Subject: Amending certain Donner Lake parcel assessments
At the last meeting of the Board we discussed several Donner Lake parcel assessments
that needed to be revisited. After a long discussion the Board agreed to amend or
repeal certain parcel assessments. The attached resolution accomplishes exactly that.
Also attached for your review is the staff report that was presented at the last meeting.
RECOMMENDATION: I recommend that the Board adopt the resolution amending
Resolution No. 2001-09 by amending certain assessments.

Amending Resolution No. 2002-09 by amending certain assessments
WHEREAS the Board of Directors adopted Resolution No. 2002-09 which made determinations,
confirmed assessments and proceedings, ordered the acquisition and construction of improvements
and took certain other actions relating to Donner Lake Water Assessment District No. 00-1; and
WHEREAS, subsequent to adoption of Resolution No. 2001-09, certain information has come to
light as follows:
1. Certain property owners have merged multiple adjacent assessed lots into a single lot
2. The formula used in the Assessment District Engineer's Report to determine assessments on
motel units was applied in error
3. That certain parcels are too small to be built on, or as so located as to be removed from the water
system improvements and shall therefore never benefit from the improvements made by the
assessment district; and
WHEREAS THE District determines that, based on the above findings, certain assessment
confirmed in Resolution 2001-09 should be amended or repealed;
NOW THEREFORE BE IT RESOLVED BY THE BOARD ODFDIRECTORS OF THE DISTRICT AS
FOLLOWS:
1. The parcel assessments for APN 17-301-15, APN 17-301-16 and APN 17-301-01shall be
rescinded because they were merged into a single new parcel identified as APN 17-301-70, and this
new parcel shall be assessed at six thousand nine hundred twenty-five dollars and fifty two-cents
($6,925.52)
2. The parcel assessments for APN 17-301-39 and APN 17-301-39 shall be rescinded because they
were merged into a single new parcel, and this new parcel shall be assessed at 17-301-40 and
place an assessment in the amount of at six thousand nine hundred twenty-five dollars and fifty two-
cents ($6,925.52) once it has been given a new APN.
3. The parcel assessments for APN 17-160-31 shall be amended to be fifteen thousand five
hundred eighty-two dollars and forty-two cents ($15,582.42) and for APN 17-160-321 shall be
amended to twelve thousand four hundred sixty-five dollars and ninety-four cents ($12,465.94).

4. The parcel assessment for APN 18-352-02 shall be amended to twenty-four thousand nine
hundred thirty-one dollars and eighty-seven cents ($24,931.87).
5. The parcel assessments for APN 18-374-24 shall be thirty-one thousand one hyndred sixty-four
dollars and eighty-four cents ($31,164.84 and APN 18-374-18 shall be twenty-one thousand eight
hundred fifteen dollars and thirty-nine cents ($21,815.39).
6. The parcel assessment for APN 17-150-28 shall be amended to ten thousand three hundred
eighty-eight dollars and twenty-eight cents.
7. The parcel assessments on the following parcels, said parcels being too shall to build on or being
located such as to not benefit from the water system improvements, shall be rescinded: APNs 17-
270-01, 17-150-06, 17-260-01, 17-261-16, 069-170-016, 17-020-19, 17-060-02, 17-070-14
8. All other resolutions adopted by the Board of Directors shall remain in effect except to the extend
that the terms therein conflict with the terms of this resolution.

