Resolution No. 2025-21
Rescinding District Resolution No. 9519 and Terminating the
Sole Source Procurement Authorization for Eaton Products
WHEREAS, the Truckee Donner Public Utility District ("District") previously adopted
Resolution No. 9519, determining that the exclusive purchase of Cooper Power Systems,
now named Eaton Products, reclosers and microprocessor-based recloser controls was in
the District's best interest and that competitive bidding for such equipment was undesirable
and impractical; and
WHEREAS, the District has since reevaluated this position and determined that seeking
competitive bids for reclosers and recloser controls may provide greater value, technological
diversity, and pricing advantages to the District; and
WHEREAS, the supply chain circumstances that justified the sole sourcing of Cooper Power
Systems equipment under Resolution No. 9519 no longer outweigh the potential benefits of
competitive procurement, including access to innovation, better pricing, and improved
functionality from a broader market; and
WHEREAS, the District desires to rescind Resolution No. 9519 terminating the sole source
procurement authorization and returning to competitively bid procurements of reclosers and
microprocessor-based recloser controls in accordance with applicable public contract
requirements;
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Truckee Donner
Public Utility District as follows:
1. Resolution No. 2025-21 rescinds Resolution 9519, terminating the sole source
procurement authorization of Cooper Power Systems (aka Eaton Products)
reclosers and microprocessor-based recloser controls with future procurements to
be executed in accordance with District Code Title 3.08.
PASSED AND ADOPTED by the Board of Directors of the Truckee Donner Public Utility
District at a meeting held within said District on August 20, 2025 by the following vote:
AYES: Murrell, Randall, Bender, Laliotis, Finn
NOES: none
ABSENT: none
ABSTAIN: none
