in the
CEQA guidelines,section 15168, Under this procedure, projects which are consistent
with the development density established by an e� isting general plan will generally not
have to undertake further environmental review for issues which arc adequately
addressed in the general plan raid accompanying environmental review. Additional
environmental review is still required to identify and address any project-specific
significant effects. In the case of the Glenshire aci.quisition and improvement project, this
procedure does apply to potential growth-inducing effects.
One of the steps public agencies are required to take in order to use this procedure is to
adopt any mitigation measures contained in the general plan for the environmental effect
for which the agency wants to streamline its review. Tn order to streamline the review of
growth-inducing effects, the District has adopted'the mitigation measures for growth-
inducing impacts which are contained in the Tow4 of Tiuukce's general plan. These
mitigation measures are not added to reduce a potential significant impact to a level less
than significant, rather they are added out of an abundance of caution with respect to
growth-inducing effects.

Diri iot's actions to acquire the Glenshire Water Systerri and to annex the Glenshire Area into the
District. Nonetheless, we have the tollowine, comments on the proposed Negative Declaration
that we hope will assist your Board of Directors:
1, Rec.alrsl, the District annexation process can be lengthy and time-consundug, we believe it
would be advantageous for the District to expand the proposed annexation boundaries of
your proposal and to annex the area known as Tahoe Boca Estates (western half of Section
3) as part of the Glenshire Water System annex ation. This Tahnn Boca Estates rhea is
located within the Town and is 7.nned for a residential density that wil! require community 1
water service from the District, In addition, btti ed on our discussions with the pr:yperty
owners and developers, it appears that this urod could be subdivided within the next
swct01 yrixi5.
Tlnderstandinp that further environmental review will be necessary for the pipeline to the G

Services, Division of Drinking Water and Environmental Management (Di is responsible for
.water supply permits administered under the Safe I Drinking Water Program, If the Truckee
Dormer Pui Utility District plans to acquire, ope�ale and maintain the Glenuhlre Mutual
Water Company and make improvements to the Water system in order to provide water for
domestic use and fire protection, DIFIS may need to amend the current permit or plovidn a 11Rw
water supply permit. Accordingly, DHS would be � responsible agency pursuant to CEQA and
may need to consider an environmental document when deciding whether to permit the new

MITIGATION MONITORING PROGRAM
The Mitigation Monitoring Program insures the enforcement of mitigation measures included in
the project's negative declaration. The Environmental Initial Study identifies mitigation
monitoring responsibilities including method of implementation, timing of implementation,and
responsible party.

The following Mitigation Monitoring Program Checklist provides a method to verify
implementation of mitigation measures. Typically, mitigation measures are implemented at
three phases of a project; project planning and design, project construction, and following project
completion. The checklist shows verification of implementation at each phase for each