Subject: Donner Lake Assessment
It sometimes appears to me that we will never be completely finished with Donner Lake
Assessment District adjustments. In this memorandum I will describe several
adjustments to assessments that I think need to be considered by the Board. The
adjustments fall into five categories.
1) Two property owners have completed the merger of vacant parcels with the
adjoining parcels which they also own
2) The Board adopted a new policy governing exemptions for common area
parcels. I am now working with the various homeowner associations to complete
the application process.
3) Four motel properties were erroneously assessed, based on bad data that I
gave to Kristen Lowell of Lowell and Associated. We need to adjust the
assessments for the four motels.
4) There is one multi-family structure that was assessed incorrectly.
5) A handful of parcels are not benefiting from the water system and therefore
should not be assessed
In the remainder of this memorandum I will describe the details of each of the above
cited issues.
1. Parcels that have been merged with adjacent parcels. Mahnaz Dashti, who
initially owned three parcels (17-301-15, 17-301-16 and 17-310-01) has merged all three
into a single parcel (17-301-70) Attached is the Nevada County Assessor notice
confirming the action. Justin States, who initially owned two parcels (17-301-39 and 17-
301-40 has combined them into a single parcel. The County has not yet given the new
parcel a number. Attached is the Nevada County Certificate of Merger.
RECOMMENDATION: I recommend that the board rescind the assessments applicable
to APNs 17-301-15, 17-301-16 and 17-301-01 and place an assessment in the amount
of $6,925.52 on parcel 17-301-70 and I further recommend that the Board rescind the
assessment on APNs 17-301-39 and 17-301-40 and place an assessment in the amount
of$6,925.52 on the new parcel once it has been given an APN.
2. Common area exemptions. At this time I do not have completed applications for
exemptions from any of the homeowners associations. I am working with Wolfe Estates,
Donner Tract, Donner Lake Property Owners Association, Donner Lakeside Landing,
Donner Lake Vista Homeowner Association, Tinkers landing Homeowner Association,
Donner Pines West and Donner Pines East Homeowner Associations and Donner lake
Woods Property Owners Association. There is one other small association that does not
have an official name that the owners can remember. This matter will come back to the
Board in the near future.
3. Motel assessments. There are four motels at Donner Lake that have been
erroneously assessed. The formula determined by the Engineer Report for
determination of the assessment for motels is as follows:
Number of Units X the Standard Dwelling Unit Assessment X 45%
For example, the assessment for a motel with ten units would be calculated as follows:
10 units times $6,925.52 times .45 = $31,164.
The key data that I needed to give to Kristen Lowell was the number of units in each
motel. I apparently gave her bad data.
Richards Motel was assessed $65,446.20. The motel has two parcels with 5 units on
one parcel and 4 units on the other parcel. The calculation of their assessment should
be:
APN 17-160-31 has 5 units X $6,925.52 X .45 = $15,582.42
APN 17-160-32 has 4 units X $6,925.52 X A5 = $12,465.94
Total $28,048.36
RECOMMENDATION: I recommend that the assessments for APNs 17-160-31 and 17-
160-32 be amended to $15,582.42 and $12,465.94 respectively.
Lock Leven Lodge was assessed $34,281.34. The motel has 8 units. The calculation
for the motel should be
APN 18-352-02 has 8 units X $6,925.52 X .45 = $24,931.87
RECOMMENDATION: I recommend that the assessment for APN 18-352-02 be
amended to $24,931.87.
Lakeview Motel and Donner Trails Motel are owned by James Stiles. They were
assessed $24,931.89 and $34,281.34 respectively. Lakeview Motel has 10 units and
Donner Trails Motel has 7 units. The calculation of their assessments should be as
follows:
Lakeview (APN 18-374-24) 10 units X $6,925.52 X .45 = $31,164.84
Donner Trails (APN 18-374-18) 7 units x $6,925.52 X .45 = $21,815.39
RECOMMENDATION: I recommend that the assessments for APNs 18-374-24 and 18-
374-18 be amended to $31,164.84 and $21,815.39 respectively.
4. One multi-family structure. Jeff Metz owns a duplex APN 17-150-28. It was
assessed at $13,851.05 We had adopted a formula relating to multi-family rental houses
on a single parcel as follows: the first unit is assessed the full $6,925.52 and all
subsequent units are assessed at 50% of the full assessment. APN 17-150-28 should
have been assessed 1.5 times $6,925.52 = $10,388.28.
RECOMMENDATION: I recommend that the assessment for APN 17-150-28 be
amended to $10,388.28
5. Parcels not benefiting. There are a few parcels that do not benefit from the Donner
Lake water system
APN 17-270-01 -Too small to build on
APN 17-150-06 - Isolated from the water system. May be added in the future as
circumstances change.
APN 17-260-01 - Isolated from the water system. May be added in the future as
circumstances change
APN 17-261-16 -Too Small to build on
APN 069-170-016 - Too small to build on
APN 17-020-19 - Isolated from the water system. May be added in the future as
circumstances change
APN 17-060-02 - Isolated from the water system. May be added in the future as
circumstances change
APN 17-070-14 - Too small to build on
I will bring maps to the Board meeting so the Directors can have a full discussion of
these issues
RECOMMENDATION: I recommend that the board rescind the assessments on APNs
170270-01, 17-150-06, 17-260-01, 17-261-16, 069-170-016, 17-020-19, 17-060-02, 17-
070-14.

of California Subdivision Map Act, Section 66451.12 and 66499.203/4 and Town of
